This being a scheduled Public Hearing the following items were presented to the Board of County
Commissioners for their consideration:
Consent Calendar
Chairman Johnson stated the first item on the agenda was the consent calendar as follows:
A) Approval of bill paying for week of January 20, 1998, subject to review by County Administrator
B) Approval of the minutes of Board of County Commissioners meetings for January 12, 1998
C) Resolution 97-03, regarding the development of an access plan and 1-70 Interchange Feasibility
Study, Gypsum to Eagle,
D) Agreement between Eagle County and U.S, West Communications, Inc. To provide pay phone
service to the Mt. Sopris Tree Farm, 0488 Valley Road, Carbondale
E) Memorandum of Understanding between Eagle County and Mt. Sopris Skateboarding
Organization for ground rules to permit the organization to use the Tree Farm property for skateboarding and in-line
skating
F) Resolution 98-06, proclaiming January 20, 1998 through January 25, 1998 Denver Broncos Week
in Eagle County,
Scot Hunn, Planner, spoke to item F and asked that it be changed to Super Bowl Week so that all members
of the County might be represented.
Chairman Johnson suggested they can not satisfY everyone,
Commissioner Phillips advised Mr. Hunn this is Colorado and in Colorado we support the Colorado teams,
Chairman Johnson suggested they not order cheese burgers,
Bob Loeffler, Deputy County Attorney, spoke to item E and stated if a signed contract has been returned
from the Mt. Sopris Skate Boarding organization he doesn't have it. He suggested it be authorized for the
Chairman's signature,
Chairman Johnson stated there is a signature line for Jaime Goldner.
Jack Ingstad, Asst, County Administrator, stated they were in a hurry to get back a signed agreement.
Jaime Goldner was out of town, The original is probably in themail.Mr. Ingstad stated the ones he received back
had Mike Bradley's signature,
Mr. Loeffler stated that was added after the original contract was mailed,
Commissioner Phillips asked about payment of the pay phone,
Mr. Ingstad stated they have paid for the installation but will receive the revenue,
Kelly Jo Wallace, Buildings & Grounds, stated with the usage out there it will still cost the County about
$200 per month.
Chairman Johnson stated the reason for the phone is for emergencies and they had not anticipated it would
pay for itself.
Ms, Wallace stated they will need a timer on the lights to turn them off at 10:00 p,m,
Commissioner Phillips moved to approve the consent calendar as presented being items A - F,
Chairman Johnson seconded the motion, Of the two voting commissioners, the vote was declared
unanimous, Commissioner Gates was not present at this meeting,

Staff recommends the neighborhood be the Edwards area/PUD,
Commissioner Phillips moved to establish the neighborhood as the Edwards area/PUD for Marko's Pizzeria,
Chairman Johnson seconded the motion. Of the two voting Commissioners the vote was declared
unanImous,
Mark Esteppe, applicant, testified as to the needs of the neighborhood,
Commissioner Phillips moved to establish the needs of the neighborhood as evidenced by testimony and the
submitted petitions,
Chairman Johnson seconded the motion, Of the two voting Commissioners the vote was declared
unanImous,
Commissioner Phillips moved to approve a new hotel and restaurant license for Marko's Pizzeria of
Edwards, Inc" dba/Marko's Pizzeria,
Chairman Johnson seconded the motion. Of the two voting Commissioners the vote was declared
unanImous,
Blue Creek Grill
Sara Fisher presented a renewal of a hotel and restaurant license for Fabulous Foods, Inc" dba/Blue Creek
Grill, She stated this application is in order and all fees have been paid. The Sheriff s Office reports no complaints
or disturbances during the past year. Staff recommended approval.
Commissioner Phillips moved to approve the renewal of a hotel and restaurant license for Fabulous Foods,
Inc" dba/Blue Creek Grill.
Chairman Johnson seconded the motion, Of the two voting Commissioners the vote was declared
unammous.
Commissioner Phillips moved to adjourn as the Local Liquor Licensing Authority and reconvene as the
Board of County Commissioners,

