HomeMy WebLinkAboutMinutes 04/15/97 BOARD OF COUNTY COMMISSIONERS EAGLE, COLORADO RECORD OF PROCEEDINGS FORM 50 HOECKEL'S 387869 PUBLIC HEARING APRIL 15, 1997 Present: Johnnette Phillips James Johnson, Jr. George "Bud" Gates James Hartmann Sara J, Fisher Chairman Commissioner Commissioner County Administrator Clerk to the Board This being a scheduled public hearing the following items were presented to the Board of County Commissioners for their consideration: ZS-00007, Vail Valley Learning Camp Kathy Eastley, Planner, presented file number ZS-00007, Vail Valley Learning Camp, She stated this was a request to allow for a summertime resident camp for children with learning difficulties, Ms, Eastley stated the current zoning is resource which allows for the special use permit of the educational day camp, Today's hearing is a conclusion of the discussions. Ms. Eastley stated Ann Cathcart is the head of the Learning Camp, At this site, they want to allow for a summer resident camp for 90 days, They will house 35 children on the site for approximately three weeks, The applicant is proposing three sessions, Ms, Eastley explained the camp site and the conversion of existing buildings. Food service is to be catered on site and a contract is pending, The location does necessitate an access permit. They are proposing to realign the road, There is an existing well permit and the bath house will be constructed. Environmental Health has worked with the applicant. The parcel does comply with the Eagle County Mater Plan and Land Use Regulations, Staff recommended approval with the following conditions: 1) This special use permits this educational camp to operate as a summertime use. The site is permitted a maximum of four temporary units, one single family cabin and accessory structures, all as general delineated on the submitted site plan, 2) This Special Use Permit may commence upon issuance ofthe State Highway Access Permit and construction of any improvements required for issuance of the permit. 3) The applicant must provide sufficient fencing along the railroad right-of-way, 4) The applicant must obtain a Private Road Crossing Agreement with Union Pacific prior to commencement of activity on this site, 5) The applicant must submit an annual report to the Department of Community Development no later than September 30th of each year that the camp is in operation, This report shall include, but not be limited to, student, counselor occupancy, occurrence of accidents, notification of complaints received and the resolution of notification of complaints received, number of vehicle trips and method of access to the site, septic system pump- out reports, and general activities which have occurred on the site, 6) This special use permit will expire on the fifth anniversary of approval granted by the Board of County Commissioners. John Comer, a resident of northern Eagle County, stated he thinks there is a jurisdiction concern, He has given the city attorney an affidavit. He provided copies to the Board. Since 1991, he and his family have owned the Water Wheel Ranch which is directly across the river from the site, He presented tax notices to the Board, Mr, Comer stated as the affidavit indicates and his son confirmed, he and his brother and sister did not receive notice of this hearing, He learned of it after the planning commission meeting, Adjacent to the site, there is a small parcel ofland owned by Mr, Kimerling, He spoke ofthe Shooey property, Mr. Comer bought that from them last year. His notice was addressed to him, pertaining to the Shooey property, He showed the Board a copy of the deed, He acknowledged receipt of notice, He stated his three children did not receive notice, They want to receive notice and they want to respond, Dugon Comer did respond by way of letter but stated he did not received formal notice, He quoted to the Commissioners a recent Colorado case regarding absence of notice. They will spot haul loads as needed, That will take them approximately 10 to 12 working days. Six to eight trucks will be tarped and hauled as best they can during non peak times, The dry haul means they are hauling the aggregates dry, They can be flexible and will work with the communities involved. He stated they have all of the permits required, They have done major projects up in Hot Sulphur Springs and have done a project on the other side of Vail pass, These are state of the art asphalt plants. Chris Jouflas stated this is a very temporary project but necessary in nature, He stated he has dealt with Corn Construction before and believes them to be an upstanding group that will do the best job they can, Ms, Eastley stated there are a few master plan non-conformities, On page two of the staff s report she explained the outlines, She explained the temporary nature of this activity mitigates some of staffs concerns, Another non conformity has to do with the visual quality, Again the temporary nature mitigates that concern, The Wolcott community plan specifically discusses the resource extraction and does not allow for this type of use, The temporary nature of this activity and the draft reclamation agreement assure the return of the land to its present condition has allowed staff to recommend approval with the following conditions: 1) This Special Use Permit will commence upon issuance of the State Highway Access Permit, and completion of any required improvements, Substantial conformance must occur with the schedule of operation as defined in the table on page one ofthis document. Expiration ofthe Special Use Permit will occur at midnight (Mountain Standard Time) on October 31, 1997, 2) Reclamation of the site must be collateralized through a Bond held by the County. A general cost of reclamation for the site has been determined to be $2,500 per acre, No activity related to this permit may commence until collateral has been provided to the County Attorney's Office, Reclamation must commence prior to expiration of this permit. 