Commissioner Johnson stated he would like to vote on C separately. On item G, he asked Mr. Bradley if they were going to a boy scout system. Mike Bradley, Buildings & Grounds Supervisor, explained item G to the Board. Chairman Phillips asked if this was budgeted in this years budget and ifso would it be completed this year. Mr. Bradley stated the biggest advantage to this system is that the current system ties up two lines. By having this in house, we can reduce the number of lines each call takes, and it would upgrade the switch. Chairman Phillips asked about the five phones that don't have voice mail. Mr. Bradley responded they would be able to add voice mail to all work stations. Michael Mudder, Vice President of Cordillera, answered yes, Commissioner Gates moved to approve Resolution 97-145, ZC-00009 & PDP-00004, Brett Ranch, PUD, incorporating Staff findings, Commissioner Johnson seconded the motion, Commissioners Phillips and Gates voting aye and Commissioner Johnson voting no, Resolution 97-146. ZS-00003, Gypsum Ranch Sand and Gravel Pit. He stated this was a resolution for the approval of a Special Use Permit for gravel extraction and processing for Gypsum Ranch Sand and Gravel Pit, The Board considered this file on August 18, 1997, Chairman Phillips asked why this is just coming forward, Kathy Eastley stated this is the second time, She explained this was a very detailed file and when previously scheduled there was a question on the expiration date, Commissioner Johnson clarified the Board understood it to be a ten year permit. Ms, Eastley explained the commencement date of June 1, 1998, Commissioner Johnson stated it is ten years or less as it expires June 1, 2008 because they are phasing out another pit and transferring operations to this one, Commissioner Johnson moved to approve Resolution 97-146, ZS-00003, Gypsum Ranch Sand & Gravel Pit, incorporating Staff findings, Commissioner Gates seconded the motion. The vote was declared unanimous, Resolution 97-147. ZS-00023. Edwards Village Center. He stated this was a resolution for the approval to amend existing Special Use Permit No,(s) ZS-104-79, ZS-116-80 and ZS-117-80 to add Medical Clinics as a use by right on the property, The Board considered this file on October 14, 1997, Mr, Johnson explained this was the second time this has been presented and condition #2 was clarified regarding no overnight stays, Commissioner Gates moved to approve Resolution 97-147, ZS-00023, Edwards Village Center, incorporating Staff findings, Commissioner Johnson seconded the motion, The vote was declared unanimous, Community Oriented Policing Services, Fast Grant Application Award Jim Hartmann, County Administrator, stated this is a grant for five officers, The impact to the County will be about $89,000 per year, If the Board agrees to this, they will change the budget accordingly, Commissioner Gates moved to approve the Fast Grant Application Award, Commissioner Johnson seconded the motion, The vote was declared unanimous, Eagle County Regional Airport Ground Transportation Rules Jim Elwood, Airport Manager, presented the revision of the Eagle County Regional Airport Ground Transportation Rules and Regulations, He explained the revisions to the Board stating they have now received numerous letters from the Ground Transportation providers, He suggested they continue with their previously approved rules and regulations at this time though he believes there are some inequities built in, He stated sometimes those are hard to resolve, He stated he wanted to advise the Board that one of those inequities is within the pricing structure, He spoke to infrequent usage compared to regular usage, He spoke to ADI, and the automation of vehicle identification. He recommended this goal and he would like to see it in service next year, It would come forward later this year. He suggested the price is between $80,000 and $100,000, They may be able to share transponders and reduce costs. Only 15% of the field will be disturbed at anyone time, Mr. Luicki stated the land owner stated wildlife has only been on the property for two years, The applicant does not believe this is a critical habitat for deer and elk. Glen Palmer, Alpine Engineering, stated the speed limit of Colorado River Road is typically 40 miles per hour, He stated Coffee Pot Road is typically 25 miles per hour, The average daily traffic on Colorado River Road is 608 and the predicted traffic of the pit is 16 trips per day and employees would be approximately 14, The total number of trips is approximately 28 per day, The proposed pit will not be working year round, He stated Colorado River Road is a County Road, not a State road, He stated based on a 40 mile per hour design speed, there are no requirements for an accell/decellane, He stated for the bridge, there is a standard for sub standard roads. The requirements are based on the amount of traffic on the road, The bridge would be acceptable as is, Commissioner Johnson questioned if an actual measurement was done, Mr. Palmer stated he did a measurement, The biggest concern about the bridge is its proximity to Coffee Pot Road. One vehicle per hour is considered acceptable, Site distance at 20 miles per hour is based on a vehicle being able to turn onto the road and if there is enough distance for