This being a scheduled Public Hearing the following items were presented to the Board of County
Commissioners for their consideration:
ZS-236-96, Category III, Vail Ski Area
Chairman Johnson opened the meeting setting the ground rules, He asked that no side bars take place in the
meeting room. He introduced Keith Montag, Director of Community Development.
Keith Montag presented file number ZS-236-96, Category III, Vail Ski Area Expansion Hearing, He stated
the applicant is Vail Associates and introduced their representatives.
Mr, Montag introduced Jim Fritz, County Attorney
Jim Fritze, County Attorney, stated this application is not a normal one and this is a hearing pursuant to a
resolution adopted in 1986, He stated the current Board was not seated at that time, He read the conditions of the
resolution stating the plan, when more completed, was to be brought before the Board. A second condition was that
Vail Associates would meet some of the parking requirements, The most significant development was in 1987 the
US Supreme Court rendered a decision which had to do with preempted local regulations, The law continues to
evolve and in preparing for the meeting they have seen cases that have come down as recently as last year. This
isn't the normal land use matter because it is on Forest Service land and there is the preemption. The County is still
allowed to attach conditions with regard to its own environmental regulations. So the Board's authority will not be
the normal land use criteria nor is it a popularity contest. The Board will have to apply specific regulations, They
have received correspondence from proponents and opponents to this application. He stated the applicant might
suggest they have less authority than they do and the proponents might consider they have more authority, They
will look to those present to provide direction, With that in mind he is suggesting to the Board they allow this
hearing to stay open for a period of time to allow for written documentation to be submitted regarding the actions of
the Board. They have received comments relating to a 1041 permit and if water and sewer is required a 1041 would
be needed. The applicant has acknowledged this and they have been through this drill before, He stated because of
this preemption issue this hearing will have to deal with the legal issues and the Board's authority.
Chairman Johnson suggested if the people in the back cannot hear during this hearing he would like to
know, He introduced Sara Fisher, Jim Fritze, the Board, Jim Hartmann, Jack Ingstad and Keith Montag,
Keith Montag reviewed the proposal for the Board, In 1986, Eagle County approved the conceptual
development of Category III as a Special Use within the Resource Zone, He stated there were originally two
conditions one which was the need for the hearing being held tonight. The second was an issue with parking, Mr.
Montag reviewed the history stating it is in compliance with the NEP A. The United States Forest Service
completed an environmental Impact Statement and published a record of decision, Mr. Montag stated the applicant
will give a complete overview ofthe application, Mr. Montag explained it is 4,100 acres, 4 lifts, 885 acres, 11.1
miles of ski-way roads, 1.1 miles of roads, etc. He spoke to the referral letters received and stated the Board has
every letter that has been submitted and sent. They have heard from the town of Red Cliff and the Town of
Minturn, both voicing concerns with potential impacts, water impacts, water source, concern with human activity,
He stated he received verbal responses from the Environmental Health Department, Colorado Geological Survey
with regard to use of the restaurant. He spoke to the issues and concerns, He stated the basis is from a letter sent
back in 1996. In that letter numerous concerns were identified, Although the Eagle County Master Plan supports
expansion of the recreational economic base in the County a balance must be achieved, He continued to review
Staff s report,
Mr. Montag reminded the Board that conceptual approval was granted back in 1986. The Board does have

meetings were pointed out on two charts. A former planner, Kathy Eastley, attended most ofthe hearings, She was
involved, knew what was going on, Keith Montag wrote an extensive letter during the EIS process, He stated they
implemented several of those changes, Keith had input, the County had input, many changes were made, Is this the
end of the County process, if they say yes, it is not the end of the process, HB 1041 requires an applicant come
back. They acknowledge the construction of the restaurant will require them to be back. That is the time and place
to deal with the environmental issues, They think Category III is the most studied and scrutinized ski area in the
world, They have more studies than they did for DIA and more hearings, This is not the first hearing, and they are
not the first people to study the issues, The Forest Service process was not a quick process, The studies were based
on science and experts, with knowledge as applied to the ski area. There are 62 volumes on the table, There is
reason the forest service develops an EIS which summarizes, It's science, it is what was done. The experts
developed the studies. They looked at the issues and the scientific nature of what they were doing, The 1998 EIS
was 770 pages prepared by a team of 32, 70 different studies mostly focused on environmental. Experts have
looked at this and it was not a rubber stamp, It is probably the best ski design in the country,
Mitigation they have agreed to was done by groups and presented on 13 boards, wildlife and bio-diversity ,
water quality, hydrology, aquatic resources, and wetlands, To the extent those have been considered and not dealt
with, they will listen, Some of the specifics will be heard later,
The down zoning from 1986 included the old forest from 96 to 54 acres, wetland disturbance less than 1.5
acres, the old growth forest disturbance they believe is less than 1 %, In 1986 VA provided a total of 149 beds for
its employees, this year 1,282 beds, 1986 there was a 4-way, now there are round-a-bouts.
