This being a scheduled Public Hearing the following items were presented to the Board of County
Commissioners for their consideration:
Consent Calendar
Chairman Phillips stated the first item on the agenda was the consent calendar as follows:
A) Approval of bill paying for week of May 12, 1997, subject to review by County Administrator
B) Approval of Commissioner Minutes for April 1 through April 29, 1997
C) Resolution 97-49, concerning appointments to the Eagle County Fairboard
D) Resolution 97-50, concerning appointments to the Junior Livestock Commission
E) Approval of two 1997 Dodge Intrepids per specification
F) County Veterans Services Officer's monthly report for April 1997
G) Cops Universal Hiring Supplemental Award to the Eagle County Sheriff's Office,
Commissioner Johnson requested a separate motion for item B as he has not been able to read them as of
yet.
Commissioner Gates moved to approve the Consent Calendar consisting of items A through G except for
item B.
Commissioner Johnson seconded the motion, The vote was declared unanimous.
Commissioner Gates moved to approve item B of the Consent Calendar,
Commissioner Johnson seconded the motion,
In discussion, Commissioner Johnson stated on April 21st Commissioner Gates was not present and would
like that correction reflected,
Chairman Phillips called for the question on the motion, Commissioners Gates and Phillips voting aye,
Commissioner Johnson abstained,
ZS-00007 Vail Valley Learning Camp
Kathy Eastley, Planner, presented file number ZS-00007, Vail Valley Learning Camp, She stated this
request is for a summer-time only resident camp for children with learning disabilities, The resource zoning of this
6 acre parcel allows for day or resident camps, as well as educational facilities, to be permitted through the special
use reVIew,
Ann Cathcart, applicant, started the Vail Valley Learning Camp last summer with 22 children being tutored
in a day-camp environment. Ms, Cathcart is requesting use of this site, just north of Bond, for an annual summer
period of 90 days, with a maximum of 35 children being housed and taught on-site during a three-week session,
The applicant has proposed three sessions, each lasting approximately three weeks, The camp will include a bath
house, 4 yurts to be constructed on wooden platforms, an infirmary, a one-room school house, and the existing
single family log cabin which will be utilized as Ms, Cathcart's residence, The infirmary and the school house will
be located in existing accessory structures on the site, Food service will be catered to the site, a contract is currently
pending for a provider,
Ms, Eastley stated there is an existing well and septic on site, A septic permit will be issued upon approval.
A State Highway Access Permit is currently being processed and may necessitate relocation and substantial
improvements to the existing shared driveway, The shared access driveway is on adjacent property and currently
serves one dwelling unit. Alignment with Copper Spur Road on the east side of Highway 131 is proposed,

Hastings stated these youngsters have a need and they are delighted to have them, Mr. Hastings stated the neighbor
across the river, about a quarter of a mile away, should not feel a conflict and thinks this will be a great attribute,
The community gave its full support last night,
Chairman Phillips asked how many were in attendance at the meeting,
Mr, Hastings stated there were about 13 people present with the Board being present in full.
Chairman Phillips asked if they will hear from those who were not in attendance,
Mr, Hastings stated ifhe had that wisdom he'd be in great shape, He stated the meeting is open to the
public, There was a diverse group present and gave a unanimous decision,
Chairman Phillips asked if an agenda had been posted,
Mr. Hastings stated nobody appeared to object,
Ms, Cathcart asked to submit letters for the record that she has received in support of this application,
Commissioner Gates moved to include the letters into the record,
Commissioner Johnson seconded the motion, The vote was declared unanimous,
The Board reviewed the letters they had received,
John Comer, a resident directly across from the site, stated it is less than 250 feet from his property, Mr.
Comer stated he didn't know of any meeting, Mr, Comer asked if they have a letter from Mr, Tom Pettie, Mr,
Comer stated his children weren't invited to the meeting either. He stated he has been a resident of Eagle County
for 28 years and lives permanently at the Water Wheel Ranch, He stated there are six reasons to deny this permit:
1, Safety - numerous attractive nuisances - the river - the railroad which curves right around the comer of
the property at the southeast comer. Mr. Comer stated it is about 100 feet from where the children will be, He
stated he understands them to be putting in a wooden pole barbed wire fence, He referred to an article in Littleton
and a judgement awarded to a "chi1drens camp", Mr. Comer spoke to the three foot culvert and that it will be filled
with water during runoff, He spoke to the tresses and the access road which runs under it. He stated to get to the
property you must go through Mr. Abbott's land on a shared access road, The Water Wheel is directly across the
river from them, He stated the folks at Anderson ranch know there are dangers as they experienced them when a
raft capsized, He spoke of Pete Allen, George Fromming, Marvin Mitchel, and others who have experienced
emergency situations. He spoke ofthe bond fire, ambulance being 35 miles away, etc,
2, Noise - Mr. Comer stated several months ago the new owner rented to someone with dogs and he can
hear them across the river, He stated this will go on from 7:30 in the morning to 9:30 in the evening, Mr, Comer
stated he is disappointed with the planning commission, He asked the Board to consider how they would feel if
there were 45 people camped across the street. He referred to inverse condemnation.
