Commissioner Johnson moved the Board table item I to September 22, 1997, He stated there will be a resolution drafted, Commissioner Gates seconded the motion, The vote was declared unanimous, James Fritze, County Attorney, asked to withdraw item F stating it was no longer necessary as a replacement letter of credit has been submitted, Commissioner Johnson stated in item B, Board minutes, he had a couple of corrections and submitted those to the Clerk. 's~lUoqUMol du~'1 s8UlS '1LOOO-gWS l:}qmnu ~1Y lU{d {uuy ~AOldd13 Ol P:}AOUl uosuqof l:}UO!SS!UlUlO;) BOARD OF COUNTY COMMISSIONERS EAGLE, COLORADO RECORD OF PROCEEDINGS FORM 50 HOECKEL'S 387869 the intent to close any driveways unless they are going to redevelop, He stated it is a long range plan that would be implemented in phases, Mr, Felsberg emphasized this is something new, and they are fairly new in Colorado as there are only 10 to 12 now, It is a nationwide trend as the benefits can be seen, Chairman Phillips asked if there is a possibility of having an owner off ramp by Hillcrest Road, Mr. Felsberg stated it was discussed both there and at another location, He stated they chose not to put it in the plan for a couple of reasons as they didn't want to get into interchange feasibility, There is a process they would have to go through with CDOT, Partial interchanges are difficult to get approved, Interchanges that don't provide for all movements are a concern to them, He stated there is a processes to have those approved, He stated the community should not forget the ideas and they are worth pursuing, Chairman Phillips asked for public comment. Sue O'Neil, area resident, asked why they would not do full access at Hillcrest and Cemetery Roads, Mr, Felsberg stated the intent of this plan was to look at access from I-70G, He suggested these could certainly be pursued, He stated Cemetery Road is a lesser candidate, Ms, O'Neil asked about sound barriers, Mr, Felsberg stated there are standards established to do that and as widening comes into play, those concerns would be addressed, He stated they are not doing a transportation plan for the community per say, The process would be if a widening project comes in on Hwy, 6, there is then a process they have to go through to address all of the environmental aspects, That is when the studies would be done and the restriction in place, Kim Andree, resident of Homestead, stated she has attended the meetings remarked that safety was a concern in unified voice, She doesn't believe a five lane road is the safest bet. Five lanes does lead people to believe they can accelerate, If a vehicle is traveling at a high rate of speed over a period of time, the speed tends to increase, She questioned the use of the railroad abandonment to be used as highway access, Commissioner Johnson explained the restrictions that are placed on the use ofthe railway corridor. He stated that is not a possibility, Ms, Andree spoke to the secondary access easement for Cordillera, Homestead and South 40 only have single access, She reflected on the five lane roadway on Colfax in Denver. Commissioner Johnson asked about the seniority of the water rights, Mr, Stangion stated the Brett Ranch rights are the senior rights, second to one, Mr, Mutter stated there were also some issues from the NWCOG regarding storm water retention issues, They are now satisfied, Finally, before they get their grading permit they come back to the County, The Colorado Geological Survey asked for additional information, They completed the needed study but include a plat note requiring a geological survey be done on all single family homes, Mr, Mutter stated that is the end of the issues of concern for the 1041, Mr. Merry stated staff is recommending approval with the two conditions listed above, Jim Anderson, a resident of Homestead, asked if this pertains only to the water rights or can he bring up the issue of treated water, He stated he understands the Eagle River water people have said there is plenty of water on this project, He suggested they are looking for approval for 200 some units as compared to the original 16 units, Mr. Anderson stated he lives high in Homestead and on July 4, had no water. He stated that Saturday morning their water went off at 6:00 a,m, He stated it came back on at 11 :55 a,m, He stated he was told two hours after the outage they have diverted water from their tank to Arrowhead, Mr. Anderson asked ifthe Board realizes how much water is used in comparison to how much is treated, He referred to the massive use, The State recommendation is when you reach 80% capacity, you don't approve more development until a plan has been put in place, He stated they have over 1000 units that aren't yet built. He is saying it is wrong to approve this project prior to a new plant being built. People know the cost of living here, but if employers would pay accordingly they could become home owners, Dennis Galvin, General Manager of the Eagle River Water and Sanitation District, responded to the outage over the 4th of July weekend, He stated they have traced the problem, it has been corrected and they don't expect more problems, Mr, Galvin stated 10,000,000 is the capacity, Peak use reached about 3/4 of that so they do have adequate water to service, They have a new water plan that will be completed in 2000 or 2001, Mr, Galvin spoke to the value of water and they think it makes good sense to restrict its use so that it's used properly, Commissioner Johnson asked about the projected 2300 units in Edwards that haven't been built yet. Mr. Galvin stated he thinks those are the total build out and the water has been augmented, He stated he isn't sure how many have been built today but their plans are designed to help meet the need, Commissioner Johnson questioned the peak being at 75%, He stated they are talking about units that have already been approved, Mr. Galvin stated the new water plan will need to be built for units that have been approved but not yet built. Mr. Mutter stated on page 6 of staffs report it provides the single family equivalent numbers, Mr. Anderson stated he met with three water board members to advise them they have approached 80% usage, He spoke to Mountain Star, Beaver Creek and Bachelor Gulch, He suggested with 10 homes using 100,000 gallons they run out of water real quick. He read from the article stating accidents have doubled since 1990 and Hwy 6 has twice the number of collisions as is the State average, He spoke to the large amount of traffic on Highway 6, He spoke to Lake Creek village and the access that will be in and out. They already have problems with their own people, Until traffic problems