On social economics SAOT is 19,900. Up front they agree and they will not seek to increase it. The needs
and purpose of CAT III is to fill the valleys not add to the peaks, The problem is they need early snow to fill the
valleys, these are north facing slopes, this will spread out the skiers and make it a better experience, They believe
for safety and guest quality they are doing Cat III, The Town of Vail agreement was over two years in the making
adopted unanimously by their council. Conclusion reached as a resolution adopted in 1995 by the Town of Vail
supporting CAT III. The Town looked very hard at the impact not only avoiding negative impact and they saw a
positive impact. He handed out a letter dated March 9, 1998 from town manager of the Town of Vail. He enclosed
a copy of Res, 95-4 from the town.
Chairman Johnson introduced the letter as Exhibit C.
Mr. Mandel spoke to the employees and the letters they have received about housing and employee
concerns, He stated they have done their job and they will find the employees.
Off site impacts will contribute to the growth in the area. Growth will happen and this will have a minor
impact.
Land on Battle Mountain, 1962 when Mr. Seibert discovered Vail Mountain and decided to construct a ski
area Vail Associates had no interest. In 1986 when this Board approved CAT III Battle Mountain was private land.
In the early 1990's they were approached by Denver lawyers who acquired property within a mile of the proposed
area. It was a defensive measure the company jumped on, V A has the option to acquire Y2 interest in all of the
land. It is somewhere between 4000 and 6000 acres, It is in a legal quagmire, it is a mess, He believes they are the
best of the group, There are prospectors out for mining. They care about the valley and are good stewards to the
valley. Is this relevant, it is, Tonight's hearing isn't about Adam's Rib, its not about the Vail Valley Center, and
they are not talking about Battle Mountain as it is private land. He spoke to the letters in the packets, Any
discussion of uses are irresponsible and speculative, The land has not come forward to this Board, The land is
subject to regulations, They don't own it, they have an option to participate. They want to be involved, He spoke
to the process they would have to go through, There is a process and a system to deal with that development and it
is not tonight's fight nor the purpose of CAT III,
The restaurant is a concept and an environmental discussion to happen, Before anyone can build, that is
1041, That is a process they will need to go through, They would ask that decision not be made tonight. He stated
there is no evidence to conclude that it is an environmental impact. It is not today's argument and they are not
going to build it until they have the required environmental approvals,
He reminded all to look at the scope of the hearing and stay focused on the environmental aspects, Are there
environmental issues that are not mitigated, are there air issues, are there wildlife issues,
Tom Allendar, with Vail Associates, reviewed the history of the 1986 master development plan that
established CAT I and II, CAT II is all the terrain on the south side of Two Elk. As part ofthe exploration they
preformed a number of studies and created a conceptual plan developed on conceptual lines, He showed a map of

Mr. Kroenke continued to review his typed presentation for the Board,
Kit Buel, Wildlife Biologist, showed a map on the overhead, He displayed photos which were identified by
exhibit # M 1 which show the portions of the tree coverage and the forage, He showed the lower elevations of CAT
III and the lodge pole pine, He stated there are 14 to 28 year old lodge pole pine at this site, He stated they took the
suitable habitat assumptions and parlayed them onto the designs, He stated the impacts will be less than what they
modeled. They modeled using the same assumptions and the same data base, He showed the different levels of
potential forage, They are trying demonstrate that Vail is not the only area that has potential for lynx, He stated the
mitigation measures will help the lynx and measures taken into account to develop the landscape. He spoke to the
conservation easement and the process they are now going through to develop a working plan,
Chairman Johnson asked ifthey are looking at the environmental impacts in the area as well as outside, He
suggested in the record of decision the off site impacts would be administered by other agencies, It sounds like they
are recognizing there will be off site impacts and asked within what process will they look at those.