SD-0014, Eagle River Fire Protection District
Keith Montag, Director of Community Development, presented file number SD-00014, Eagle River Fire
Protection District, consideration of their service plan, He stated the applicant is proposing to provide consolidated
fire protection services through the adoption of a service plan for the Eagle Fire Protection District. Staff
recommended approval.
Mr. Montag stated the service plan is relatively self-explanatory as are the staff comments. He stated they
heard from the Town of Avon by letter who have stated they do not wish to be part ofthis district. In addition there
is a letter in the packet from the Lebo's who are requesting to be excluded from the boundaries of the fire district.
Chairman Johnson asked Bob Loeffler for direction about the exclusions,
Mr, Loeffler stated they know what they must address first is the exclusions, Those findings are in staffs
report and those issues should be addressed, There is a second petition for exclusion from Alikar Gardens Resort
which is addressed to both special districts on for today.
Chairman Johnson asked for statute about the exclusions.
Mr, Loeffler stated the items in staffs report are taken from statute in 35-103 (2) and 35-103(5),
Mr. Loeffler read those sites and the requirements, He stated those are on page two of staffs report,
Chairman Johnson again asked about the exclusion,
Mr. Loeffler stated the burden is on the applicant to show that the application is not in the best interest of the
district. The person seeking exclusion may want to address their petition, The proponent must then address that.
Jim Collins, Collins & Cockrel, stated he represents the petitioners for the Service Plan, He stated they are
ready to commit not to move immediately. They are requesting the Board approve the service plan and find it in
conformance with the standards and requirements. Then they plan to wait until they have more of a consensus with
the eleven entities to make sure they can meet their needs. They are not planning a May election at this time,
Chairman Johpson asked if there is an expiration date and if they are not looking to make a change.

Mr. Moore stated when you have so many entities involved it is difficult to gain consensus on cost sharing,
Mr. Collins asked about difficulties in providing apparatus,
Mr. Moore spoke to the Edwards Fire District and the need for a three Board approval. Other areas benefit
from the rolling stock without paying, None ofthe districts to the west have paid but stand to benefit. He stated it
should be simple to finance and it is now more difficult than it should be,
Mr. Collins stated he has reviewed the statutory requirements for approval. He asked Mr. Moore if this plan
meets the requirements and the needs.
Mr, Moore responded yes.
Mr. Collins asked if the plans as they exist are inadequate.
Mr. Moore responded yes.
Mr. Collins asked ifthis service plan would meet the needs.
Mr. Moore responded yes,
Mr. Collins spoke of the costs to the property owners and suggested the costs would be less than they are
now as properties are now excluded, Mr. Collins suggested the mil levy now is 2,8 mills and in the proposed plan it
would be 3,5, That would include additional attributes and those would be the reason for an increase, The reason
for asking for the 3,5 mill levy is to ask for room to accommodate the proposed services,
Mr. Moore stated the service plan looks at the next ten years,
Mr. Collins stated at the Planning Commission it was requested to remove the Almont Report, They do not
object to the removal as it is superfluous, They are looking at continued service and not greatly increased,
Mr. Collins asked if service could be provided by any other entity if this is not approved, Mr, Collins
continued his questioning regarding compliance to the master plan,
Mr, Moore responded affirmatively,
Mr. Collins spoke to the long range water quality in the area,
Mr. Moore stated he believes it is in compliance and is in the best interest ofthe area proposed to be served,
Chairman Johnson asked Chief Moore ifhe was aware of their discussions with the Town of Avon and their
request was not timely received either.
Mr. Collins stated they do not believe the Town of Avon falls under the same requirements as property
owners, Mr. Collins stated they need to have the Town's consent for them to be part ofthe district. They could
however, just contract with The Town. Mr. Collins stated they have the 150 service contracts with individual
property owners, They need to have Avon fully cooperating and fully convinced that what they are doing is proper,
Mr. Collins stated that petition is a different type and is a lack of consent.
Commissioner Phillips asked how that would work with the Town of Avon,
Mr. Collins stated they would have the same contract with the Town of Avon replacing sixteen contracts
with one. It would still result in a substantial reduction in complication,
They would like to not proceed with an election until they have the Town of Avon's full support. Even if
they chose not to be in, they want their support of the bond issue,
Mr. Collins turned to the issue of capital. They have developed a capital plan and the replacement of fire
stations with a "super station". Whether the super station is located to the west or not they have developed a budget
of the capital needs for the next few years is $7,000,000, He asked Mr. Moore if that is reasonable,
Mr, Moore spoke to the position of the fire stations as they are now with Eagle Vail, Avon, Beaver Creek.
In the long term to find staffing and rolling stock will be must more cost effective.
Mr. Collins asked the Chief how long he has been with the department.
Mr. Moore stated he has been Chief since 1989 and in the fire district since 1979.
Chairman Johnson asked about response time and the effect on places like Red Canyon,
Mr, Moore stated response time is not as important as how many people are on the truck. Mr. Moore stated
they are responding with two people and that is still not enough, He stated ideally there would be a minimum of
four people on a truck. He stated service will be improved by developing a larger station and adding to the student
population, doubling the crew size there and in Edwards to four people. He stated the more stations you have the
more expensive it is, They look for one at Edwards and one at Hwy 6 and Avon Road,
Chairman Johnson stated the thing that concerns him is the congestion on Hwy 6 and the response time to
areas in Eagle Vail. He questioned the response time but understands the argument of having more people.
Mr. Moore stated it has always been a concern and the roundabouts have simplified their ability to get
through, He again stated five road miles is the norm. He stated where he has a concern is in Eagle Vail when they

