This being a scheduled Public Hearing the following items were presented to the Board of County
Commissioners for their consideration:
The Board convened as the Local Liquor Licensing Authority,
Gashouse
Earlene Roach, Liquor Inspector, presented a managers registration for Brian Eldon Wallace, Gashouse,
Inc" dba/The Gashouse, She stated Mr, Wallace is reported to be of good moral character. This application is in
order and all fees have been paid, Staff recommends approval.
Chairman Johnson asked how long Mr. Wallace had been in the restaurant business, He responded since
August.
Chairman Johnson asked Mr. Wallace of his familiarity with the liquor laws,
Mr. Wallace responded he has only been in the liquor business since August.
Chairman Johnson asked about TIPS training.
Mr. Wallace responded he was talking with the Town of Vail and will be TIPS trained,
Commissioner Gates suggested he get familiar with the laws,
Commissioner Phillips moved to approve the managers registration for Brian Eldon Wallace, Gashouse,
Inc" dba/The Gashouse.
Commissioner Gates seconded the motion, The vote was declared unanimous,
Zino Ristorante
Earlene Roach presented a renewal of a hotel and restaurant license for Zino Ristorante, Inc, She stated this
application is in conformance and all fees have been paid, The Sheriff s Office reports no complaints or
disturbances during the past year. Staff recommended approval.
Kevin Clair, applicant, was present and stated that business is very good and they are happy with the first
year results,
Chairman Johnson asked what percentage of business are alcoholic beverages.
Mr. Clair responded around 40%, He stated it is significant and the bar seats around 75, They are doing
some live music now. The dining room produces about 20% of the liquor sales.
Chairman Johnson asked if all employees have been TIPS trained.
Mr, Clair responded all have been trained but a couple of new hires, They require they be TIPS trained
within ninety days,
Commissioner Gates moved to approve the renewal of a hotel and restaurant license for Zino Ristorante,
Inc.
Commissioner Phillips seconded the motion. The vote was declared unanimous.
Cordillera Golf Club
Earlene Roach presented a renewal of a hotel and restaurant license with optional premises for Gemsa
Corporation, dba/Cordillera Golf Club, She stated this application is in order and fees have been paid, The

Mr, Sands asked Ms, Yonkers how long the liquor store has been listed,
Ms, Yonkers stated about six weeks,
Mr. Ping stated he will leave the establishment as soon as possible. When asked if they have advertised he
stated no,
Commissioner Philips asked if they have someone minding the store in his absence,
Mr, Ping stated he is the staff. He explained the drop in business due to the many new stores,
Mr. Sands spoke to the state's recommendations,
Chairman Johnson asked about the three months held in abeyance and if they were to give six months it
would then be for nine months. The three months may have elapsed,
Ms, Black stated the order showed no time period restriction,
Ms, Black asked if they own the property or if they are just selling the business,
Ms, Yonkers stated they lease the space.
Clarification was made that Mr. Yonkers also had a violation,
Chairman Johnson stated it is his concern that the violations have repeated themselves and the excuses are
the same, He stated he does not see that this Board has any other option than to revoke the license, He suggested if
they really cared they'd check ID's,
Mr. Ping stated they are not looking to sell liquor to kids, He stated today can be his last day and he'll find
someone to work the store. He stated he does not actively sell to children, He has made some mistakes and he is
owning up to them, He stated if they can keep the license he will be out of there, He said he has never stated he
would get out of the business before,
Mr. Sands summarized saying it is never easy to put a family out of business, The licensee has received all
the warnings and nothing has gotten through to the licensee, Whether they are intentional or merely negligence,
you have to be concerned with the health and safety of the community. He stated even iftheir intentions are good,
they have been extremely negligent in not following policy.
Chairman Johnson asked about inventory.
Ms, Roach stated they can sell it back to the distributor or by public auction. She explained the public
auction practices.
Commissioner Phillips stated at the last hearing revocation was suggested,
Commissioner Phillips stated she would move for a suspension for three months with three months in
abeyance, Ms, Phillips stated she would like to see this license left until they can sell the business, indicating Mr,
Ping would have to be completely out of the store.
Commissioner Gates stated he has known Clairene for a long time and he feels badly this has happened and
he is in a tough situation but today he is going to have to vote to revoke the license,
Commissioner Gates moved to revoke the liquor license for Three Seventy Six Corporation, dbafWhitewater
Package Store,
Commissioner Phillips seconded the motion, Commissioners Johnson and Gates voting aye and
Commissioner Phillips voting no,
Pier 13 Liquors
Earlene Roach presented a renewal of a Retail Liquor Store License for Thomas J, Domenico, dba/Pier 13
Liquors,
Allen Christianson, Attorney, was present representing Tom Domenico owner of Pier 13 Liquors, Mr.
Christensen stated they have both the renewal and the slow cause before them today,
Kevin Lindahl, Attorney representing South Forty Liquors, stated he is here today on another matter with
South Forty, He suggested it is his understanding the Board can invoke a fine rather than suspension and asked that
the Board hold the hearings, continue them to a later date, schedule a work session to review the option of passing a
Resolution for imposing fines in leu of suspension, then bring all applicants back to consider a fine in lieu of
suspenSIOn,
Chairman Johnson stated the Board actively agreed not to adopt such a resolution in the past,
Mr. Sands explained ifthe license is not revoked they can proceed with the renewal.