that to happen safely, He recommended additional signage be installed, Based on the criteria, the signs do not indict there to be a problem, He spoke to paving Colorado River Road from I-70 to Coffee Pot Road, Commissioner Gates stated most people do not drive 25 miles per hour, rather about 45 miles per hour, He questioned an overlay on the road, Mr. Palmer stated the applicant might be acceptable to signing a contract for future improvements, Commissioner Johnson questioned the speed limit and Mr. Palmer's calculations, Mr. Palmer stated even at 40 miles per hour accell/decellanes are not needed, Discussion followed on the design recommendations. Mr. Hover reviewed the costs incurred and the denials on the first two pits, He stated his best guess is that they will spend between 30 and 50 thousand dollars on this pit. He stated it is extremely costly to remove gravel in Eagle County, Mr, Hover referred to the report he sent the Board. They have also expressed a concern with the length of the permit. They are suggesting a permit be granted for ten years and the Board can then restrict any further excavation after that period of time, He suggested they could either be granted a new permit or let the permit expire, Mr. Lindahl suggested in reviewing the report both he and B & B see a bias in the analysis staff has made in preparing this permit. Mr, Lindahl stated staff has refused to recognize the importance of resource excavation, Mr. Lindahl stated if it hadn't been for resource recovery, that road would not have been built nor would it be maintained, Mr. Lindahl stated they have the water rights needed to develop this pit. On page three of staff s report they base their assumption on performance not on consistency, He suggested there are small details that are misleading in staffs presentation, Mr, Lindahl referred to permissive use for access but that has been at the good will of the land owner. BLM has had access because Dr, Jacobson has allowed it. Mr, Lindahl spoke to the open space and the fact they will use approximately 15% ofthe property, He doesn't know of a land use that would limit their development to that degree, That leaves 85% for open space and wildlife, He stated wildlife are not intimidated by gravel mining or operations, Mr. Lindahl spoke to transportation and the maintaining the rural character. He asked ifthey are maintaining the roads as is and if the roads are bad now they will always be bad, He suggested when there is a need based on use to improve a road it is to improve it so it is safe, That does not mean accell/decellanes, Mr. Lindahl spoke to gravel mining and it being a commercial activity, Mr, Lindahl stated if resource extraction is a commercial activity they have one heck of a precedent set. There has been logging there for fifty years, They are different beasts, Mining is not the same as development. Staff refers to the lack of development along the Colorado River Road and that they don't need the gravel extraction, He stated when you don't have a plan, you end up with what is happening in Wolcott, Staff suggested it may be ten years before there is development up the river Road, If they wait, it will be too late, The Board has no authority to compel the developer to mine the gravel. This is an opportunity to make sure they preserve this gravel resource, Mr. Lindahl spoke to the Eagle County Open Space Plan, He stated every gravel pit is in a constrained area, They are talking about disturbing 15% of the site, What other types of development will allow for that. He doesn't believe the standards staff are using are very consistent. Mr. Lindahl spoke to compatibility and the incompatibility with construction sites, Mr, Lindahl suggested that ultimately, gravel pits are not compatible with any kind of use, They are trying to mitigate the impacts the very best they can, He stated they have worked with the neighbors and have tried to work with the County, Mr, Lindahl suggested a Planning Commission member voted against it so that it would come directly to the Board of County Commissioners, Mr. Lindahl stated Staff refuses to acknowledge the use of the resources in this area, Mr, Lindahl spoke to the last paragraph of the report and the maintenance of the rural character, That paragraph fails to realize the importance of tourism and development to this county, Mr, Lindahl stated they are not suggesting the environment be destroyed, He stated at the same time, they must have gravel because construction is an important part of the economy, Mr, Lindahl suggested that much of what staff has submitted were not validated concerns, The DOW did not contribute that information, Staff did, Mr, Lindahl spoke to the Planning Commission meeting an analysis submitted by Ron Brave, a member of the Planning Commission, His numbers were more aggressive than Scott Hover's, Mr. Lindahl spoke to one of staff s findings for denial around temporary sanitation systems, The Environmental Health department does not agree and does not seem to have a problem with the plan, The arrangements on the site are suggested as not being compatible, He stated you can't see the pit except for a couple of spots on the Coffee Pot Road, He stated where it can be seen is not where you would stop and look at the view, Mr. Lindahl suggested he would not