Fisher Chairman Commissioner County Administrator Clerk to the Board Absent: George "Bud" Gates Commissioner This being a scheduled Public Hearing the following items were presented to the Board of County Commissioners for their consideration: The Board convened as the Local Liquor Licensing Authority. Vail Food Services, Inc. Beaver Creek Food Services, Inc. Piney River Ranch, Inc. Earlene Roach, Liquor Inspector, presented a change in corporate structure for Beaver Creek Food Services, Inc., Vail Food Services, Inc. and Piney River Ranch, Inc. The changes reflects the resignation of Gerald Flynn and the addition of James Donohue. She stated Mr. Donohue is reported to be of good moral character. All files are in order and all fees have been paid. Ms. Roach requested three separate motions, to include all establishments under each corporation. Commissioner Johnson moved to approve the change in corporate structure for Vail Food Services, Inc., dba/Game Creek Club, Mid-Vail Restaurant, Two Elk Restaurant, Eagle's Nest Restaurant and Wildwood Shelter. Chairman Phillips seconded the motion. Of the two voting Commissioners the vote was declared unammous. Commissioner Johnson moved to approve the change in corporate structure for Beaver Creek Food Services, Inc., dbalBeano's Cabin, Inn at Beaver Creek, Spruce Saddle Restaurant, Trapper's Cabin, Broken Arrow Cafe, Beaver Creek Golf Club Bar & Grill and Saddleridge at Beaver Creek. Chairman Phillips seconded the motion. Of the two voting Commissioners the vote was declared unammous. Commissioner Johnson moved to approve the change in corporate structure for Piney River Ranch, Inc., dba/Piney River Ranch. Chairman Phillips seconded the motion. Of the two voting Commissioners the vote was declared unammous. Wildwood Shelter Earlene Roach presented a renewal of a hotel and restaurant license with optional premises for Vail Food Services, Inc., dba/Wildwood Shelter. She stated this application is in conformance and all fees have been paid. The Sheriff s Office reports there have been no complaints or disturbances during the past year. Staff recommended approval. Staff suggested the neighborhood be defined as from the establishment in a two mile radius, The applicant has submitted a petition as evidence of need, Staff recommended approval of the license. Commissioner Johnson moved to establish the neighborhood as from the establishment in a two mile radius, Chairman Phillips seconded the motion. Of the two voting Commissioners the vote was declared unanImous, Commissioner Johnson asked if when the petition was signed if it was for a Beer and Wine License or for a Tavern License, Linda Weiner, applicant, stated the petition was circulated for a tavern license, Ms. Roach stated there was a cover sheet for that cover sheet on the petition explaining the process, Ms. Weiner stated her establishment is located across from the movie theater and individuals have expressed a desire for an alcoholic beverage to be served, Commissioner Johnson moved to establish the needs of the neighborhood as evidenced by the petition and testimony of the applicant. Bob Loeffler, Deputy County Attorney, answered no. Commissioner Johnson moved to approve the application for a tavern license for Kibbitz, Inc" dba/Perks Cafe. Chairman Phillips seconded the motion. Of the two voting Commissioners the vote was declared unammous, Gore Range Brewery Earlene Roach presented a new application for a Brew Pub license for Gore Ranch Brewery, LLC, dba/Gore Range Brewery, This establishment is located in Edwards, behind Stop and Save, She stated the first order of business is to establish the neighborhood and the needs of that neighborhood. Ms. Roach suggested the neighborhood be from the establishment in a two mile radius. She submitted an petition of signatures for the Board's consideration, Mark Fisher, Attorney representing the applicant, called James Errant, owner of the restaurant, as his first witness. Mr, Errant explained the theme of the restaurant and his history of restaurant business, He stated all managers and staff will go through TIPS training, Chairman Phillips asked about the location of this establishment. Mr. Errant stated it is located at the corner of Edwards Village Blvd"just South of Highway 6, Commissioner Johnson asked about the size of the restaurant. Mr. Errant answered approximately 5,400 square feet. Commissioner Johnson asked about the quantity of off premise sales. Mr. Fisher stated he knows there is a limit but does not know that number, He informed the Board this license allows for package sales on Sunday, Mr. Loeffler asked about the premise map and the kitchen being excluded from the licensed premise, Mr. Errant stated he did not mean to leave the kitchen out of the premises and requested the map be amended. The Board concurred, Mr. Fisher questioned Max Scott, Oedipus, Inc" about the circulation of the petition. Mr. Scott presented the Board with an opinion poll and explained the circulation of the petition, Rick Mueller, developer and area resident, testified to the need for this establishment.