Mr. Delvillar responded about the additional employees and one of the things they looked at were the
impacts to adjacent counties. He stated when they looked outside of Eagle County they felt their housing needs
would be minor as to what housing is available. He stated they only viewed five or six employees impacting
outside of Eagle County, He suggested there may not need to be a process for that example.
Chairman Johnson asked when they will have something in writing from Fish and Wildlife,
Mr. Delvillar responded they understand in about June of this year the agency will sit as proposed for listing.
What that means for them is in cooperation and during that twelve month period they will be working closely with
them on formal conferencing in regard to this project and that would result in a conference report, They think that
will be similar to what they had originally been cooperating with the development of a conservation agreement on
this project. They will be able to identify anything that will be needed for this project and others,
Chairman Johnson suggested in June they will take comments and by June of 1999 they will have their
listing.
Tom Olden, area resident, stated he wants to speak to the DOW agreement they have, He stated they had
their wildlife consultants working with the DOW and came up with 34 additional conditions, He spoke to their
belief there will not be cumulative impacts. The Colorado DOW agrees the mitigation is adequate,
He spoke to the concern of staff, The master plan - they have looked at the goals as enhanced early and late
skiing. He spoke to the conditions in the back bowls stating those skiing in the back plug up the intermediate
terrain, It would improve bowl skiing throughout the season, they are north facing and would provide good skiing,
It is a dramatic increase of intermediate skiing, The most they could gain on the front side is sixty acres which is
roughly two acres additional. This would double the terrain on the mountain, It would improve the distribution of
skiing,
Commissioner Gates asked if there is any plan to do snow making on CAT III.
Mr. Olden responded no, They believe the addition of CAT III and its early and late skiing will be a help to
the local economy, He spoke to the impacts being mitigated, He stated there are 32 mitigation measures from the
DOW agreement. They do not show the 2 for 1 mitigation with the Corps, They do not show other mitigating
plans. They covered the concerns of wildlife issues. They have gone down to 56 acres of one type of lynx habitat
and 120 acres of other habitat. They have voluntarily moved Super Bowl west and Commando Bowl. Many
mitigation measures speak to lynx. The Forest Service did conclude that it is not likely to result in the direct
mortality to individual lynx, Impacts to big game, there is no calving habitat in CAT III. The elk migration routes
will remain. Elk use is back up to what it was before development. Staffs concerns with riparian and water issues
were addressed, Through the ROD has been reduced by 92%, wetlands reduced to 1/10 of an acre, they've
discussed old growth and the master development plan, Concerns on air quality they had Merco Inc model the area
and estimated the emissions associated would account for 4/1 00%- of 1 % of the total emissions, That is based on
the master development plan,
Commissioner Gates asked about Commando Bowl and Super Bowl being pulled out,
Mr. Olden responded they are not part ofthe developed ski area,

Chairman Johnson asked what percentage of visitors were introduced because of skiing, He stated there will
be a seven minute break with Ted from the Land and Water,
Ted Zukoski, an attorney with the Land and Water Fund, stated he is representing more than a dozen Eagle
County residents and many wildlife interests, He promised not to sue, He stated he will speak and then Jeff
Berman will speak, He stated as he sees the Board has four questions to answer. What power to the Commissioners
have? What do they know and not now? What should they do about the project and the damage it will cause?
How much is enough for Vail Associates?
He suggested the Commission needs to look at the compliance with resolution 86-32 and has VA complied.
