Fisher Chairman Commissioner County Administrator Clerk to the Board Absent: George "Bud" Gates Commissioner This being a scheduled Public Hearing the following items were presented to the Board of County Commissioners for their consideration: Consent Calendar Chairman Johnson stated the first item on the agenda was the consent calendar as follows: A) Approval of bill paying for week of January 20, 1998, subject to review by County Administrator B) Approval of the minutes of Board of County Commissioners meetings for January 12, 1998 C) Resolution 97-03, regarding the development of an access plan and 1-70 Interchange Feasibility Study, Gypsum to Eagle, D) Agreement between Eagle County and U.S, West Communications, Inc. To provide pay phone service to the Mt. Sopris Tree Farm, 0488 Valley Road, Carbondale E) Memorandum of Understanding between Eagle County and Mt. Sopris Skateboarding Organization for ground rules to permit the organization to use the Tree Farm property for skateboarding and in-line skating F) Resolution 98-06, proclaiming January 20, 1998 through January 25, 1998 Denver Broncos Week in Eagle County, Scot Hunn, Planner, spoke to item F and asked that it be changed to Super Bowl Week so that all members of the County might be represented. Chairman Johnson suggested they can not satisfY everyone, Commissioner Phillips advised Mr. Hunn this is Colorado and in Colorado we support the Colorado teams, Chairman Johnson suggested they not order cheese burgers, Bob Loeffler, Deputy County Attorney, spoke to item E and stated if a signed contract has been returned from the Mt. Sopris Skate Boarding organization he doesn't have it. He suggested it be authorized for the Chairman's signature, Chairman Johnson stated there is a signature line for Jaime Goldner. Jack Ingstad, Asst, County Administrator, stated they were in a hurry to get back a signed agreement. Jaime Goldner was out of town, The original is probably in themail.Mr. Ingstad stated the ones he received back had Mike Bradley's signature, Mr. Loeffler stated that was added after the original contract was mailed, Commissioner Phillips asked about payment of the pay phone, Mr. Ingstad stated they have paid for the installation but will receive the revenue, Kelly Jo Wallace, Buildings & Grounds, stated with the usage out there it will still cost the County about $200 per month. Chairman Johnson stated the reason for the phone is for emergencies and they had not anticipated it would pay for itself. Of the two voting Commissioners the vote was declared unanImous, Mark Esteppe, applicant, testified as to the needs of the neighborhood, Commissioner Phillips moved to establish the needs of the neighborhood as evidenced by testimony and the submitted petitions, Chairman Johnson seconded the motion, Of the two voting Commissioners the vote was declared unanImous, Commissioner Phillips moved to approve a new hotel and restaurant license for Marko's Pizzeria of Edwards, Inc" dba/Marko's Pizzeria, Chairman Johnson seconded the motion. Of the two voting Commissioners the vote was declared unanImous, Blue Creek Grill Sara Fisher presented a renewal of a hotel and restaurant license for Fabulous Foods, Inc" dba/Blue Creek Grill, She stated this application is in order and all fees have been paid. The Sheriff s Office reports no complaints or disturbances during the past year. Staff recommended approval. Commissioner Phillips moved to approve the renewal of a hotel and restaurant license for Fabulous Foods, Inc" dba/Blue Creek Grill. Chairman Johnson seconded the motion, Of the two voting Commissioners the vote was declared unammous. Commissioner Phillips moved to adjourn as the Local Liquor Licensing Authority and reconvene as the Board of County Commissioners, Chairman Johnson seconded the motion, Of the two voting Commissioners the vote was declared unanImous, SD-0014, Eagle River Fire Protection District Keith Montag, Director of Community Development, presented file number SD-00014, Eagle River Fire Protection District, consideration of their service plan, He stated the applicant is proposing to provide consolidated fire protection services through the adoption of a service plan for the Eagle Fire Protection District. Staff recommended approval. Mr. Montag stated the service plan is relatively self-explanatory as are the staff comments. He stated they heard from the Town of Avon by letter who have stated they do not wish to be part ofthis district. In addition there is a letter in the packet from the Lebo's who are requesting to be excluded from the boundaries of the fire district. Chairman Johnson asked Bob Loeffler for direction about the exclusions, Mr, Loeffler stated they know what they must address first is the exclusions, Those findings are in staffs report and those issues should be addressed, There is a second petition for exclusion from Alikar Gardens Resort which is addressed to both special districts on for today. Chairman Johnson asked for statute about the exclusions. Mr, Loeffler stated the items in staffs report are taken from statute in 35-103 (2) and 35-103(5), Mr. Loeffler read those sites and the requirements, He stated those are on page two of staffs report, Chairman Johnson again asked about the exclusion, Mr. Loeffler stated the burden is on the applicant to show that the application is not in the best interest of the district. The person seeking exclusion may want to address their petition, The proponent must then address that. Jim Collins, Collins & Cockrel, stated he represents the petitioners for the Service Plan, He stated they are ready to commit not to move immediately. They are requesting the Board approve the service plan and find it in conformance with the standards and requirements. Then they plan to wait until they have more of a consensus with the eleven entities