Resolution 98-34, ZS-00002. Blue Lake Community Center Special Use Permit, He stated this
was a resolution to approve a Special Use Permit for Lot 4 of Blue Lake Subdivision, Filing No, 3, for the Blue
Lake Community Center Office Building for Professional offices, including government offices such as for the
County court and clerks. The Board considered this file on December 17, 1996,

Paul Clarkson, Senior Planner, presented file number PDS-00009, Adams Rib Residential Golf Community,
He stated this was a request for approval of a residential golf community, 1,569 acres, 1,320 dwelling units, 125
square feet of commercial.
Chairman Johnson asked some procedural questions. He suggested if it is going to take more than one
meeting that they set another date for the second half of this application, He suggested if it is going to take longer
that they set a finish time for tonight of 10:00 p,m..
Terrill Knight, Knight Planning, suggested their presentation will take approximately one and one half
hours,
Chairman Johnson stated they will take a break at 7:30 p,m, and then see how public comment is
proceeding.
Mr. Clarkson stated his portion will take approximately twenty minutes.
Chairman Johnson asked those who wish to speak to sign up,
Fred Kummer, President ofHBE and Adam's Rib Development stated there has been much confusion with
the size ofthis development. He stated it covers a large piece of property of 1,569 acres with 1,360 units, 1,270
single family housing units, 50 caretaker homes and a 120 room hotel for a density of ,87, He stated putting this in
perspective, he showed a map of Arrowhead and Singletree, comparing the density and size, He also showed a map
of Eagle-Vail comparing the acreage and density, He stated the project they are proposing is a simple one,
Encompassed in the project is 80 acres that will go to the school, the recreation district, fire and ambulance, He
stated they have met with the school district who would like about 25 acres, They are proposing a par three golf
course to be managed by the Recreation District. The Eagle County Land Use Regulations would require 19 acres
to be contributed in this development so they are above that by 61 acres, The Eagle area plan puts something
between 1,700 and 2,000 units, They are roughly 2/3 ofthe total number of housing units, 2/3 consumes only 2/3
of the water, creates only 2/3 of the traffic and air pollution, Stream flow is impacted less as is open space, This is
a project that was made for PUD but does require an expansive opportunity, It will not be developed
instantaneously, He explained they have developed this project differently than Singletree, They are developing
this with residential pods, one at a time. He stated they believe this is a well thought out plan with less density. He
thinks this will be a positive project with low impact, He stated they will have two eighteen hole golf courses, two

to add employee type units as caretaker being 50 units, One of the considerations was the concentric circle
approach, He explained. He stated they looked at the sub-area plan in total. Other issues is respecting the land
form. The plan does not propose to put development uniformly across the property, The reason for the PUD is to
respect the land use numbers and the wildlife, As directed by the area plan, a balance was proposed to integrate
recreational activities, including parks and golf courses so as not to negatively impact wildlife,
Mr. Knight stated they have addressed the density issue and they encouraged the Board to read the master
plan to validate their numbers, They were not the maximums but what fits on the land. They have taken into
account the myriad of issues to create areas that are no build lines were building won't occur, They wanted to make
sure the proper amount of amenities are in place. He spoke to the issue of wildlife and introduced Dr, Allen
Crockett with Schafer & Associates,
Mr. Crockett stated he feels very good about the wildlife aspects of the plan, He introduced exhibit J, the
vegetation map showing the pasture and the native habitats, He explained the winter range. Exhibit K is the
wildlife map showing the areas of sage brush and the winter range area, He stated it shows 215 acres of deer and
elk winter range. He explained the other habitats. He stated the corner stone of the plan is avoidance, He stated he
looks at the overall picture and sometimes it is necessary to put development in areas with natural species, About
35 acres overlap with development areas, That includes golf course, portions oflots that won't be developed, He
stated they have dropped the sporting clays part of the proposal. He stated this project won't fragment the habitat
that is there, He spoke of his meetings with Bill Heicher. He believes what they have is a plan that is very good
with the golf course being pasture and the native land being used. The lots that are outside the building envelopes
will be enhanced through mitigation money,
Mr. Knight pointed out the issue about the fringe area rather than it being the center of habitat. He stated
almost all the property to the north and south is BLM land and does blend into the surrounding properties, He
stated additionally the area has been grazed and used for years, He stated the riparian habitat will be enhanced,
Mr, Knight stated Mr. Ferguson from Holland & Hart was unable to be here, He stated they have presented
information in that regard. He spoke to the charts included in the blue book dated January 14, there is a section on
water called Water Consumption. He stated it shows the depletions after development are less than prior to
development using less diversion than agriculture. He stated the property has historically be irrigated and used as
hay land, He spoke to the memorandum that is labeled Adam's Rib Water Rights issues in the same book following
the chart, He explained the memo and what it addresses, He read the memo into the record.
