Fisher Chairman Commissioner Commissioner County Administrator Clerk to the Board This being a scheduled Public Hearing the following items were presented to the Board of County Commissioners for their consideration: PDS-OOOl, Diemoz River Ranch Paul Clarkson, Senior Planner, presented file number PDS-OOO 1, Diemoz River Ranch. He reviewed the site visit and public input meeting from April 7, 1997. The site inspection and public input occurred last night in Basalt. He referred to the staff report and the recommended conditions. He stated the modified conditions for approval were also included in staff s report. Doug Pratt stated he would like to discuss the recommended conditions. He stated in terms of item #1, they have committed in sketch plan to do a floodplain study. They would like to retain driveway standards and have looked at clustering to maintain those. They are unclear on the Hooks Spur road requirements. They have talked about looking at sprinkler systems. The driveway configuration is what has been shown on their sketch plan but they are open to discussion. Regarding the 125 foot set back from the river, they would like to discuss a set back of 100 feet to ensure the vegetation is preserved. They don't want a homesite that will encroach on screening. In terms of lot #4 being moved to the south, he referred to the utility lines they are trying to avoid. The feasibility of common agricultural buildings, they would like to control within the two acre building sites themselves instead of creating a fifth building. He stated the PUD would commit to the design guidelines. Mr. Pratt further discussed their commitments to the project. He suggested having recommendations for the individual builder regarding septic systems. Mr. Pratt reminded the County of the dedication ofland by Oscar for $25.00. He would like to use that portion of the road that accesses his home. They request retention. The fishing access on the northern portion would exist. He spoke to the accessory dwelling units. He suggested an ADU might provide supplemental income if a family member wants to build on the site. It also provides affordable housing to renters. They are talking about limiting the ADU to 1000 square feet. They are asking for two and one half ADUs. Mr. Pratt stated they will respect the river and restrict runoff. LeRoy Duroux spoke to the lay ofthe land and it being towards the river. He stated there is no way they wish to jeopardize the river in any way. Chairman Phillips referred to the site visit. She asked about staff s findings and the statement the project is in general conformance with the various use plans. She asked why those areas were marked non-conforming. Mr. Clarkson responded on the top of page seven they state they would find the application in conformance assuming the conditions are met by the applicant. Commissioner Johnson suggested if people read the footnotes they would have a better understanding. He referred to the discussion of the night before. Mr. Duroux stated it is difficult to try to figure out where you aren't in conformance. Chairman Phillips suggested if it is in general conformance but marked as not it reflects on the project. Commissioner Gates referred to the recommendation requesting the lots be moved and asked if they do move the lots if it will be considered a major change. Commissioner Johnson moved to approve file number PDS-0001, Diemoz River Ranch incorporating staffs findings including Planning Commission recommendation on 1 and 2. JI 'SUOH'Bl!ill!l mln:l!llBd BOARD OF COUNTY COMMISSIONERS EAGLE, COLORADO RECORD OF PROCEEDINGS FORM 50 HOECKEL'S 387869 b) hook spur travel surface c) hydrant location, if any d) driveway configuration. 3) The applicant shall investigate the feasibility of a common agricultural building/use site within the open space and shall limit both the total site, coverage and number of structures within the individual building envelope. 4) The PUD Control Document shall be finalized which shall include but not be limited to building bulk restrictions, lighting, fencing, landscaping, use restrictions, etc. Animal, water, pasture and open space management guidelines and architectural treatments shall also be included within the Control Document or related draft Design guidelines or proposed covenants. 5) The applicant shall communicate with the Environmental Health Division concerning Preliminary Plan ISDS requirements. Septic systems shall be prepared by a Registered Engineer to meet all requirements and shall be specifically designed to protect ground water. 6) 4 accessory dwelling units shall be allowed and shall be a maximum of 1,000 square feet and shall be contiguous with the primary residence. 7) Development shall be performed in such a manner as to protect the river from construction debris, runoff, etc. Commissioner Johnson seconded the motion. In discussion, Mr. Fritze asked if the motion contemplated a written resolution and findings and order which will be the final action of the Board. Commissioner Gates answered yes. Commissioner Johnson concurred. Chairman Phillips called for the question on the motion. Commissioners Phillips and Gates voting aye and Commissioner Johnson voting no. Mr. Pratt asked about submitting the preliminary plan and the final plat at the same time. Mr. Clarkson discussed the concerns in doing so. He stated the level of review is very difficult. Mr. Pratt asked if it feasible to do so. Commissioner Johnson explained the troubles with the doing so. Mrs. Duroux explained it would eliminate a lot of traveling and meetings. She stated she would like clarification on what the planning department will do now. Commissioner Gates explained that they are here to provide customer service. He stated they are there to help.
