This being a scheduled Public Hearing the following items were presented to the Board of County
Commissioners for their consideration:
Consent Calendar
Chairman Phillips stated the first item on the agenda was the consent calendar as follows:
A) Approval of bill paying for week of May 27, 1997, subject to review by County Administrator
B) Approval of minutes of the meeting of the Board of County Commissioners for May 5, 6, 12, 13
& 19, 1997
C) Transfer of permit and succession of operators application form for B & B Excavating, Inc.
D) Resolution 97-55, approving County Investment in Certain Government Investment Pool Trusts
E) Juvenile Wrap Around Program request for approval of application for second year funding
F) First Amendment to the Agreement between Eagle County and Laman Auctions for auctioneer
servIces
G) Lease Agreement between Eagle County and Jack Laman for 43 acres of pasture adjacent to the
Eagle County Fairgrounds for hay production
H) Agreement for Provision of Photogrammetric Service
I) Contract between Eagle County and Montaine Environmental Solutions for a wetland delineation
study and permit application
J) Agreement between Eagle County and Colorado Pavement Maintenance for airport crack seal.
Commissioner Johnson recommended that item C be voted on separately because the Chairman has agreed
to step down from matters involving B & B Excavating, As far as item H is concerned, the Board did not receive
backup and he would like it pulled, He asked for clarification on item 1.
Ellie Caryl, Planner, responded the total sum estimated includes the application for contract.
Commissioner Johnson asked about the agreement.
Ms, Caryl stated the agreement would be to prepare the study and the application,
Bob Loeffler, Deputy County Attorney, stated he would interpret it to be a fixed price to prepare the
application and extra for the contract.
Commissioner Johnson asked if they would need another agreement that says they agree to do that.
Mr, Loeffler explained payment would be clarification,
Jim Hartmann explained item H, He stated this is a time sensitive contract because it involves aerial
shooting, He stated we need to proceed with this post haste,
Commissioner Gates asked about budgeting,
Mr, Hartman stated it is well under budget
Commissioner Johnson moved to approve the consent calender except for item C.
Commissioner Gates seconded the motion, The vote was declared unanimous,
Commissioner Johnson moved to approve item C from the Consent Calender listed as Transfer of permit
and succession of operators application form for B & B Excavating, Inc.
Commissioner Gates seconded the motion, Commissioner Johnson and Gates voting aye, Commissioner
Phillips abstained,

Chris Jouflas stated form has a lot to do with that. He stated in reading the draft, he couldn't tell what was
being changed, He stated there are spots in there that are hard to handle. It is getting smaller and smaller, He
doesn't want to be left out in the cold, There is not enough left, Everything is on top of him, He stated we need
regulation, not over regulation.
Commissioner Johnson stated it is a difficult balance, He asked when they went through the land use regs if
it supported the master plan,
Mr, Jouflas stated he didn't put much time into it. He stated he is sure it dovetails together.
Commissioner Johnson asked if from a citizens perspective, does the document support other documents or
is it so monumental, they should take it a bit at a time, He asked about doing it chapter by chapter,
Mr, Jouflas stated they could feed it piece by piece,
Pat Hammond stated one thing they would like to do is create a document that doesn't force flipping back
and forth, She stated they attempted to do an introductory chapter that explains the whole book. She stated they are
trying to create a form that makes it easier. He suggested that very few people in the county deal with the old land
use regulations at all. He suggested by taking chapters out, they would ultimately replace the whole set, She
suggested there be an eight or ten page summary that lists everything that is new,
Jerry Craghead spoke to clustering, He suggested the County needs a strong resolution that preserves the
right to farm in this county, He doesn't believe there has been this type of discussion.
Commissioner Johnson stated not only a resolution but it should be incorporated in the land use regulations,
Commissioner Gates stated they have tried to do a public process but they have not had the input. He
suggested that unless people are involved they don't have an understanding.
Chairman Phillips suggested they may not be interested, The people on the street don't get into looking at
the regulations, The goal was to be more user friendly with fewer regulations. They wanted to address the old and
the new, She suggested the people that are interested may be looking at it now,
Sid Fox stated getting more public input is laudable, He suggested the Board be comforted because it is
difficult getting public involvement. He suggested it is more successful in a master planning project. He suggested
getting out there and trying to get people involved with an outreach or education campaign, Part of that effort
should include the master plan and trying to understand what the regulations will do, He stated this is a long
process having started in 1992, He suggested the Board review the goals that were set out and in looking at that
many of them are bing fulfilled in the new code, It is not as easy to use as it could be or should be, Getting
amendments in motion seemed to make sense,
Pat Hammond stated at the last meeting people brought up the Leadership Coalition and how effective
they've been, She suggested this task force take on the image of that. She suggested they may never reach
consensus but with a larger, more committed group they may be able to reach that.