are adequately addressed, this project should not be approved, He stated again, until the water treatment center is at least under construction, they should not allow them to proceed, Mr, Anderson spoke to the possibility of them spreading out the units over the property they own. He feels it is very wrong and they must look at the quality of life, Mr. Anderson suggested they will be building the same type of plan they have in Avon. He spoke further to the quality of life, the gravel pit and the cement plant. He stated with an eastern wind they get dust residue from those two plants, He asked they keep it open area and suggested they put employee housing up where it belongs, George Chrissman, area resident and neighbor of Jim Anderson, stated he applauds the job that Cordillera has done thus far. He explained they moved to Edwards because there was lots of open space and it was a family area, He stated they are originally form Texas, They have out of hand growth there, He requests they deny or at least postpone this decision to maintain the quality of life and take a closer look at Edwards, Gerry Coates, area resident, stated he spoke against this before, He stated the Eagle Board of Education is asking for a bonding increase on this November's election, He stated he is not sure they should vote for this, He stated the problem is growth is moving faster than the planned development. He suggested Cordillera has not asked for public money to create this development. Jill Kovaskovich, a member of the Eagle Valley task Force and Eagle Valley Leadership Coalition, applauded the comments made by Mr. Thomason. The concern is still there, Rich Barnes a member of the Planning Commission, stated in the 28 months he has lived here, 27 of those have been working on affordable housing. Mr. Barnes stated there are a lot of good things about this plan. He introduced NIMTO, not in my term of office. This Board has done a great deal in trying to establish a plan for affordable housing, He stated there are too many good things going for it and they have built strong components that will allow for entry level housing. Stewardship comes with ownership, He stated these folks have basically followed to a tee what the housing task force has required. This is all private money. He believes everyone in the County deserves this right. Commissioner Gates suggested this project will not solve the problems of Eagle County. Commissioner Johnson asked how many units did they estimate needing. Mr. Barnes stated between 2000 and 3000 units will be needed by the year 2000. Page Knower stated she moved here after graduating from college and has found a career here. She would like to stay here and call Eagle County her home. The only reason she will leave, is not being able to afford real estate. She read from a prepared statement. She stated the Brett Ranch is the first affordable housing project that will enable her to become a home owner in Eagle County. She stated as a citizen she takes her responsibilities seriously. She referred to a couple of quotes form the campaigns. She quoted Commissioner Johnson and his desire for more for sale units. Bill Andree, resident of Edwards, is not here today to say its a good project or a bad project. He stated he hasn't seen anything that has shown up for safety. We have to take care of the infrastructure, There is not an adequate water system. Part of the problem with Homestead is that it comes through a six inch line, There are a lot of units to build out in Homestead. He's not arguing affordable or not affordable. His concern isn't whether its good or bad but that the infrastructure must be addressed before they move forward with more development. He stated his concerns are water capacity, getting it fixed and upgraded. The situation in homestead puts lives and property at risk. The traffic is horrendous, adding more lanes will increase the speed and there will be more accidents. He suggested they infield what has already been approved, He suggested they may do an impact fee on the developer and get the infrastructure up. Edwards has always been the bedroom community. He is concerned about traffic and water. For every winner, you have to have a loser. Ginger Marshall, thanked the Commissioners for supporting and matching funds for the down payment program. Susan Elkin, an employee of Cordillera and Colorado Mountain College, urged the Board to approve the project and she urged them to keep their campaign promises. She asked the Board allow them to develop as residents in this community. Dave Sloan read petitions into the record stating they wish denial of any additional projects until the master plan has been revised. A newer petition states objection to the change in current zoning and the water and traffic problems that will be created, This morning, he said, they heard one of the best reasons for not approving this plan, that is the Edwards Area Access plan. One of the best ways to avoid this is by not changing the zoning on Brett Ranch. Another issue that wasn't answered was who was going to pay for these improvements. It gave several possible ways of paying but no one plan has been formulated. 7.3% of the identified but still to be constructed units will be in Brett Ranch. He asked if the developers will put up their share of the cost for road improvement infrastructures. Mr. Roussos stated it will be 10 to 15 years before any funding would be available if requested today. This zoning increase is being requested so the current developer can make more profit. Will the developer pay part of that infrastructure. He stated indirectly they are asking for public funds and it is a public problem. This mornings meeting brought up several questions and many problems. How many will arise with the Edwards Sub- area master plan, They are asking they be able to maintain their rights and maintain the development at 16 units. Commissioner Gates made the comment that part of the problem they are dealing with now is a result of zoning decisions made in the 70's and 80's. He stated the current pressures of today should not influence the decisions for the future. Gerry Ingle addressed some of the issues. Land speculation is certainly one thing, He believes, however, that they look at things differently, They see a need for this type of housing, They were the first to aggressively lobby for caretaker units, They were partners in Lake Creek Village, This is a continuation in their effort to provide housing in this valley, It is too simple to say Cordillera is in it just for the money, He stated we provide one of the best places for second homes as well as for permanent homeowners.