3, Wildlife - he referred to the findings from the DOW, He stated that the deer are as prolific in the summer
as in the winter because they come down for watering, He stated this will adversely effect the wildlife and he
would hate to see his deer go away, He referred to a case with O'Dell, a 1996 Colorado case.
4, Water - Mr, comer stated after the last meeting he went to Denver to seek out someone who would
educate him about the water concerns, He stated he talked with an environmental health officer with the State
whose expertise is water. He stated he explained his scenario, The employee stated he is concerned about the
bottled water. He suggested a sign would not provide the notification, He asked what would keep them from
drinking the non-potable water. Mr. Comer stated he explained the findings of the planning commission and
because this is agricultural it should be compatible. He asked about well water and suggested it needs to be tested
and treated and approved, He asked about the emergency management. He referred to the flood plane
requirements, Mr. Comer stated there is flood plane on both his and this property,
5, Credibility - Mr. Comer introduced the brochure that is being sent out to parties within the United States,
He referred to the various disorders the children might have that attend this camp, He read from the brochure. Mr.
Comer suggested the name alone makes one think it is in the Vail Valley, Mr, Comer suggested it should read that
it is 43 miles from the Vail Hospital. He suggested they should have said this will be right by the Colorado River
which gets high, That the railroad is 100 feet away, He suggested it should have said the fire truck and ambulance
is 35 miles away, Mr. Comer suggested they have moved away from their commitment to having an EMT on site,
Charleen Kirby has agreed to provide services, but she works a full time job, He referred to Tom Petties letter. He
spoke to Mr. Abbott's house which is about a block away, He stated he won't hear the noise, He stated when the
water wheel is turning it is a site to behold, He stated it can be dangerous, an attractive nuisance to kids. Mr.
Comer stated Mr. Abbott suggested the water wheel hasn't run in the last four years, Mr. Comer stated the water
wheel turns every summer with regularity, He stated Mr. Abbott has a proprietary interest in this venture,

She stated she doesn't want this area to change but she wants her children to be able to grow here. She stated so
often she has to go out of the valley for services as these, That is sad,
Joe Abbott, the adjacent property owner, stated he has given them a written agreement to the camp and to
Bill Altmann, the owner of the property, for access to their facilities, Mr. Abbott stated in his letter he has asked
they post a sign at either end ofthe road, for protection of his children, that says "drive carefully, children at play",
It is a single lane dirt road, Mr. Abbott stated they have gone together with them on the highway access permit. He
stated right now the road is unacceptable but it will be prepared so that it is safe for everybody, He stated he is
donating dirt and gravel to work on the road, He said he thinks the camp is a good thing for the children. He has a
son and daughter who live there as well, He stated the kids that will be coming in deserve the right to enjoy the
property, He said he has made offers to the camp to join them for supervised visits on their property, He stated if
the kids are having fun, he doesn't care, That's what it is all about. He suggested he and his family will learn from
them and vice versa, He suggested the culvert mentioned by Mr. Comer is not on the camp's property but on his,
He explained once they start irrigating the water goes down, He stated the river is a hazard but you teach children
to stay away, They have rules about what you can and cannot do, Mr. Abbott referred to Anne's rule about going
to the river. She'll send them home, He said he understands the danger of the river but it shouldn't stop this from
happening, They have lots of wildlife on the property, The deer hang out in the meadow, This area is mostly
brush, The deer are either on his property or Mr, Comer's, Mr. Abbott stated there are no structures in the flood
plane and the buildings she intends on using are well above flood plane, He stated he is a volunteer firefighter in
Yampa and they are only about 20 miles away. They are looking to work with Eagle County to provide emergency
services, Mr. Abbott stated noise is an issue, It is three months out of the summer with a giant river that runs
between the two, He stated the noise of children being happy is not an upsetting thing and something he is willing
to put up with, He stated the water wheel doesn't run full time, but perhaps enough for T,V, He suggested to play
on the water wheel, you have to swim the river first. He explained the water wheel and the sound barrier the river
should provide, If he doesn't want to see kids having fun, he should look the other way, As to Ann Cathcart's
credibility, it should not be questioned, She has done everything she has been asked to do and has done so to the
County's satisfaction. He feels very much in support of this.
Dugan Comer stated he feels what Ms, Cathcart is doing is a good thing because of the location, Mr, Comer
stated fencing won't keep people away from the railroad, He stated the roadway is a forty mile an hour zone with
the camp being at the bottom of two hills, Mr. Comer stated he is a parent of eight and six year old boys, Mr.
