Fisher Chairman Commissioner Commissioner County Administrator Clerk to the Board This being a scheduled Public Hearing the following items were presented to the Board of County Commissioners for their consideration: The Board convened as the Local Liquor Licensing Authority, Zino Ristorante, Inc. Earlene Roach, Liquor Inspector, presented a new application for a hotel and restaurant license with extended hours for Zino Ristorante, Inc. Also included in this file is a managers registration for Robert Jastrab. She stated the premises is not yet complete but close, The application is in order. In your packets you will find the Sheriffs report for the proposed manager, Robert Jastrab, You will note there is a current violation, a large time span and then three additional violations, Staffhas spoken with Mr. Jastrab who is currently in alcohol awareness classes, Staff believes the manager has taken care of this matter, All other applicants were reported to be of good moral character. The outside patio and lawn area will be fenced with a self closing gate that will be monitored by employees, All fees have been paid, Staff recommended approval. Mrs, Roach suggested they establish the neighborhood as a two mile radius surrounding the establishment. Mr, Jastrab stated he is embarrassed about some of the things he's done. Alcohol has not been an easy thing to overcome in the past. He explained his training in New York, his staff and TIPS training at Sweet Basil. He stated he is in counseling now with Colorado West and he has not had a cocktail since May 21, 1996. He stated as far as Mr. Clair entrusting him to run the restaurant it is a great honor. He has quite smoking, He spoke to the employee manual which incorporates good training in alcohol awareness, Peter Rudie, stated he is an Attorney representing Zino' s, and Kevin Claire, the owner of Sweet Basil in Vail. Mr. Rudie spoke to the credentials ofMr. Claire and his restaurants, Commissioner Gates stated he doesn't mention it to throw road blocks in the way, He spoke to his smoking and the fight of the battle, He wished Mr. Jastrab good luck. Commissioner Johnson moved to establish the neighborhood as a two mile radius from the establishment. Commission Gates seconded the motion, The vote was declared unanimous, Chairman Phillips spoke to the petition submitted, Commissioner Johnson asked how may restaurants are within the neighborhood, Ms, Roach responded Fiestas, Gashouse, Champions, Markos, etc, Commissioner Johnson pointed out they are all different. He asked how long Mr, Jastrab had lived in Colorado. Mr, Jastrab stated he was the assistant manager at Saddleridge, He was a waiter at Sweet Basil, became Assistant Manger and is currently General Manger. Commissioner Gates spoke to the supply and demand and the uniqueness. Chairman Phillips asked what the restaurant will be, Mr, Claire stated it is an Italian Restaurant with western Italian cuisine. Staff recommended approval. Commissioner Johnson moved to approve the renewal of a tavern license for Jet Center Cafe, Inc, Commissioner Gates seconded the motion, The vote was declared unanimous, Commissioner Gates moved to adjourn as the Local Liquor Licensing Authority and reconvene as the Board of County Commissioners. Commissioner Johnson seconded the motion, The vote was declared unanimous. Plat & Resolution Signing Tambi Katieb, Planner, presented the following plats and resolutions to be signed by the Board: 5MB-00058 Arrowhead at Vail. Filing 16. A Resubdivision of Lot 8.. He stated this was a Minor Type B subdivision, a resubdivision oflot 8 to create lots 8A and 8B, and 8C as a Common Parcel. This plat does contain a duplex split caveat, which states only one two-family residence may be built on the combined area of these lots, Commissioner Johnson moved to approve file number 5MB-00058, Arrowhead at Vail, Filing 16, a resubdivision of Lot 8, Commissioner Gates seconded the motion, The vote was declared unanimous, Resolution 97-40, file number PDS-00001, Diemoz River Ranch. He stated this was a resolution for the approval of a Planned Unit Development Sketch Plan which would allow for the development as follows: four single family lots with attached accessory dwelling units and 38 acres of open space, Commissioner Gates asked for clarification on the use on the lots Mr. Katieb explained the use of the lots. Commissioner Johnson moved to approve Resolution 97-40, Diemoz River Ranch, file number PDS-OOOOl. Commissioner Gates seconded the motion. Commissioner Phillips and Gates voting aye and Commissioner Johnson voting no. Resolution 97-41, A Day for Children Kathleen Forinash, Health & Human Services, presented Resolution 97-41, proclaiming April 22, 1997 as a Day for Children, She explained the resolution to the Board, Chairman Phillips read the resolution into the record. Commissioner Johnson asked the date be corrected, Commissioner Gates to approve Resolution 97-41, proclaiming April 22, 1997 as a Day for Children, Commissioner Johnson seconded the motion, The vote was declared unanimous, Resolution 97-42 - Supplementary Budget, Item 10-03 Allen Sartin, Finance Director, presented item 10-03 of the supplementary budget, which was tabled from 4- 14-97, He explained the item to the Board, Mr, Sartin explained this item was tabled last week. This is an increase in the amount of$598,577,OO. Mr. Fritze stated this item was published and continued from the date set. There was a resolution approved on the 14th that included all items but this, The proposed resolution today is just in regard to 10,03, Commissioner Gates stated there has been a lot of discussion about the cost. County Administrator, gave the original to Mr, Loeffler, Mr. Loeffler referred to Dr, Freedman's letter, a letter from the Mogers, third is a complaint from Zaner, a second letter dated March 14 by the Mogers and suggested they formally be received along with the photographs, Mr. Merry stated the animal control office also has photographs and video tape for the record. Ms, Zaner stated she also has some signed affidavits of complaint. Commissioner Gates stated they have had troubles bringing this to closure, He asked if it can come to closure in an efficient manner. Ms. Kleinschmidt stated she has just recently been retained. She is reiterating that Mr. Ammer is attempting to clean up the lot. She stated he is also inclined to reduce the number of animals but it is currently in a different court, He wants this cleaned up but there are a myriad of reasons it has not transpired. They are certainly trying to sell the property. She stated they have not been privy to the evidence submitted today, They want it cleaned up and will do whatever is necessary to do so, Tom Moger, 0047 Polar Star Court, stated Mr. Ammer has promised they would clean it up for the last four years, They have done nothing, The fact that the animals are not his, he doesn't understand, because it is his wife, There is no place for the horses to run.