He suggested they need to take a hard look at whether or not the transportation and parking plan meets the
requirements of the resolution. Secondly there is no doubt that the Commission can limit the environmental impact
this will cause. They have explained their version and directed them to look at FS regulations, the permit and FS
law that gives the County broad powers to enact mitigation measures, He suggested they should feel secure they
will get sued and win, The Supreme Court has looked at development law and the provisions that are
environmental in nature, All are at issue today and he urged them to take a look at implementing further controls,
Commissioner Johnson asked for the site,
Mr. Fritze responded it is in the 480US 572,
Mr. Zukoski suggested there is a big pile of stuff. He suggested bulk should not be mistaken for quality. He
stated it is their job as commissioners to look at this and that Vail has complied with the regulations, He spoke to
2.10,05 (4)(8f), He stated one of the areas that is most important is the social economic impacts and the growth
effects,
Mr. Frick stated there will be a fairly modest economic impact.
Mr. Zukoski stated that contradicts what the FS says as they say there will be no impacts resulting from the
economic growth impacts, He stated this is a predicted 6 -12 % increase over what the skier numbers would be
otherwise, He spoke to the County's analysis and the impacts, The EP A agrees and comments on another VA
expansion in Breckemidge and Keystone. They are measurable, He read part of the EIS and the key assumptions
made that skier capacity will remain in place and the development to handle high impact.
Mr. Frick stated 200,000 plus more skier days at Vail is going to have an impact on the economy, the retail
sector, and housing, These are impacts that will occur and they may be modest but they will occur, The money
will increase spending and that means more of an economic impact fueling growth in numerous sectors, How they
can assume it will be zero with 218,000 more skier days makes that impossible, He spoke to Mr. Mandel's letter of
March 4 with only an increase of 1,5000 skiers per day, The forest service conclusion that off site impacts will be
minimal is based on the 71 new employees, He suggested that is false and they have assumed away the key impact
this commission needs to address. He urged this commission address an analysis, They can say that the EIR does
not account for social economic impacts and urged them to do that. He spoke to the Canada lynx being a critter that
has important habitat in the CAT III area, This is an animal that was listed as endangered in the state. This is an
animal that is decreasing to very low levels in Colorado and CAT III is critical habitat. Two biologists with the
DOW have stated this is a critical area, He spoke to a 1978 DOW map and CAT III being in it. This will destroy
lynx habitat. From what they know it appears to be the last known occupied habitat in the state. When you put an
industrial facility in the habitat there will be grave consequences, This project may further jeopardize the lynx
existence, They also heard the DOW has signed off on this project. They think it is interesting. Attorneys for VA
and the FS stated they didn't want anything more in writing from the DOW, He stated the Fish and Wildlife service
has not signed off on this project and they will be looking at this through the conferencing process, They suggested
it may jeopardize the existence of the lynx, The 350,000 acres on the map shown did not address the useable
habitat. To rely on habitat you haven't looked at doesn't make sense, He spoke to the draft conservation plan and
how that may ensure that all will be well. It is a conservation plan and they don't know whether it will work.
When you take what may be the last habitat and destroy it you may be endangering the results, He spoke to the
concerns with Elk and referred to the EIS and the elk caving and rearing habitat.
Mr. Frick went on to discuss mitigation, He stated many of the measures and their effectiveness is
unproven, One is to log timber on adjacent land to provide future habitat for the lynx, Young lodge poll pine is
good for snowshoe hair, The problem is by the time the lodge pool pine are the proper height, they are talking 10-
20 years after the timber sale, Providing future habitat and destroying current habitat is not an effective mitigation
measure, Another measure discussed is closing or discouraging skiing in the Mushroom Bowl, placing sings in

Chairman Johnson spoke to the moratorium,
Joe Stauffer spoke to a reprint of the Valley Times business section before V A went public, He suggested it
would be interesting for them to review it. In the meantime he put up the picture of Peter Seibert because he was
here in 1962 and worked for Pete, This dream that Pete had was before Keystone, before Copper Mountain, before
Beaver Creek and Arrowhead, Those had not been dreamt of in 1962, The reason he is showing this is because
after the public offering the major stockholder is still Appol Ski Realty and that is a significant difference, The
stated purpose that he heard for this expansion is to have off season skiing, more terrain for the off season, He
suggested they can't sell what they have in the off season so why make it bigger. He is not a skier the way some
do. He stated he has yet to go up this winter and stand in a lift line. There is no growth in the day skier. Why build
more terrain if there is no growth, One doesn't build lifts and impact big areas for being Mr, Nice Guy. Since Vail
Associates built and improved the mountains the lift tickets have gone up, He hasn't seen any raises on the
mountain, So who is being served by all this and why do we have to be here saying if we don't get this
development, V A claims the Board has no right. He suggests the Board has every right to make a decision, The
paperwork doesn't' mean anything unless they see the impact on the private land, It's 6000 acres which is 3 times
Vail Valley Center and 4 times the land they owned in 1962, Adam's Rib wouldn't be allowed to build the lifts and
then show what they plan to do below, He suggested they need an overall impact statement to find out what this
development does to this County, Think of the people, not the investors, That is who they are responsible to,
Chairman Johnson suggested this has been a wonderful exercise in democracy. He stated he would like to
ask people to keep their comments short but asked they come back March 19.
