Steve Pittell, president of Nova Guides, stated they have been in the business for a number of years. He stated there is clientele that is looking for a larger, more upscale unit. He stated they have 87 acres up there. He doesn't believe they should be limited in what they can do as business people. Chairman Phillips stated most of the discussion is around the two bedroom units. She asked if 600 is adequate for a one bedroom cabin. Mr. Pittell stated its a good size for one bedroom, but most two bedrooms are larger. He reiterated they are working with 87 acres. Mr. Boni stated the only issues in front at this time are those in the March 5 letter. The rest are acceptable. Ms. Eastley stated attached to the backup was the original staff recommendation. The Planning Commission did recommend approval except for #5. They recommended the site be 15 dwelling units. She explained, She stated there were no size limitations placed on the units at the Planning Commission meeting. Mr. Pittell responded. He stated he would have no problem taking one of the one bedroom cabins and making that an employee housing unit. Mr. Boni stated there has been difficulty in counting the cabins. He understood them to approve the six they were requesting with one being a long term affordable housing unit. Commissioner Gates stated they are disagreeing on numbers. Ms. Eastley stated that is why they have the recommendations they have today. Ms. Eastley stated the 1,100 square feet were part of the plans submitted by Knight Planning. She referred to the plans. Mr. Pittell stated they included some options they plan on looking at, but they are not the cabins they intend on building. They would like to have the option to vary the size of the cabins. If they want one that is 1,400 so be it. These are not the floor plans they will definitely be using. Chairman Phillips reviewed the history of the file from her perspective. Mr. Pittell agreed with what she suggested. He stated it should not be the County Commissioner's job to tell them how many square feet are necessary. The limitation is on the amount of beds. It is not up to them to tell him as a businessman how to spend his money. Michael Caccioppo, an Edwards resident, referred to page 8, #1A. He asked why he would not be able to have dinner. Bob Loeffler, Asst. County Attorney, stated that is not a part of today's request and was subject to prior action. It is not part ofthe special use permit. He stated the purpose of the regulations is to implement the Eagle County Master Plan by providing specific direction and procedure for land development in unincorporated Eagle County. Allen Richman, Planning Services, gave background on the proposals. He stated these changes have been on-going for about four and a half years. He stated the draft has been with the County for five months. This was a draft structured to get reaction. The contract requires another draft. They are expecting to get final direction from staff in late April and they will submit a draft back to the County in late May. Hopefully for adoption purposes. The March 14 memo is an important one. It pulls together all of the major comments, though not every comment. They have a list of all the changes. The February 17 memo points out the differences with existing land use regs. Mr. Richman stated the document is different in its organization. It is more user friendly. They have put the tables and the illustrations in the document. The text has been reduced. Users can compare where uses are allowed throughout the County. A third thing that is important are the overlay zones that can be utilized. The maps are general and site specific information is still necessary. He stated they direct people to avoid the sensitive lands. They have functioned with direction to find a greater sense of balance. They have also included innovations with cluster development. They believe it is very sensible. His last comment is a major change to the review procedures. He suggested people look at the flow chart outlining the steps to be followed. He reviewed other comments they received. Keith Montag referred to the March 14 memo used for reference. The most important components of the changes were shown on a list. Mr. Montag stated the biggest issue discussed at that time was the wildlife issue. He stated the direction from the master plan indicated that wildlife was an important consideration. Consequently the draft regulations were set up and spoke to avoidance. That could create additional issues. So the direction given by the Commissioners and the Planning Commission was to reconsider the wildlife section and instead of using avoidance approach it was worth looking at a mitigation approach. Other issues may be the result of avoidence. Direction was to consider mitigation which will occur in the second draft. Another issue was the deer winter range and if that should be considered critical for wildlife. The direction again was instead of avoidence, to use mitigation approach. A second issue was how do these regulations, particularly the standards in article 4, apply to legal, non- conforming properties. The direction was that these regs should apply to 35 acre parcels and to those in non- compliance. Mr. Richman further explained saying they felt they needed to apply these