He stated there will be a dual system, domestic being one system and irrigation being a second system using
raw water. That is a goal of many communities to reduce costs. Mr. Knight showed exhibit L, which showed the
road system, He explained the road and where the road will be abandoned and the new road put in, He showed
where it crosses the Jones property into West Eagle, They have proposed roadways through the project and to the
intersection with the existing road, They have completed an agreement with exchange of properties. He showed
that on the larger map, They feel that was a significant improvement and they are working cooperatively with their
neighbors, They feel comfortable with the road and the limited number of access points, He spoke to the interior
circulation pattern and the improvements to the intersections, They are concerned and want to avoid problems such
as in Eagle Vail. They believe they are planning for good circulation,
Mr. Knight spoke of the density charts and the comparisons, He spoke to exhibit M and the affordable
housing, He compared it to Eagle Vail and though not affordable the density is to be considered,
Exhibit N shows the affordable area of Adman's Rib ranch and a portion of Berry Creek. Exhibit 0
compared the Terrace and the comparisons which are close in lot size. Exhibit P shows Eagle Vail and compares it
to their General Areas.
Chairman Johnson asked about an Eagle Vail resident selling their home and buying at Adam's Rib,
Mr. Knight compared their general area to Singletree in exhibit Q. He showed exhibit R and the comparison
of Arrowhead and the general golf community, He showed the Greens project at Arrowhead and the comparison
and then the Aspen Glen, exhibit T, and one ofthe areas they have used as a model.
Mr. Knight spoke to employment and employee housing stating they will generate about 382 employees
with 122 being year round, He spoke to the affordable owner occupied housing and the 170 residential units stating
it will exceed the need for employee housing. He spoke to the par three golf course being no cost to the public. He
explained the Planning Commissions concerns with slow plays and who uses the course. Mr. Knight explained a
great deal of play is by juniors and seniors. This is a true par three golf course being a fully designed course and

the north, Also the master plan suggests somewhere between 700- 800 dwelling units and that a degree of
clustering should take place reducing the density to about 1,000. The intent is to recognize the clustering, The
Engineering Department has identified areas on the north side of the property as fire and habitat concerns, The
affordable housing component is questionable and has been better explained by David Carter. He is suggesting
there isn't enough affordable housing being proposed and it should not be as segregated from the rest ofthe project.
The applicant has shown a nice project that is self contained, The idea is to fit a development within an existing
community, The way they are proposing it is not addressing the greater community as a whole, Staffhas suggested
eliminating the public nine hole golf course as the lot sizes would be about 6,000 square feet. They will be 8,500
square feet on average which will work. When all is said and done, the Eagle area will be looking at five golf
courses and the Eagle area has suggested they don't want this to become a second home resort, It is hard to dismiss
this as not being a resort as it has a hotel, though it may not be large, it is a hotel. It is expected that 60% will be
local homeowners though the application stated 60 - 70% second home owners. Can they restrict who they sell to,
He stated he thinks that the proposal is showing that it doesn't really know what the ultimate is, Aspen Glen is a
gated community and he questions the secondary home ownership, That is determined by where the tax bills are
sent. How do you know how many are second homeowners. The Eagle Area Community Plan and the Master Plan
speak strongly to resort development. The golf course parcel south of this suggests the applicant applying for
additional resort plans should be able to demonstrate they are needed, Also there are concerns with the broader
community and the ripple effects. Most of what we see in and around Eagle is not a direct result of different
development proposals but a result of the indirect impacts, The requirements for public services require people to
provide the services, house to houses those providing the services, people to build the development and services to
be provided to them, It can go on infinitum. They get responses from referral agencies, school land dedications,
minimum requirements, They are proposing to give 25 acres to the school district but its time to consider they may
not be getting enough as a result of the ripple effects, Perhaps independent analysis of the school requirements,
public service and safety requirements is needed, They haven't really heard from the Recreation District but
initially the application proposes to give it to some pubic entity. There will be services the County provides, day
care, library services, public health, etc that should be better spoken to. These are the main issues staffhas
identified and they all point back to concerns raised by the master plans, Staff has recommended approval with
some severe conditions, Condition #1 especially, As a result of the Planning Commission meeting there are some
33 conditions. The Planning Commission eliminated many of staff s conditions if not modified most of them,
Most of the construction of this development can draw from the existing construction work force, He questions that
as not being likely. Many are coming from out of state and the growth rate is not in keeping with the number of
jobs, Perhaps the applicant could consider providing for housing of the work force or a portion of it, Another item
staff sees is that the master plan addresses water and sewage. If public services are going to be provided by the
developer it is suggested that some mitigation be given to public lands.