K.T, Gazunis suggested on the first draft there were presentations monthly to the Board at work sessions,
She stated there was a small task force, Pat Hammond, etc, She stated the comments were not shared, She stated
there was another meeting which was not a public meeting, She stated it was an agenda item on the planning
commission. At that meeting she was told it was not a public meeting, She spoke to Keith Montag at that time and
was told her input was not welcome at that meeting, The following day there was a full day session that was not an
advertised public meeting, She stated she is not surprised that some who might have been interested did not know
about the meetings.
Commissioner Johnson suggested that is why they are back here today, He asked where they go from here,
He asked that they set up a series of public meetings at all the many communities, He stated if they make a
commitment to get staff to those areas they will hopefully get some feed back. He suggested it be done within a
month,
Ms, Hammond stated they shouldn't have a meeting until the second draft and the summary is finished,
Jerry Craghead suggested a facilitator is a needed participant. He stated the committee has a discomfort
level with the consultant and perhaps they should find a new one, They would come back with an agenda, a game
plan, and process oriented,
Mr. Montag stated to move forward they will have the consultant complete the second draft with all the
changes to date,
Chairman Phillips asked to make sure they have the summary of the changes,
Mr. Montag stated that would be very difficult because the whole formate has changed,
Commissioner Johnson asked what the expanded task force will do,

three units within this one have a tendency to make this part of the corridor less useful. Then they have the animals
moving through elsewhere, The DOW pointed out they realize this is zoned AR. What they suggested they change
the configuration to have less impact. He questioned Rick Thompson's suggestion that the impact is the same. He
spoke to the road and the three units, He stated you have short driveways and disturbed less habitat. This proposal
also recommends they not allow livestock. It will take up more habitat. He suggested they cluster it tighter, He
was told the builder couldn't do that economically. That is not his concern, The other points he brought out in
regards to livestock, the mitigation trust account, different plant species for revegetation, and the covenants which
were supplied to him for review had no enforcement provisions, He does think there is a way to allow development
and alleviate some of the impacts on wildlife, This is kind of a first and there are ways to minimize it.
Mr. Isom stated Rick Thompson's report was very specific and on page two they stated those concerns, He
read from that report, He spoke to the driveway configurations and the recommendations suggested by Rick
Thompson. He stated they have spent a lot of time looking at this and they want to make minimal impact. He
stated dog control will be in the covenants as will be the restrictions on hoses, etc, He stated he believes they have
done as much as they can do to minimize the impacts.
Commissioner Gates questioned why they haven't done what was necessary to conserve these areas,
Mr, Heicher stated as far as them purchasing the property, they don't have the money, He stated the county
has adopted the DOW's maps and these corridors are on them, He stated since 1994 all the land use users have
agreed to these plans and they have gone with the corridors that will be the least impact. With this however, all the
property is within the corridor,
Commissioner Gates stated that is his problem, it is in the corridor, What other options do they have,
Mr, Heicher stated again, they could preserve the common open space, They might not be as far apart from
each other, He stated seeing the neighbor is not a concern ofthe animals, He stated developing all the critical
habitats can happen, The master plan suggests that avoidance of the critical habitat is the primary concern of the
land user regulations,
Chairman Phillips asked about the main Bellyache Ridge Road,
Mr, Heicher stated they still cross the road and they are getting more animals as the development to the east
takes place, He stated they have more road kill. Roads bisecting don't have the effect as those going the length or
parrelling the movements,
Patricia Hammond, Bellyache Ridge resident, stated they have hundreds of animals that cross the road. She
referred to the master plan and stated they are using it. She read a letter into the record from the Bellyache Ridge
Metropolitan District suggesting they should hear Bill Heicher's concerns and pay heed. She stated this has a lot to
do with the future of wildlife in Eagle County, She asked this be tabled,
Clay Irons, applicant and owner of the property, stated as he grew up, he kept many reptiles and came here
to escape, He stated he did not realize there was a wildlife corridor when he bought. He has moved the buildings
twice. He stated that just because you have lines, they won't necessarily follow them, He stated of all that they
have done, of all the hoops they've jumped through, they have spent a lot of time and money moving the building
envelopes to make these as far from the corridor as possible,
Chris Jouflas, citizen of Wolcott, stated the only thing that bothers him is that no livestock is allowed, He
asked if this is the decision of the DOW not to allow livestock. He asked if this is precedent setting, That bothers
him tremendously. Mr. Jouflas suggested if wildlife wants to be contained the people need to put up the
environment.