Town of Avon not participating, He suggested the capital expenditures and debt service would be greater and
thinks that the debt side must be decided,
Mr. Collins stated there would be an effect if the Town of Avon doesn't participate and they would not have
the super station located in the Town of Avon, He stated one of the reasons to build that station so close to the
existing fire station is so that the town would have that building,
Chairman Johnson asked about the Eagle Vail building,
Mr, Collins stated they first would have eliminated it but with the Vail Center moving along they would
consider building a structure there, Mr, Collins stated Eagle Vail does need the building for other purposes,
Commissioner Phillips asked about #3 of the Planning Commissions recommendation.
Mr. Collins stated they are in agreement. If approved, they will rewrite the service plan,
Mr. Loeffler questioned waiting to 2000 and if the service plan, the building costs, the financial plan, etc,
will all be the same,
Mr. Collins stated they believe they will, He does not see that there will be material modification in the next
five to ten years.
Mr. Loeffler asked ifthe service plan ultimately proposed will be as is today if they will apply for
amendments.
Mr. Collins does not believe the changes will be material enough, They would come back with a
modification to the service plan if for example they need $8,000,000,
Mr. Loeffler stated about the timing and how long they can live, he does not see any time limits imposed by
statutes. He suggested an expiration date for the approval.
Commissioner Phillips moved to approve SD-OO 14, Eagle River Fire Protection District with the four
conditions and an expiration in the year 2000,
Chairman Johnson seconded the motion.
In discussion Chairman Johnson spoke to the positiveness of the consolidation,
Mr. Collins spoke to condition # 1 and that it is possible that a entity may not chose to be in initially,
Chairman Johnson suggested that no district would be included unless they want to be included, They
would have to agree to dissolve in order to be included.
Chairman Johnson called for the question on the motion, Of the two voting Commissioners the vote was
declared unanimous,
SD-00013, Beaver Creek Metropolitan District
Keith Montag presented file number SD-00013, Beaver Creek Metropolitan District, consideration of an
amendment to their service plan. He stated the applicant is proposing to amend the existing service plan to include
comprehensive transportation service and traffic and safety controls, Staff recommended approval. He stated they
did receive letters requesting exclusion once again from this district, one being the letter regarding the fire
protection district and the other is from Dustin Himsel. In the letter he stated he does not have adequate
information, Mr, Montag stated they sent the letter for referral and have included those letters.
Mr. Collins stated they have no exclusion requests that were received timely for filing, He stated he testifies
it would not be in the best interest ofthe district to exclude the parcels.
Mr. Loeffler agreed the letter from Karl Finzel is not timely. Mr. Himsel stated he does not want to be in if
it will cost him more but yet he doesn't know for sure if he does or doesn't want to be in.
Mr. Collins stated they are prepared to offer testimony.
Commissioner Phillips moved to deny the exclusion ofD,C. Himsel in the district request.
Chairman Johnson seconded the motion, Of the two voting Commissioners the vote was declared

Jim Collins, representing Beaver Creek Metro District, stated this is the final step before voter approval for
the amendment of the Beaver Creek Metropolitan District Service Plan, He stated they are prepared to assume an
additional power, being transportation, For a number of reasons the district has determined it would be better to
have the Metro District operate the facilities, They are looking forward to a new transportation system that would
be extremely expensive, They have filed a number of documents and want to include exhibit A, Notice of Filing,
Exhibit B and the Notice of Hearing, and Exhibit C and the notice of Mailing,
Mr. Bernstein spoke to the financial matters ofthe service plan stating he prepared a draft ofthe service plan