Chairman Johnson stated he is of the position that he doesn't want to consider fines, He wonders if a fine is
more penalizing than four days of none sale,
Mr. Christensen stated they are acknowledging their guilt and now ask that they look at all the
circumstances,
Ms. Roach stated the suspension would be harder than the fine. She stated she prefers the suspensions
because she feels they are a better deterrent than the fine. Should there be repeat offenses they could deal with that
then,
Chairman Johnson asked Mr. Christensen about the options and the opportunity for the Board to consider
extenuating circumstances. They have flexibility in the sentencing, Mr. Christensen stated they have a bigger gap
between their violations,
Renee Black recommended to the Board that if they are going to consider a resolution they determine
whether there has been a violation and continue the hearing to a date certain,
Mr, Lindahl stated his client will agree with Bud for the owners sake. The penalty is placed on the owner
rather than the employees who will be out of work.
Mr. Sands asked what the average profit margin is,
Mr. Domenico stated it is 18% to 27%,
Cindy Esqwith, owner, of South Forty stated net profit is about 10% after paying for goods and employees.
She stated if they are left with 10% they are doing well.
Commissioner Gates stated he is willing to look at the possibility of fines but not for those files being heard
today,
Commissioner Gates moved to suspend the licence for four days, two active and two held in abeyance,
Commissioner Phillips seconded.
Mr, Sands asked for an amendment to the motion ifthey want a sign to be located in the establishment.
Chairman Johnson asked them to be date specific,
Mr, Christensen stated seven of the licenses are violated by this code five in Eagle county and two in
Gypsum. The town of Gypsum is doing nothing,
Chairman Johnson stated he finds it difficult to believe the Town is not taking any action with their stand on
teen smoking. He feels they are shirking their responsibility as a licensing authority, This Board has tried for
consistency whether a small organization or a large one like V,A.
Mr. Christensen stated they appreciate that.
Ms. Black stated equal protection is being shown in this case because the County is treating all their clients
equally,
Commissioner Gates included in the motion the dates of Wednesday, February 25 and Thursday, February
25, 1998 as the dates of active suspension, The two days held in abeyance will be for a period of one year,
Commissioner Phillips stated the second concurred.

The next item was the renewal of a retail liquor store license for Thomas 1. Domenico, dba/Pier 13 Liquors,
Ms. Roach stated there has been one complaint which is the violation discussed above, The application is in
order and all fees have been paid,
Commissioner Phillips moved to approve the liquor license for Thomas 1. Domenico, dba/Pier 13 Liquors,

Mr. Sands explained the next hearing and allegation of the licensee selling liquor to an underage person.
Terry Marcum, owner of Stop and Hop, stated he is indeed guilty,
Ms, Roach was called as a witness to give her recommendation, She stated Mr. Marcum did not attend the
training but his manager and server did.

Mr. Sands stated the next show cause is for Buxman Enterprises, Inc" dba/Village Market, He read the
findings into the record.
Rob Mount, store manager, stated they admit to the allegations,
Ms, Black asked if he has the authority to speak for the owner.
Mr, Mount stated he has,
Mr. Sands called Ms, Roach as a witness who reviewed the history ofthe establishment stating there has
been one previous violation on July 3, 1996 as a result of a sting operation. They received a four day suspension,
two active and two held in abeyance.
Mr. Sands introduced the Commissioner minutes for the record,

Mr. Sands asked for the proposed sanctions,
Ms, Roach stated the server is no longer employed at Village market and she was not the same server as in
the previous violations, Ms. Roach recommended eight days of suspension, four active, four in abeyance.
Mr. Mount stated the employee resigned as a result of this, He spoke to their employee manual.
Chairman Johnson asked about TIPS training,
Mr. Mount stated they do bring it up in staff meetings and they are now implementing more strict training
for employees,
Mr, Mount apologized for this happening, He showed the Board the sheets they are now giving to new
checkers and the concerns for violations, He showed the information from the Sheriff s office and stated every
checker has a copy of the law as well as the signs they have posted on the check stands,
Mr. Sands spoke to the server at the time and if she gave any explanation,
Mr. Mount stated the server related she was the only checker at the front and had juveniles by the cigarettes
who she was concerned with, There were others in line and she did not have cause to see a red flag,
Greg Beaumont, investigator for the Sheriffs office, stated he has worked with Rob on shop lifting and
other matters, He stated out of all the people he spoke with about these matters he seemed the most concerned. He
believes he will take this seriously,
Chairman Johnson spoke to the value of the sting operations even they don't look good or feel good to those
involved but it is a necessary evil to keep the youth of the County safe.
Mr. Mount thanked Greg for his testimony, He stated there have been 103 checkers since the last incident.
He asked the Board to know they do take it seriously and asked them to take that into consideration,
Commissioner Gates moved to suspend the liquor license for eight days, four active and four days held in
abeyance for one year, The establishment shall be posted with suspension signs. The active four days shall be
February 25, 26, 27 & 28, 1998,