Doug Maxfield, Bellyache Ridge, stated it seems to him that the people who run Eagle County have either
got to fish or cut bait. Is the DOW going to be your guide, He stated they have had these things for six or seven
years, He suggested they forget the hunting industry, This thing is not a big deal, it the principal, its erosion, its
compromise, Some place it has got to stop and he suggested they start here,
Steve Isom stated one of the main items in their concerns and discussion with Rick Thompson outlined what
he believes the corridor is. He referred to Mr. Thompson's memo, He felt his recommendations were appropriate.
They could have one person develop the entire process. Mr. Isom spoke to the holes on the property, He stated it
makes it difficult to get into the comers, They have tried to come up with a good solution that works for everyone,
Ms. Eastley stated staff is concerned with the wildlife issues and Mr, Katieb referred to the requirement for
signature on the mitigation plan, She suggested a tabling of the application may result in a better plan,
Pat Hammond commented on the water issue as well, She suggested the plan is calling for three esthetic
ponds,

Mr. Clarkson reviewed staffs presentation, their findings, and the applicable reviews, He stated they have
incorporated the changes made by the planning commission into staff s conditions, He explained those changes,
The planning commission recommended approval by a vote of 5 to 1, The dissenting vote was concerning density,
Tom Braum, representing the applicant, introduced the property, He explained they are east of the Miller
Ranch near the Reserve, The majority ofthe site is flat. The site drops off to the river, A very buildable piece of
land, Not critical wildlife habitat. Mr, Braum further explained the site, He stated equally important are the
developers objectives, They are targeting the local market, entry level, move up type of project. They see a series
of duplexes for the local community, They are trying to target the local market by establishing a sense of
community with open space and common areas, There are three different areas they are planning to build in, This
is a conceptual presentation, They prepared a plan showing the nineteen duplex units in one area, In area A, it is
more of a town home layout. The duplexes will have the house and the lot surrounding, They introduced some
street scape with bearing set backs, They are trying to make it an appealing project for all involved, They are in
compliance with all applicable aspects of the master plan, They are in agreement with all the conditions placed by
staff,
Commissioner Gates asked if the access is still over the bridge to the west. He asked about additional
bridges,
Mr, Braum stated their access would be from the Reserve Bridge,
Commissioner Johnson asked about the units in area A and eliminating the street. He explained their
decision on the way it is,
Commissioner Johnson asked about the Town of Avon's recommendation for deed restriction.

Resolution for the approval of a 1041 permit for Fox Run Meadows. She stated this resolution
was for the approval of a 1041 Permit for the construction of a major new water treatment and distribution system
and for the efficient utilization of a municipal water project for the Fox Run subdivision, The site is located on
Missouri Heights, and this permit was approved on May 13, 1997,
Commissioner Johnson stated the resolution he has doesn't involve the Fox Run Meadows,
The Board concurred to pull this item,
Resolution 97-56. approval of a Special Use Permit for the Vail Valley Learnin~ Camp. She
stated this resolution was for the approval of a Special Use Permit for a resident camp/educational facility, The
application was approved on May 12, 1997.
Commissioner Johnson moved to approve Resolution 97-57, Vail Valley Learning Camp, incorporating
Staff findings,
Commissioner Gate seconded the motion, Commissioners Johnson and Phillips voting aye and
Commissioner Gates voting no,
Resolution 97-57. approval of a Special Use Permit for a Temporary Asphalt Plant in the
Wolcott Area. She stated this resolution was for the approval of a Special Use Permit for a Temporary Asphalt
Plant in the Wolcott Area, This file was approved on April 15, 1997,
Commissioner Gates stated he wasn't here and will abstain from voting,
Commissioner Johnson asked about the bonding,
Ms, Eastley stated the attorney's office has it.
Commissioner Johnson moved to approve Resolution 97-58, temporary asphalt plant in the Wolcott plant,
incorporating Staff findings,
Commissioner Phillips seconded the motion, Commissioner Johnson and Phillips voting aye and
Commissioner Gates abstained,
Resolution 97-58, approval of Extension of the Sketch Plan for the Eagle Valley Regional Park aka
Berry Creek Fifth filing. She stated this was a resolution extending the Sketch Plan for a period of one year, The
Sketch Plan will expire on June 14, 1998,
Commissioner Gates moved to approve the Extension of the Sketch Plan for the Eagle Valley Regional Park
aka Berry Creek Fifth filing,
Commissioner Johnson seconded the motion, The vote was declared unanimous,
Ms, Eastley stated she will bring the Fox Run Meadows resolution back at a later time,
There being no further business to be brought before the Board the meeting was adjourned until June 2,
1997,