applicant is requesting 2,542 acres, formerly known as the Colville/Janes Parcel and the Kummer Parcel be
included into the Cordillera PUD, Density requested is 155 lots to contain 175 units, the density for this area is
being transferred from within the existing PUD, Overall density of the Cordillera PUD will remain the same, This
sketch plan request is for allowance of 155 free market unit lots and 220 caretaker units on the 2,542 acre Mountain
Tract parcel, with the proposed density being transferred from the currently approved units within the existing
Cordillera PUD, This effectively lowers the overall density in the PUD to one dwelling unit per 6,55 acres by
keeping the approved dwelling units to the same number while adding over 2,500 acres of property to the PUD,
Staff recommended approval
Gerry Ingle, president of Cordillera, spoke to the acquisition of the property and the law suits that prompted
that acquisition, Ultimately Cordillera purchased the property from Kummer and Janes and now believe there are
no other adjoining properties that can claim access through their property. Colorado Open Lands and the Diamond
S Ranch are the other two adjacent property owners and have historical access in different areas,
Lance Badger, Cordillera, stated they opened dialog with the those who might have concerns or ideas, Staff
has been extremely helpful. They and staff have resolved the planning issues and are in agreement. He asked to
walk them through the plan reminding the Board it is in Sketch Plan, Mr. Badger pointed out the piece of property
on a map, He stated they originally looked at the property as stand alone but decided it would be better as part of
Cordillera, By down zoning the property it will reduce the impacts to the area, There will be no additional
demands for water as 30 to 40 of the homes will be on wells. There will be no additional traffic on Squaw Creek
Road, By down zoning they have created a transition area from the ranch outward, The most dense area is 12 two
acre parcels. It does create a transition with the 35 acre lots on the west end of the property.
Mr. Badger stated they did some creative things with the 35 acre lots. He showed one to the Board on a
map, Within the 35 acre lot they created a four acre building envelope, They also placed a conservation easement
over the 31 acres, The distance between the envelopes will be significant creating area for habitat. Mr, Badger
spoke to the architectural guidelines. There will be a second story of only five feet. They have limited the height to
32 feet in the guidelines with a maximum of 35 feet. Mr. Badger stated the area of disturbance will be 6% of the
total area not counting roads. With regard to wildlife, the public lands to the south are now linked to the property,
They have established wildlife corridors throughout Cordillera, The DOW is very pleased as is the Forest Service,
They have created the first leg of a public trail into Forest Service land,
Mr, Badger summarized their proposal.
Mr, Loeffler asked about the 35 acre plots being conveyed, He asked ifthey are applicants with them,
Mr. Badger stated they have their Power of Attorneys and will submit those.
Commissioner Phillips questioned how there can be no increase when 72 units is less than 125,
Mr. Badger stated use by right is 145 dwelling units, with primary and secondary units, Because they are
not doing that they are asking to shift existing density to that area, It is a reduction of what they have had approved
previously.
Chairman Johnson clarified the moving ofthe units from the original PUD to this site.
Mr. Badger stated the previous owners could have developed with maximum units without any zoning
change,
Chairman Johnson spoke to the wildlife and the lack of clustering. He asked if they are taking into
consideration road impacts.
Mr. Badger stated the roadways have been designed into this and will not be barriers to the wildlife
migration, Mr. Badger stated the corridor is designed to provide additional migration, They worked with Bill
Heicher on that and have increased the width of the corridor.
Commissioner Phillips spoke to the requested agreement with DOW and what type of requirements they
may have.
Chairman Johnson stated they have a requirement in the land use regs for the wildlife mitigation plan,
Mr. Badger stated they can enter into an agreement and already have the 35 acre parcels,
Matt Donovan, property owner on Squaw Creek Road, stated he has concerns with ridge line homes,
Mr. Badger stated the area being developed will sit back from the ridge line. He showed Matt the spot on
the map. He showed the balled spot that is visible from down below, He stated he does not believe the ridge can be
seen from Avon. He stated the idea was not to impose any development for the ridge line,
Sid Fox, area Planner, stated that concern was addressed by the Planning Commission and is addressed in
condition #8.

Mr. Loeffler concurred,
Steve Isom, Isom & Associates, stated Menzels Woodworking Shop is dying to get in. The well permit is
very restrictive to one building and it must be commercial. They are not allowed to outside landscape, They have
master planned this area for service industry. That is why they need the wood storage and it would be outside,
tarped and elevated. They will do what they can to camouflage it.
Chairman Johnson asked how they came up with 20% and questioned the condition limiting the retail area
to 20% of the floor area.

a Napa Autoparts will be allowed. He suggested a retail showroom manufactured on site is appropriate,

Chairman Johnson looked toward the future with Napa and then this complex, He suggested if there is a
plumber, it is different than having a plumbing fixture retail shop.
Mr, Clarkson suggested the zoning is intended to separate incompatible uses. He thinks if they were not to
have any restrictions retail sales is a use by right and would be allowed. He stated there are retail uses that are not
appropriate out there,
Mr. Long stated they agree with Paul and that is why they are working with the Town of Gypsum to master
plan the entire area. They have no problem with the limitation of 20%,
Mr. Clarkson stated staff does not have a problem with getting this applicant into the area. Staff agrees this
is an appropriate use on the site, The show room is an restricted accommodation,
Chairman Johnson stated they cannot make their decision based on what mayor may not be going in now,
The PUD Guide is pretty restricted to its uses as is the well permit.
Chairman Johnson asked if the well permit can be changed.
Mr. Clarkson stated not without a court approved augmentation plan,
If changed, Chairman Johnson asked what restriction they will have,
Mr. Clarkson stated they will remain in place. He stated staff has a history with this site, The building was
built and they have had code enforcement issues, Now they are getting zoning in place to allow for some uses to be
properly in place, The site is trying to respond to a need and a PUD Guide created for it. Staff has listed conditions
to not allow for expansion. Staff requested and suggested they only be looking at this site in terms of the site plan