regulations in hopes the PUD approach and others can be applied easily. He hopes its not viewed as a penalty. The third item of discussion was whether a mandatory sketch plan review should be required, The intent was to streamline the process. One approach was to eliminate sketch plan or allow the option. After much discussion, it was felt the sketch plan process was an important component of the process giving the developer a sense of where the County is coming from. They intend to include the sketch plan in the process. Mr. Richman stated the issues that have been addressed in sketch plan has been positive for both the applicants and the County but the submission contents must be more clear so the applicant does not have to spend tremendous amounts of money to produce the sketch plan. They'd like to see this as an opportunity for working together to make it more simple and less expensive to get into the process. That will make it less painful. Mr. Montag stated there were different options identified. The response from the developers was they wanted to hear from the BoCC directly as to their feelings on the project. Item #4 was raised in the process. They questioned church use as a special use permit or a special review process, or being a use by right. There are some potential impacts that would be appropriate to be reviewed. The direction was to maintain the church use as a special review. The potential of a special use being revoked is not the case. The use would go with the land and would not be up for an annual review. Iftime limits were to be imposed, that should be a condition. Mr. Richman stated the revocation issue was a concern. Once the building is constructed the special use is there for life as long as they are in compliance. If the conditions were not complied with, then it would run its course. Accessory dwelling units was another issue. There is a need for affordable or employee housing. They felt this was a mechanism to provide for affordable housing. Mr. Richman stated the use table on page 311 shows the zone districts. The standards follow on page 314. Commissioner Johnson stated the March 11 and 12 meetings were open. This meeting was an agenda item. They have not been closed sessions. He suggested she has been to enough meetings to know that the Board gives credence to public input. He asked how the task force was put together. Mr. Montag stated the task force was appointed by the commissioners after they advertised for applicants. He stated they tried to get a representation on the task force and specifically for those that use the regulations. There were two planning commission members. Mr. Montag stated the planning commission is a cross section. Mr. Richman stated the task force meetings are in no way meant to substitute for the Board based input. He stated the task force had to do the homework. It was not an effort to question policy. The question of policy is still to take public comment. Commissioner Johnson explained. He asked Ms. Gazunis if a road show would be an appropriate mechanism. Ms. Gazunis responded. She spoke to a situation that took place at the March 11 th meeting about having been limited in giving comment. She stated she is not asking for anything more than what Mr. Richman is planning on doing but rather than just staff reviewing the draft for the next 25 days, she believes a broad based input should be given at this point in time. Chairman Phillips stated they will listen to the rest of the comment. Michael Caccioppo, area resident, was the next to speak. He referred to Article 1 of the U.S. Constitution regarding prohibiting of the freedom of religion. He pointed out the Board doesn't have the power to amend the constitution. He referred to Article 5 and stated they don't have the power to require special reviews. Commissioner Johnson stated they are not regulating religion which they are not allowed to do. They are regulating a building, not a religion. Mr. Caccioppo referred to prohibiting the rights thereon. Chairman Phillips asked that they not debate each and every issue. Mr. Caccioppo asked for term limits. He believes by limiting their terms they will get more people involved. He stated they don't need more regulations. Mr. Caccioppo spoke to the riparian set backs and the public good. He reminded the Board of their responsibilities to the Constitution. Scott Hover, representing the Eagle Valley Homebuilders, stated he has read this document and has studied this thing. He stated that its not all bad but its not all good. It is lengthy and it is cumbersome. With regards to the task force, he has called them, at least three of them, and they don't feel as though their comments have been properly included in where they are today. This document is a moving target. He can't comment on a specific section, a map, etc., because changes are being made daily. They would like to be included in this process. They would like a revised copy that is complete to review. He would see it as an appropriate time for those who have put their time in thus far, to step back. They are asking for a break of 90 days to get together with the Board of Realtors, the housing task force, a large land owner, a small land owner, with David Carter. Let them have 90 days to get together then they can come back