David Carter spoke to the conditions starting with Affordable Housing, He acknowledged the work of the
County Commissioners for affordable housing and the draft housing plan, He complimented Randy Cloid and
Charlie Wick who met with him in discussing some of the important issues in this regard, He stated providing
enough housing is a hard problem to solve, He is going to suggest a solution to Adam's Rib that is a simple
solution but hard to take, He referred to an overhead and the initial concept oftheir being a giving to the project,
The specific steps proposed is 20% of units reserved for local residents. This housing needs to meet the definition
in the Housing Plan dispersed through the development, and a voluntary 2% real estate transfer fee, 72% assessment
of gross receipts, plus adequate deed restrictions. He spoke to the zoning, He stated the draft housing calls for a
percentage to be set aside for local units, He spoke to the residential aspect for this project. The twenty percent
would be one out of five units, The purpose is defining affordable housing by setting up three categories, A
problem in this County is a tough combination of low wages and high cost of housing, Eagle County is
considerably less than the states national wage being about 85%, The low wages and the jobs to be developed will
be low wage jobs. They start out with a low average wage which gets to be a challenge for affording housing, He
showed the labor force growth over the population growth. The labor force outside of Eagle County has continued
to increase, This has been an issue that the Rural Resort Region has been working on, He spoke to the draft
housing plan and the three pillars being the business community, development community and the general public,
Mr, Carter stated one of the recommendations is to disburse the housing throughout the community. The
applicant is proposing to concentrate the affordable housing in one area, The project could provide funding on an

Mr. Rulon suggested in 1995 the median income was $55,000 a year and questioned the construction being
short term. He questioned the master plan projections showing the employment needs exceed the housing,
Mr, Carter responded there will be more people working here than living here, He stated the median income
is about $68,000,
Mr. Carter stated the crucial point is that incomes are reported where people live and incomes are reported
where people work. He explained the wage gets reported here but the income is reported where they live, He stated
they have the Beverly Hills effect where people can't afford to live where they work, He explained the increased
high income which he believes is caused by them getting priced out.
Mr, Rulon suggested a factor is also with a number of women working as well.
Mr. Carter stated that was happening in 1990 with 90% ofthe adults working,
Mr, Rulon suggested the number of people working under 17 is also a consideration.
Jody O'Connel, area resident, asked if the wages were 1990 statistics.
Mr. Carter stated it is 1996 data,
Ms, O'Connel spoke to the hospitality industry and the upper management incomes,
Chairman Johnson suggested the dishwashers and maids are a much larger number,
Ms, O'Connell suggested management is substantially higher,
Mr, Carter responded the average is what is reported,
Merrill Hastings, area resident, asked if they can blend people of different incomes can they mix housing
types without the upper end depreciating, He asked if that will sustain the upper end market,
Mr. Carter stated this is a good point and that having relatively inexpensive housing next to a trophy home
will somewhat hold down the value of the upper real estate,
Larry Benway, Edwards resident, suggested they are on the verge of creating a social experiment and asked
what will happen to the local contractor who has limited himself to developing a five plex in Wildridge, He asked
if one of those units will be an affordable housing unit. He stated that will be a question for the community, He
suggested it is a policy question of the community and the elected officials, He suggested they need to proceed
quite cautiously and asked if 20% of Cordillera will be affordable housing.
Stewart Warren questioned the income listed on the graphs, He asked how many are transient workers
opposed to those who live here, He suggested many of those are transient workers who have no intention of living
here.
Mr. Carter stated they do have data on transient workers being more seasonal. He stated the wage will enter
into the data,
Mr. Warren asked what percentage ofthe workers are transient workers,
Mr. Carter questioned what is transient suggesting those are seasonal. He stated a number of the people that
fill those categories are seasonal but he suggested the data does not dip during the winter, The average wage tends
to be steady throughout the year,
Chairman Johnson suggested Mr. Carter bring that data forward in the next session as well,
Dwight Martins, area resident, stated he is in favor of this project but stated his next door neighbor last year
threatened to sue him as his house is substandard to his,
Bruce Carry asked ifhe is to buy a home in the neighborhood of $500,000 to $600,00 would that be
considered a local home.