review the traffic report, He finds it unfortunate that staff wouldn't take the time to attempt to find mitigating conditions, Mr, Lindahl stated they listened to the Board three years ago when they were here, They have had three more years of production since then, It is important that they look at the impacts of this reserve on the County's future needs, Mr, Loeffler referred to copies ofthe conditions that Mr, Hover submitted, Commissioner Johnson suggested that one Planning Commission member voted against this as there were no conditions placed by Staff, Mr, Lindahl stated Arlene Quinnon asked for conditions on the premise that this file would be approved, He stated there weren't any conditions presented by staff. Once you open up this valley to this type of development, resource extraction, there is no stopping, He suggested the next application cannot be denied with the precedent set. He believes in personal property rights and generally the changes effect only the property owner but not in this case, This is a narrow road with a small ditch and mountain, He stated he has driven busses on the road for twenty years and still gets chills when passing trucks going the other way, In the twenty years he has driven the road he has never seen anyone stopped by police, He also feels the property values will be diminished, With respect to the Jacobsons and B & B management, they have places to live. Those who live there may not have that alternative, You can hide the gravel pit but you can not hide the impacts, Mr. Steward asked they consider the reality and that it just doesn't make sense, John Ehring, a resident for twenty five years stated he hasn't heard what is a valid reason for rejecting this pit. He suggested the surrounding Counties are going through this same thing, There won't be roads, He asked they grant this permit. Harold Bernett, an upper valley resident and employee of B & B, stated if B & B had not come in we may not have the development we now have. Commissioner Gates moved to approve file number ZS-00004, Hidden Valley Pit, incorporating Staff findings and the twenty conditions written by the applicant for a ten year term not to exceed 50,000 tons per year on 29.2 acres, Chairman Pro-tem Johnson seconded the motion, Commissioner Gates suggested he can understand the peoples concerns and the impacts, He stated he is looking at this as to what is in the best interests for the citizens of Eagle County, By not approving this, he believes the development will be driven further up valley, Commissioner Johnson stated things will change up the Colorado River Road and there will be development up there and he understands Erin's concerns, He does not believe this is the time for the change to occur and that this is not a ten year proposal but a forty to fifty year proposal. He doesn't understand why they would approve something that would leave Dr. Jacobson's land less useful. What they are looking at is a full blown mining operation in this area rather than a ten year limited operation, Commissioner Gates stated the motion is for a ten year pit and that they should not assume things that they don't know for a fact. He recalled the residents up Sweetwater coming in every month asking for gravel. Chairman Pro-tem Johnson stated he was reading from the applicant's application, Chairman Pro-tem Johnson called for the question on the motion. Commissioner Gates voting aye and Commissioner Johnson voting no, Commissioner Johnson turned the meeting over to Chairman Phillips, Mr. Loeffler stated the motion is pending the vote as it has been set forth in the motion, Chairman Phillips asked when the mining would start, Mr. Hover stated they will continue to move forward on the applications to the State and when the permits are in place they will begin development. Chairman Phillips asked Mr. King if he lives in his house on Colorado River Road or if Mrs, Hecktalllives there, Mr. King stated he and Kathy moved there in 1977 and raised their kids there till 1988, They then moved closer to Battle Mountain where their children attended school. They now live up valley and since both children are now in college, they will soon move back. Chairman Phillips stated she has given this a great deal of thought and she sees this as a difficult decision to make, She has listened to the concerns ofthose on I-70 who don't want it in view, She stated she drives that road a lot and has grandchildren up there, She stated they have been here a long time, Her daughter worked at Anderson camps, she has visited the site and knows the area, She stated she appreciates Mr, Hastings and the survey of the road, She was told to listen to the people, ten for and ten against, with breaking the tie, Chairman Phillips spoke to the cyclists on the road and the impact and danger. Her concern is not necessarily for the ten years that they may approve, She does not believe that forty years should be in the consideration, Ten years is what she feels should be considered, She believes there are major concerns for mitigation and those will have to be addressed as this moves forward if approved today, She believes the mitigations shall be met and during times like hunting season, there should be no trucks on the road, She suggested a compromise is something they should look at.