and have an intelligent conversation. Commissioner Johnson asked if the copy that is in front of them today would be sufficient. Mr. Hoover stated they would like all of the revisions to be made and then to get the interest groups involved. Chairman Phillips suggested that is what they intend to do. Commissioner Johnson stated his concern is that he doesn't know if they should go through the effort to put together another document. Mr. Hoover stated their comments have been filtered through. Dee Combs, area resident, stated she is here on behalf of the Vail Board of Realtors representing 450 Realtors in the community. She stated only today was it brought to their attention where they are. She questions why this has come into place and where were they. She stated it is not only themselves but the people buying and selling the properties. She stated they would like to create a citizens task force and give them at least 90 days to review the final document. She stated they can work with what has been revised so far. He said as being a part of the task force and having been and still is a representative of major landowners, he has looked at this document with their concerns in mind. He said they are not satisfied with it as it is in the current draft. He has looked at it in many different respects. He has had many questions and comments. He said as one member ofthe task force, he is not satisfied with it the way it is today. He, like Mr. Carlisle, would ask they reserve the right to comment on the next draft. Changes are in the process of being made. He said he doesn't understand the distribution of the first draft. Part of that may be why there is so much confusion. The second draft, once distributed, should be the time that all the walks of life will scrutinize the document. There are far more issues than the eleven major items. He suggests the county look at it in general terms as follows: 1) How does this comply with the master plan? He sees this as perhaps being a no growth document. The only side the county can control is the supply side. 2) Document is somewhat of a limiting factor in growth. He suggested if they don't take care of the supply side, they will move the development elsewhere by pushing it across county lines. There must be some balance. The master plan has done an outstanding job in identifying growth areas. 3) Documents effect on affordable housing will be significant. He said the last item is one of common sense. They need to make sure whether its from agricultural to residential to small and medium landowners. He said he looks forward to reviewing in detail the second draft. Cynthia Lepthien, area resident, stated she works for an engineering firm. She said personally she feels it would be unconstitutional to not regulate church buildings. She said she supports this document and the intent to have some sort of rational planning process. She spoke to section 5, administration and enforcement. She said the words plats and plans are used interchangeably and not necessarily in the appropriate context. She also questioned how a final plat can expire? The third question is on the finalization of the plats, she suggested that after five years they have the hearing and determine if it has expired. In another comment on minor plats on page 571, she said it isn't clear what the review process is. She asked for closer look. George Jouflas, a land owner in Eagle County, stated there is not much for him to say. He said he picked it up and almost got a hernia. He said he relies on the commissioners to make a decision. Gerry Arnold, a frequent and regular user of the land use regulations, stated most of her focus is on Article 5. She prepared a letter to address the technical revisions. Ms. Arnold asked the regulations reflect the purpose and the intent of the County Commissioners. She asked if they can let the words do the interpretation of the intent. Commissioner Gates stated they know this is not the final product and that there is more to do, He didn't realize there is so much more to do. He said he hates to spend county money on consultants and task forces, and perhaps they don't get the right people but they try. Commissioner Johnson stated he hates spending the money as well but you have to get the job done right. He explained when they started into this, they wanted was to streamline, make it easier to use, and have public input. He said they have failed in all areas. Streamlining can still be done, there are redundancies, some can be eliminated. He would like to see a smaller task force, representing some of those there today. He asked if Tom, Scott and Peter could present something back to the Board to try to get more public into the process. Like Commissioner Gates, he too would like to see more people here. Commissioner Gates asked that there be input from the rest of the Board in selecting a task force. Commissioner Johnson explained there were already some very large groups being represented. Peter Jamar clarified that they, as the task force, had nothing to do with the creation ofthe document being presented today. Chairman Phillips stated she thinks they will discuss an additional task force and that staff would like to have some time off. Staffhas been pushed about using the regulations and getting them done.