Mr. Carter suggested a local would be defined by a home in the range of $250,000,
Mr. Carry asked about absentee ownership and the ripple effect. He questioned an empty house placing an
impact on schools when there would be no impact on water, schools, highways, etc,
Mr. Carter stated if there was a whole County of second homes and people living elsewhere, it could be a
good thing, It is a policy decision for the community and the Board of County Commissioners,
Chairman Johnson asked if there is another date this can be moved to,
Pete Feistman stated what is being proposed is a 1100% upzoning,
Chairman Johnson asked Mr. Kummer is the 30th is possible,
Mr. Kummer stated they would like it sooner than that. The next meeting is scheduled for 6:00 on March
17th.
Suzie Kincade, Eagle resident, stated she was hoping to stand up and offer her full support of the project and
believes that one day she can, She spoke to discussion of the bar being lowered on this development and she feels it
should be lowered on all new projects. She suggested we need to take care of the infrastructure first. She spoke to

questioned the 2% on retail sales. He thinks the County is sticking its nose outside of the regulations and the
regulations should be in line first. The Army Corp of Engineers has ajob to do and not the Staff. Mr, Turgeon
went on to say this is a development and it is a PUD which should regulate any development that could possibly
happen, Free market runs this Country and if a developer thinks a project should work, it will work. He spoke to
the project in Dotsero and the regulations and stipulations, He stated he wished he could be here at the next
meeting to point some more fingers, He suggested the Chairman was pointing out people who would speak in
opposition to this,
Chairman Johnson suggested he was not pointing at people specifically. He agreed with the need for
regulations,
Mr. Turgeon stated this is not the time to do it and that a moratorium is out ofthe regulations.
John Swanson, a limited partner ofEby Creek and a resident for 15 years, said he learned a lot about local
housing. Mr. Swanson spoke to the changing lines and the different plans and the non-compliance of the master
plans, He stated as far as this County not wanting to be a destination resort, we should not have built the airport,
He would like to see the project move forward and the density restored. He spoke to the water rights, the property,
and the excellent planners, He spoke to the positive aspects of Adam's Rib and their good intentions, Iftheyare
committed to sell lots at $40,000, this will go away if reduced by 20%, A single family lot at Eby Creek is now
$85,000. He spoke to the Concerned Citizens and their desire to turn their project over to them. He said Mr,
Kummer is mitigating the concerns of wildlife,
Tom Burke, a resident for 25 years, suggested that it depends on how long you've been here determines how
you feel about growth. He spoke to Mr. Kummer's givings such as giving away the ski area, density, gated
communities. He asks what other developers have given, He votes for approval.
Bud Nichol, a golfer since 7, stated he is not new to the valley and not new to Colorado, They retired here
nine years ago and settled in Edwards, He stated he has made his contribution to Eagle County over the years, He
suggested there are so many counties in Colorado who would love to have what is being presented here, He
suggested this is well planned growth, He stated they will look back on this project in the future and say look what
they've done, He suggested the golf course will bring, other than an economic value, a clean good looking
surrounding, The plans to this project are a real plus to Eagle putting Eagle, not Eagle County on the map. He
stated he has friends who live here, There will be growth to the community such as what Edwards has experienced,
He stated this end of the ranch needs a well, good planned community. This is not a present plan, but a future plan,
He stated they were invited to play at Aspen Glen and suggested it is a gorgeous community.
Del Dyck, a Gypsum homeowner, stated he was shocked by the Chairman not paying attention during the
presentation this evening. He stated he believes this to be an asset to the community, He stated he has worked in
most of the developments in the valley. He stated he enjoys Brush Creek and he doesn't see anything in this plan
that will deter from the beauty. He appreciates the years, the time, the effort of one manys charge, He respects him
for that. He thinks he has something here that the community will enjoy and be a part of. He stated it does take a
lot of money to live here and he works three jobs,
Chairman Johnson asked Del what he does,
Mr. Dyck stated he is a custodian, a construction manager and does construction on the side,
Chairman Johnson asked who Ms. Dyck works for.
Mr. Dyck responded she works for HBE,
Glen Miller stated the Eagle Area Plan is not the consensus of the community. He feels this is a very viable
plan by a conscientious developer to get the job done, It is an opportunity for this Board to work with Adam's Rib,
He suggested it is a major item and they are talking about moving houses around on a piece of property, He
suggested it would be viable project.
Stewart Warren said he takes issue with some ofthe language with the master plan and showing the need for
a resort, He suggested that is an oxy moron and a difficult thing for anyone to prove. He stated people come to a
resort to spend disposable income, Recreation is an industry.
Chairman Johnson stated they will be closing this meeting this evening and continuing to March 17, 1998,

Chairman Johnson stated they would need to schedule this at the next meeting.
Mr. Kummer stated this has been delayed and here they are in March and they are still dealing with this. He