to make sure they can meet their needs. Other areas benefit from the rolling stock without paying, None ofthe districts to the west have paid but stand to benefit. He stated it should be simple to finance and it is now more difficult than it should be, Mr. Collins stated he has reviewed the statutory requirements for approval. He asked Mr. Moore if this plan meets the requirements and the needs. Mr, Moore responded yes. Mr. Collins asked if the plans as they exist are inadequate. Mr. Moore responded yes. Mr. Collins asked ifthis service plan would meet the needs. Mr. Moore responded yes, Mr. Collins spoke of the costs to the property owners and suggested the costs would be less than they are now as properties are now excluded, Mr. Collins suggested the mil levy now is 2,8 mills and in the proposed plan it would be 3,5, That would include additional attributes and those would be the reason for an increase, The reason for asking for the 3,5 mill levy is to ask for room to accommodate the proposed services, Mr. Moore stated the service plan looks at the next ten years, Mr. Collins stated at the Planning Commission it was requested to remove the Almont Report, They do not object to the removal as it is superfluous, They are looking at continued service and not greatly increased, Mr. Collins asked if service could be provided by any other entity if this is not approved, Mr, Collins continued his questioning regarding compliance to the master plan, Mr, Moore responded affirmatively, Mr. Collins spoke to the long range water quality in the area, Mr. Moore stated he believes it is in compliance and is in the best interest ofthe area proposed to be served, Chairman Johnson asked Chief Moore ifhe was aware of their discussions with the Town of Avon and their request was not timely received either. Mr. Collins stated they do not believe the Town of Avon falls under the same requirements as property owners, Mr. Collins stated they need to have the Town's consent for them to be part ofthe district. They could however, just contract with The Town. Mr. Collins stated they have the 150 service contracts with individual property owners, They need to have Avon fully cooperating and fully convinced that what they are doing is proper, Mr. Collins stated that petition is a different type and is a lack of consent. Commissioner Phillips asked how that would work with the Town of Avon, Mr. Collins stated they would have the same contract with the Town of Avon replacing sixteen contracts with one. It would still result in a substantial reduction in complication, They would like to not proceed with an election until they have the Town of Avon's full support. Even if they chose not to be in, they want their support of the bond issue, Mr. Collins turned to the issue of capital. They have developed a capital plan and the replacement of fire stations with a "super station". Whether the super station is located to the west or not they have developed a budget of the capital needs for the next few years is $7,000,000, He asked Mr. Moore if that is reasonable, Mr, Moore spoke to the position of the fire stations as they are now with Eagle Vail, Avon, Beaver Creek. In the long term to find staffing and rolling stock will be must more cost effective. Mr. Collins asked the Chief how long he has been with the department. Mr. Moore stated he has been Chief since 1989 and in the fire district since 1979. Chairman Johnson asked about response time and the effect on places like Red Canyon, Mr, Moore stated response time is not as important as how many people are on the truck. Mr. Moore stated they are responding with two people and that is still not enough, He stated ideally there would be a minimum of four people on a truck. He stated service will be improved by developing a larger station and adding to the student population, doubling the crew size there and in Edwards to four people. In discussion Chairman Johnson spoke to the positiveness of the consolidation, Mr. Collins spoke to condition # 1 and that it is possible that a entity may not chose to be in initially, Chairman Johnson suggested that no district would be included unless they want to be included, They would have to agree to dissolve in order to be included. Colorado Open Lands and the Diamond S Ranch are the other two adjacent property owners and have historical access in different areas, Lance Badger, Cordillera, stated they opened dialog with the those who might have concerns or ideas, Staff has been extremely helpful. They and staff have resolved the planning issues and are in agreement. He asked to walk them through the plan reminding the Board it is in Sketch Plan, Mr. Badger pointed out the piece of property on a map, He stated they originally looked at the property as stand alone but decided it would be better as part of Cordillera, By down zoning the property it will reduce the impacts to the area, There will be no additional demands for water as 30 to 40 of the homes will be on wells. There will be no additional traffic on Squaw Creek Road, By down zoning they have created a transition area from the ranch outward, The most dense area is 12 two acre parcels. It does create a transition with the 35 acre lots on the west end of the property. Mr. Badger stated they did some creative things with the 35 acre lots. He showed one to the Board on a map, Within the 35 acre lot they created a four acre building envelope, They also placed a conservation easement over the 31 acres, The distance between the envelopes will be significant creating area for habitat. Mr, Badger spoke to the architectural guidelines. There will be a second story of only five feet. They have limited the height to 32 feet in the guidelines with a maximum of 35 feet. Mr. Badger stated the area of disturbance will be 6% of the total area not counting roads.
