This being a scheduled Public Hearing the following items were presented to the Board of County
Commissioners for their consideration:
Consent Calendar
Chairman Phillips stated the first item on the agenda was the consent calendar as follows:
A) Approval of bill paying for week of January 21, 1997, subject to review by County Administrator
B) 1997 Motor Pool purchase request for scheduled replacement of four door utility vehicle
C) 1997 Motor Pool request for purchase ofthree 1997 Ford Explorers for use in the Sheriffs
Department
D) Resolution 97-10 Authorizing the final release of collateral and termination of the warranty
period for Old Orchard Plaza II, City Market
E) Intergovernmental Agreement between Eagle County and Garfield County for the purchase of
administrative services in connection with the housing voucher assistance payments programs
F) Acceptance ofthe donation of seven buses from Vail Associates, Inc. To the Eagle County
Regional Transportation Authority,
G) Resolution, adopting rules and regulations for ground transportation at the Eagle County
Regional Airport
H) Modification 0007 to the air traffic control service contract at the Eagle County Regional Airport.
Commissioner Johnson asked if the value ofthe busses has been established.
Jim Schrum stated they have responded back to Vail Associates at an average of$10,000 per vehicle.
Chairman Phillips asked if these are those being used now.
Mr. Schrum explained,
Jim Fritze stated with regard to item G there is still an issue that staffhas to resolve, He asked it be tabled,
Commissioner Johnson asked about item E and whether this would be taken in house or if they would
continue as they have now.
David Carter, Housing Director, stated when signed it will commit them to a three year contract which does
have an out clause.
Commissioner Johnson suggested this item be pulled to next week so they might discuss it.
Mr. Carter noted that in the past this has been done from year to year.
Commissioner Johnson moved to approve the consent calendar as read by the chair pulling item E and
tabling item G for one week.
Chairman Phillips seconded the motion, Of the two voting commissioners he vote was declared unanimous.
Commissioner Gates was not present at this hearing.

Commissioner Johnson moved to establish the need for Peter Rose, dba/Fore Seasons Indoor Golf, using
the petitions submitted.
Chairman Phillips seconded the motion. Of the two voting Commissioners the vote was declared
unammous.
Commissioner Johnson moved to approve the application for a new tavern license with extended hours for
Peter & Elizabeth Rose, dba/Fore Seasons Indoor Golf contingent with the change being made of the refrigerator.
Chairman Phillips seconded the motion. Of the two voting Commissioners the vote was declared
unanImous.
Commissioner Johnson moved to adjourn as the Local Liquor Licensing Authority and reconvene as the
Board of County Commissioners.
Chairman seconded the motion. Of the two voting Commissioners the vote was declared unanimous.
Appeal, Merv Lapin
Sid Fox, Planning Manager, presented an appeal from Mervyn Lapin regarding Wolcott Village, He stated
the sketch plan approval was given in 1994. At the time the land use regulations provided for an expiration after
two years unless a preliminary plan was approved. A preliminary plan was not approved and therefore the sketch
plan approval expired and there is now no sketch plan approval in place. The preliminary plan was actually applied
for in a timely manner, It was tabled by the Planning Commission for lack of an access permit. The access permit
was received but the file was never heard by the Planning Commission. The regulations do not extend the time
period of the sketch plan if application is made, The preliminary plan must be approved. Mr. Lapin is appealing
the interpretation.
Merv Lapin, applicant, stated when it was in preliminary plan, they were never notified that there was a date
certain. They had gone through this, the PUD process, at staff s request. The County felt it was in the best interest
of the applicant and the County. The plan was non-controversial. He received a letter about three months ago that
stated the sketch plan would expire. One of the things they are trying to resolve with the preliminary plan is the
sewage and they are working with Upper Eagle. He believes this to be a situation where no one will be harmed
allowing the sketch plan to stand and will allow them the two years they need to come back with preliminary plan.
They can't get approval without solving the sewage problem,
Chairman Phillips stated the tabling of the preliminary plan seems to have been to a date certain without
their notice,
Commissioner Johnson asked what the scheduling would be otherwise. He asked if they should have
applied for an extension of the sketch plan even though it had been submitted as a preliminary plan.
Bob Loeffler, Asst. County Attorney, stated it should have been applied for. Understanding that our
regulations did not provide for the extension of the sketch plan until last September. Prior to that time, there was
not an expressed provision allowing for the extensions. Historically, the Board has granted them. Now there is an
explicit provision.
Discussion continued on the appeal.
Commissioner Johnson stated the Planning Commission should have tabled to a date certain within the
governing regulations, He asked what the appeal is based on.
Sid Fox referred to a letter from staff dated October 14.
Commissioner Johnson asked on what grounds is the applicant asking for the appeal.
Mr. Lapin stated he was never notified when it was submitted for preliminary plan, it was scheduled for a
date certain, In absence of that, the sketch plan time frame expired.
Mr. Loeffler stated for the record he has the notice of appeal of December 12.
Commissioner Johnson referred to the letter.
Commissioner Johnson moved to grant the appeal of Mr. Lapin regarding the Wolcott Village development.
Mr. Loeffler asked if this will extend the sketch plan and if so until when,
