This being a scheduled Public Hearing the following items were presented to the Board of County
Commissioners for their consideration:
Consent Calendar
Chairman Phillips stated the first item on the agenda was the consent calendar, as follows:
A) Approval of bill paying for week of April 14, 1997, subject to review by County Administrator
B) Eagle County Veterans Service Officers monthly report for March 1997
C) Resolution 97-34, authorizing the assistance of and agreeing to the Colorado Aeronautical Board
1997 Airport Statewide Pavement Maintenance Program
D) Agreement between the Eagle County E911 and the Colorado State Patrol for a communications
officer
E) Resolution 97-35, declaring the week of April 13 - 19, 1997 as National County Government
Week
F) Agreement between Eagle County and Xerox Corporation for maintenance on a fax machine to be
purchased for the Eagle County Treasurer's Office,
Commissioner Johnson asked about budgeting of item C,
Lisa Huffman, Eagle County Airport, responded this item has been budgeted, She explained the item and
the budget for the Board.
Commissioner Johnson moved to approve the consent calendar as presented,
Chairman Phillips seconded the motion, Of the two voting Commissioners the vote was declared
unanimous, Commissioner Gates was not present at this hearing,
Resolution 97-36, Supplementary Budget
Allen Sartin, Finance Director, presented Resolution 97-36, adopting a supplementary budget and
appropriation of unanticipated revenues for fiscal year 1997 and authorizing the transfer of budgeted and
appropriated monies between various spending agencies,
Allen Sartin stated the Board has received the request for supplemental appropriations, He stated there are
sufficient funds for all the requests, He stated it includes four new positions,
Commissioner Johnson asked about the fax machine that was approved for Treasurer,
Mr. Sartin explained stating it is an inter-fund by funds,
Commissioner Johnson moved to approve the supplemental budget, all items except for item 10,03 in
Buildings and Grounds in the amount $598,577,00 as found in exhibit B.
Chairman Phillips asked why he would not approve the request from Buildings and Grounds.
Commissioner Johnson explained he did not approve it initially and won't approve it now,
Chairman Phillips asked if that item can come back to the Board at a later date,
Jim Fritze, County Attorney, responded it would have to be re-advertised.
The motion died for lack of a second,
Chairman Phillips moved to approve the supplementary budget as presented,
Commissioner Johnson seconded the motion for discussion.

Mr. Black stated there are two separate abatements for 1994 and 1995, He explained the appraisal process
that took place, He related a protest was filed against the parcels. His office logged two out of the seven parcels
and responded to an employee ofthe company, Mr, Black stated this person signed the back of the protest form and
signed as an agent for the company,
Rich Olona, representing the applicant, asked if there were copies,
Mr. Black answered yes they had them, He stated Ken Marchetti was the employee and they discussed the
valuation issues,
Commissioner Johnson asked if it was Ken Mischlo,
Mr. Black stated it was Ken Marchetti. He stated they responded to the protest as required, thus he does not
see the validity in this abatement.
Commissioner Johnson asked to see the original signed by Ken Marchetti,
Mr. Black stated they were mailed to and received from Country Club of the Rockies. They assumed they
were dealing with an employee,
Chairman Phillips asked what was signed,
Mr. Black explained it is the backside of the appraisal form, When Mr, Marchetti came in, they logged it as
a protest.
Rich Olona stated the issue they are discussing has precluded the 1995 abatement. They challenge the
Assessors Office decision because the agent that came in was not an agent for the Country Club of the Rockies, He
stated Mr. Marchetti, who is present today, came in to discuss the issues of valuation, He was told he would have to
sign the statements that were presented, He was not directed by Country Club of the Rockies, he did it on his own,
He stated Mr. Lewis really didn't have time to go through it all. They do not feel that this constituted an appeal.
Mary Jo Berenato, Deputy County Attorney, asked about the response letter that was sent to Mr. Marchetti.
She suggested the Board might like a copy of that.
Mr, Black stated they don't have a copy of the letter but they do have a log that shows when one went out.
Mr. Olona stated a copy was mailed back to Country Club of the Rockies and not to Mr. Marchetti,
Mr. Black stated they were mailed June 20, 1995, He explained there is an issue on item F, schedule
number 20829, They have been denied access on two separate occasions to see the property,
Commissioner Johnson suggested they finish this discussion first.
George Lewis, representing the Assessor's Office, stated on the day Mr, Marchetti came in, his first question
was how does Country Club of the Rockies compare to other clubhouses and golf courses in the County. He stated
they looked at Berry Creek and Beaver Creek. They looked at other comparisons, He recalls Mr. Marchetti stating
he thought Country Club of the Rockies was a little high compared to the other club houses,
Mr. Olona asked when a party comes in to compare a protest if they require a letter of agency,
Mr, Lewis stated they may require it but they will also take a persons word for it,
Mr, Olona asked if they know if there was a letter of agency.
Mr, Lewis stated he does not believe there was,
Ken Marchetti was next to testify,
Mr, Olona asked about his employment.
Mr. Marchetti stated he is an accountant with Robinson and Marchetti, He stated he does the accounting for
Country Club of the Rockies, He stated he works as an independent contractor although his technical relationship
may be assumed.
Mr. Olona asked ifMr, Marchetti was directed by Country Club of the Rockies to protest the valuation,
Mr. Marchetti explained that he came into the office and signed in, He met with Mr, Lewis and he recalls
the situation similarily to that of Mr. Lewis, He stated he came back in 1996, He recalls talking in general terms
about the golf course and they discussed some concerns about the remodel of the club,
Mr. Olona asked if Mr. Marchetti had documentation to support a lower value.
Mr. Marchetti stated no, His primary concern was with the club house. They talked more about the
property values,
Mr. Olona asked how the meeting ended,
Mr. Marchetti stated he recalls Mr. Lewis stating they would provide a formal response.
Mr, Olona asked if he received the response,
Mr. Marchetti stated he did not get the response directly but through Country Club of the Rockies,
Commissioner Johnson asked Mr, Marchetti to read the signed disclaimer signed by himself.

Mr, Lewis stated it was after the remodel. He did not write a letter.
Mr, Reedman spoke to the abatement petition form that was filed, He stated they have information with
them today to support why they think the abatement was incorrect. He stated corrections of the two factors of
concern were addressed, He stated the square footage was corrected as was the fact the restaurant does not fill the
club house. He explained there is a CAD map that shows the square footage. He stated no protest was filed in 1994
and the Board has the right to hear this,
Mrs, Berenato asked if that information is prepared for this hearing and if there is a reason he has not
submitted the information prior to the hearing,
Mr, Reedman stated an exchange of information must be made,
Ms, Berenato questioned why Mr, Reedman did not bring the documents to the attention to the Assessors
prior to this hearing date,
Mr. Reedman referred to article 11, Mr, Reedman stated he signed for a packet of info on Friday and its
hearing is today,
Commissioner Johnson moved to table schedule numbers 020827, 018626, 018128, 017834, 020833,
020829 and also the abatement hearings for 011885,029881,030413,030415 to the next abatement hearing,
Chairman Phillips asked if all of these are for 1994,
Commissioner Johnson stated the first seven are for 1994 and the others are for 1994 and 1995,
Chairman Phillips seconded the motion,
In discussion, Ms, Berenato stated there is usually an abatement hearing the first of second Monday of the
month. They should send in supporting documentation ahead of time.
Chairman Phillips called for the question on the motion, Of the two voting Commissioners the vote was
declared unanimous,
There being no further business to be brought before the Board the meeting was adjourned until April 15,
1997.