3) The applicant must provide either a copy of a contract for purchase of water or copy of a valid industrial well permit for water to be used for dust abatement purposes, The Planning Commission recommended approval with a vote of four to one, They accepted staff s conditions and added three, Tarping, hours of operation and notification to the Town of Eagle the applicant has agreed to mitigate, Notice was sent to the Town of Eagle and they responded requesting the aggregate extraction be closer to where the asphalt work will take place. Ms. Eastley stated there were representatives from Bellyache present who felt this temporary use may become permanent, Ms, Eastley stated the temporary use is part of staff s recommendations with the end being on or before October 31, They County will hold collateral. Mr. Kirkland stated Mr, Jouflas applied for a temporary easement which is in the works, The Bureau asked them to do the same thing, They have spoken with the Bureau and have submitted the application to Phil Scott, Commissioner Johnson asked about the recommended condition by the Planning Commission, He stated that with Carol Ann they could determine that loads not be covered, He questioned if the applicant is volunteering to cover the loads, Bob Loeffler, Asst, County Attorney, stated the applicants offered and it then became part of the special use permit. Mr, Kirkland stated they will cover the loads, Ms, Eastley stated there is a compliance issue because they will not know for sure which trucks coming out ofthe Nottingham pit are there, Commissioner Johnson suggested it will not be the covered ones, Mr. Loeffler suggested they enter into a reclamation agreement that is collateralized, Commissioner Johnson asked if the reclamation must commence before the issuance of the permit. If the lots that are merged are legal but less than the minimum lot size, they need direction to incorporate language into this plan, Another issue is record keeping and how do they at a staff level keep track of the mergers, Perhaps a deed would be recorded so there would be some type of record, Mr. Montag stated another point of discussion is the fact that if there are two different zone districts that could end up on one lot. They question how to deal with that. He stated typically they would apply the mot restrictive zone district. He stated there is also a concern about Fulford. He said Fulford is not a subdivision that was approved by the BoCC though they have accepted the subdivision. In Fulford, you have to combine two lots to meet the minimum requirements, They may want to exempt them out of these regulations, He stated they intend to deal with these issues before the final amendment. This is separate from the redraft of the regulations that are currently taking place, He stated he would have to see this issue held up as they deal with the full land use regulation redraft, Commissioner Johnson suggested this is only a restatement and clarification of current County policy, Mr, Loeffler stated the regulation is an expression of a long standing practice, Mr, Loeffler stated as it is drafted now, it does appear it would apply to Fulford, but he is not sure that it ought to, That can be left to the drafting of a formal amendment. They could extend the temporary regulation with the exception of Fulford, Commissioner Johnson suggested they don't need to change the temporary regulation because they are not doing anything new here, Mr, Loeffler agreed, Mr. Montag suggested they extend the temporary regulations for up to six months, keeping in mind they have adopted the temporary regs through resolution, If the Board so chooses, that will allow them time to massage the language and answer the questions they have identified, He thinks that would be in the best interest of all. Art Abplenalp, Attorney, stated he is here in full support of the extension, He asked about a letter he had faxed to the Board today, He agreed this is existing law, The County is trying to communicate to the public that contiguous lots are one ownership, If it is not in the regulations, they don't believe it. This is intended to cure that. It is important this be finalized within the next six months and he suggests it be treated independently, Mr, Abplenalp suggested they avoid the appearance that the County is forcing mergers, He suggested the "merger of' be taken out of the title and he suggested a change to paragraph one, He referred to Fulford and the filing in 1972. He suggested there may be other town sites that may be exempted as well. These are the pre SB35 town sites. He stated he supports the Counties efforts, Commissioner Johnson thanked Mr, Abplenalp for his presence and suggested the paragraph one change he recommended is good, . Mr. Loeffler stated he agrees it is a nicer expression, Commissioner Johnson asked if they chose to adopt these for three months can they be extended for another three months, Mr. Montag responded they may extend it for a period not to exceed six months, Mr. Montag suggested they would have the ability to extend it again, Commissioner Johnson suggested he could place it in the motion. Mr. Loeffler stated he cannot be sure that will provide the with adequate time, He does believe they can make the extension and then re-extend, Now is the time to make the determination. Commissioner Johnson moved to approve file number LUR-23, a temporary regulation dealing with contiguous parcels, The title shall omit "merger of'. Substituting the language "and two or more contiguous parcels of land under one ownership constitute a singe parcel and cannot be divided into separate ownerships or separated out into a new lot, parcel or subdivision without the prior approval of Eagle County as prescribed in these regulations" for a period of up to six months with staff bringing it back to the Board in the next two months.