Comer spoke to his son who they believe is hyper active, He stated he is not entirely knowledgeable about learning
disabled children, He stated on occasion, a child will not listen to those in authority, Mr, Comer stated he would
not want his children at this location for a summer camp. He sees there being negative impacts to the environment
to the property with 45 some people being there for the summer, He feels this is the wrong location for the camp
though he supports what Ann is trying to do, He does not believe they can keep the kids on the property and out of
harms way,
Dudley Comer, a resident of Water Wheel Ranch, stated he has spent time as a camp counselor and has
found that supervision is not 100%, The railroad, highway and river are concerns to him, He wishes they could
find a better location,
Ann Cathcart stated the fence will be a mesh fence which the children should not be able to crawl through,
Commissioner Johnson suggested he does have a problem with the name Vail Valley, not because of this
file but because it didn't exist previously, He thanked Mr, Hastings for being here on his 75 birthday to celebrate
children, Commissioner Johnson stated he was a camp counselor and understands supervision is a concern, The
greatest danger to these children is that people don't understand them and are not willing to, He asked about flood
plain,
John Althoff, Engineering Department. stated there is no FIMA flood plain for this area, He stated they are
confident that the 100 foot flood plain is below the existing building on that lot, The bathhouse and the yurt
building will be above that segment.
Commissioner Gates stated he is very interested in kids and his grand kids, He stated he visits the schools in
his free time, etc, etc, He stated he was concerned about the safety and the impact on the additional land owners.
He questions who is impacting who, He doesn't believe the impacts have been fully mitigated,
Commissioner Johnson stated if they were to mitigate all the impacts to property owners, they wouldn't be
approving anything,

Mr, Roussos stated initially,
Chairman Phillips asked if there are other partners to help with this study, She thought the Town of Avon,
Town of Vail, V.A., have been willing to contribute,
Mr, Roussos stated during the first process, people did sign on, He explained some of those conversations.
Chairman Phillips suggested they haven't sought out other options.
Mr, Roussos stated the question that needs to be answered is should we acquire the Tennessee Pass Line for
the County's needs, Ifthat answer is yes, obviously they need to get information on which to make a bid and
explore other public and private partnerships,
Chairman Phillips suggested that could be four years, She asked what would happen if they determine not
to commit the monies, She asked if Eagle County will loose the possibilities?
Mr, Roussos stated if they do not proceed, any bids will be evaluated and a decision made, He explained the
likely scenarios, Vail Associates has expressed an interest as did Eagle County and a couple of railroads,
Commissioner Johnson asked ifthey don't spend the money, whatever that amount, what will happen,
After June 20th they can still make a determination if there are no private sectors chosen, and make a bid
accordingly,
Mr, Roussos stated the options vary depending on the point in time you're at. As time goes by they will
have different options,
Jim Hartmann, County Administrator, asked on the June 20th issue if they are seeking active railroad
operators. He asked ifthey submit a bid would they have to show some sort of ability to operate a railroad?
Mr. Roussos responded that failure to supply some information may deem it disqualified, He stated the
answer is they are not automatically disqualified,
Mr. Hartmann asked if during this round they are looking for people who are actively operating railroads?
Chairman Phillips suggested they are also concerned about them pulling up the rails, Eagle County still has
that option, She stated by reactivating this contract they can compete head to head with the private sector.
Chairman Phillips suggested the Governor seems very interested in the 170 corridor, She sees the fast track
rail becoming a reality, She questioned if they opt out here, are there businesses that will move ahead.
Mr. Roussos suggested there are about four potential bidders on this option, He explained the various
companies currently showing interest.
Chairman Phillips asked Jim Shrum and Mike Gruber if this has been discussed at the transportation
authority?
Mr. Gruber stated it has been discussed but not with a sense of urgency at his point. He suggested the
County thought they were moving ahead and they thought the County was moving ahead. Rail has always been
part of their discussion, He stated he will bring it up on the 15th when they will discuss it in depth, One thing he
would like clarified, is where they, the Board, would like the Transportation Authority to be on rail and trail.
Commissioner Johnson stated when it comes to spending the County's money as opposed to the
Transportation Authority, they want to be the decision makers, From where he sits, he doesn't think they can make
this purchase so, they must rely on partnerships throughout. He stated there will still need to be decisions made by
the County, He suggested they are at the eleventh hour trying to make these decisions,
Commissioner Gates explained he thought they would loose out on some opportunities if they hold back.
Maybe they are closing doors and maybe they aren't. He stated he looks to them for suggestions,
Commissioner Gates moved at this point in time the RL Banks contract not be renewed.
The motion died for the lack of a second,
The Board concurred to sit tight until after the meeting on June 20, 1997,
There being no further business to be brought before the Board the meeting was adjourned until May 13,
1997,