Kevin Foley, a town council member of Vail, stated he is here as a private citizen tonight after two years of
closed door meetings. He stated when the County recommendations say they should try to implement #2 there are
three issues that effect the TOV, housing, parking, and employees,
Chairman Johnson asked if Kevin was familiar with the agreement the TOV signed, He questioned the
19,900 skiers at one time, He suggested it is a soft 19,900,
Mr. Foley suggested they could not control that number.
Merrill Hastings, a McCoy resident, brought a friend of his along, a lynx that was taken legally in Eagle
County a number of years ago and retained by a friend of his. He stated he isn't a hunter, it was taken in the Frying
Pan area and it is the last legally taken lynx in Eagle County, He stated he is a 35 year resident of Eagle County 10
years in Vail and 25 in McCoy as a rancher. He spoke to the articles in the Denver Post and the editorial opinion,
He read it into the record and the indication of restrictions the County may have, It is a nasty catch 22, The FS
says it can't consider off site impacts, At the same time, the Forest Service has given no direction, Mr, Hastings
stated the is 5000 to 6000 acres private land whereby V A could create a major development in the future, with CAT
III, the camel will have its nose inside the tent. He read again from the editorial stating local officials would be
negligent if they don't consider all the impacts inside and out. He asked ifthe Board will approve as is or with the
conditions as put forward by staff or will they withdraw earlier tentative approval twelve years ago,
Steve Jones, an outfitter and a primary permittee with the Forest Service in the Vail/Beaver Creek area,
stated he is not an expert but tells the Board he is in the woods, on the ski area, day after day with his horses. He
said you can not imagine a better habitat for an elk than a ski area, The other comment is that VA have done a
sensational job. He stated it seems appropriate for them to build it out as they proposed. He suggested they do a

Ray Sforzo, a concerned citizen of Eagle County and an avid snowboarder, stated he has watched
snowboarding out grow the current configuration of Vail Mountain, He spoke of the dangerous areas, He heard of
the expansion of the terrain and the outgrowth. The steeps are behind the front side of the mountain, He stated they
have heard about the environmental impacts and what are they doing for the skier. This new configuration will help
eliminate the congestion and shows vision and good planning,
Mary Jo Allen, a resident ofthe Eagle Valley for 29 years, stated her main concern is the Forest Service not
representing the public. She stated she shares the concern of Staff and has concern with Vail Associates and the
development of the land. She hopes if the project is going to go that it be smaller, reduced in size and no restaurant.
Celena Olden stated she feels the Board has the right to express concern and to take into account the Gilman
track. There are a tremendous number of citizens opposed to this in the letters written to them and the Forest
Service, It will have cumulative effects on this County and these impacts will occur with fire, police, social and

Lauren Donnelly, a graduate student at CSU, thanked the Board for being able to speak. She spoke to the
FS and the fact they are under the division of agriculture, They have the need to meet their budget, Just because it
has a stamp of approval from the FS does not mean it is good for the forest. Most of species that are going to be
protected are doomed anyway, There is not official protection for the lynx and ifthey do approve it, they don't
have resources to defend the area, Scientists can approve an area for other reasons than science. She spoke to the
expansion of the restaurant. There are ongoing to be more people attracted which means more traffic and pollution,
Pollution causes impacts on citizens health and once you've crossed that point its too late, The reality is if you get
to that point the taxpayers loose, She hopes no one has to go through what she's gone though and its not much fun,
She hopes they will stand up for the citizens while they can,
Jeff Widen, thanked those who live here for letting them speak saying he represents two organizations in
opposition to this proposal. He asks they take into consideration the staffs recommendations, He spoke to the need
to protect national forest areas and the need to protect them, He spoke of the roadless areas and the destruction in
those areas, He stated it is important to look at this in two different contexts, For all the mitigation and
transportation, etc, the reality is that this expansion will lead to more growth, more transportation, etc. VA is
interested in maximizing its profits and its interests. He read from a letter from the DOW to the FS about the ability
to increase peak days, Off site impacts are of great concern, In all the mitigation measures put forward the off site
impacts are still not being considered, For all the talk, they are not being addressed, The larger context and what is
happening to the FS roadless areas, this is not just the Vail Ski expansion. This is one of many. Slowly and
steadily they're chipping away at our national forest. We have only 2 - 4% of the original old growth forest. Its the
type of activity that the residents say needs to be slowed down, This isn't about being anti Vail but about
disapproving or reducing the scope ofthe project. Real tangible boundaries must be set. He stated CAT III is in the
roadless area and subject to the moratorium, He recommended the Board communicate with the FS and take a
closer look at all the impacts and deny the project or reduce to the minimum suggested by staff.
Ginny Culp, an eighteen year resident of Vail, would like to comment saying it is ludicrous talking about a
project that was originally approved in 1962 and then again in 1986, The County has changed not only the
residents but it was a whole, She is disappointed in the Forest Service approval because it seems as the County and
the residents, they have no power, The off site impacts will be taken care of by other agencies yet they don't have
the authority to do so, VA said they had agreed to limit the number of skiers to 19,900 but that number has been hit
no more than 10 times. When you look at the cars on the roads and all the congestion, you don't know what 19,900
looks like, We are being told the infrastructure is for peak times, In the TOV they are hearing there isn't enough
bed base, V A is saying we have plenty of infrastructure, She overheard a Town Council person of Vail saying if
this came before the Council today it would not pass. Does it follow that lodging and amusement amenities are
appropriate, Her only thought about the approval or what they consider, is that business ethics today have declined
and the honesty and integrity has not been appropriate, Them saying they should not consider Gilman and what
really matters is not being honest with the public, Piece mealing the approach doesn't allow them to look at the
long range impacts,
Carolyn Greene, manager of community projects for the Colorado Wildlife Federation, stated she is here to
represent the members in this valley, They are not categorically opposed to ski area developments but they are
opposed to this because of the loss of habitat. There are 46 members in Eagle County, Elk need hiding for caving
and cover for water. 60% of elk had not returned to China Bowl after five years, She further read statistics to
support their point that it will degrade the habitat.
Rob Levine, GM of the Antlers, stated the best thing about the hospitality business is welcoming people into
their home, He appreciates the FS charge of answering to the concept of multi use, He stated there are millions of
people that come to our valley each year to enjoy our home, It may bring more people because skiing is fun,
Tourism is a pretty clean industry, There is a hugh up side, He suggested measuring the skier days in smile
minutes, He spoke to how wonderful skiing in Beaver Creek was and the connection with Bachelor Gulch and
Arrowhead, He spoke to the concerns in Gilman and when that happens it comes before the Board. They will have
to come forward. Another 800 acres of skiing in the grand scheme of things, is not like we are ruining it. And it is
providing so much pleasure for so many people.
Annie Egan, a skier at Vail since 1966, has watched and seen the ski area go through a lot of changes and
good changes, It is the best area in the country, but enough is enough. Bachelor Gulch used to be prime calving
habitat for the elk, now it is prime habitat for the rich, We're doing the same for elk that we did to the Indians,
This is about money and not a need for more intermediate skiable terrain, She stated there are three bowls of
