She stated this was a request to consider final plat for 11 lots and open space for a 72 acre general purpose storage facility. The permitted uses for this development include outdoor storage of construction vehicles, construction equipment and construction materials as well as related products used by the lot owners/leaseholders. Based on a fee of $55.00 per acre, a total of $9,400.00 is to be paid by the developer as an impact fee. Commissioner Johnson stated in areas were there is a need for wildlife mitigation the fee is imposed. Ms. Eastley referred to the letter from the DOW. Ms. Eastley stated lot 4 is excluded from the impact fee which is approximately 21 acres. Ms. Eastley stated staff has recommended this matter be tabled until the wildlife mitigation plan is resolved. Terrill Knight, representing Chris and Connie Jouflas, stated the plat has been signed as have the SIA' s and road maintenance agreements. The remaining issue is the wildlife, or big game issue. Mr. Knight stated they are disappointed because the County has directed them to the DOW. Bill Andree is here today. Mr. Knight stated they did suggest initially to the County they find a site for waste and recycllng. Mr. Knight stated the $9,400 was not based on the 21 acre parcel. They looked at the wildlife on the site and reapplied the DOW numbers per acre. They have a letter that included the entire acreage. Chairman Gates asked about an option to take the fee or not. Mr. Knight stated they feel the fee asked for is inappropriate. Chris Jouflas, landowner, stated they have been landowners in Eagle County since 1918 and paid property tax Slnce then. His father, himself and his brother. They have owned the land since 1926. They owned the land that is now the dump. They did not know about the deal with up~er Eagle Valley Water and Sanitation. The critical winter range the wildllfe and other agencies feel is being taken away is far less than that taken for the dump. That area is much more critical than his. He has controlled access to his private ground but allowed people to hunt when they asked. He leased to sportsman groups but they never lasted. They spent alot of money maintaining the land which benefited them and the DOW. In his opinion, he has never asked for big game damages thou;Jh he was entitled. The deer have enjoyed full use of his property. He is lncensed with the idea that he must pay tribute to a group based ln Denver to maintain his property. Mr. Jouflas stated Eagle County is the only County in the State that allows the DOW to make policy for the planning commission. He does not think the land they are talking about is that critical to deer range. They are probably one of the last original land owners who have taken care of the animals. In the last twenty five years there are elk here again. If you take care of the land, everyone will benefit. Commissioner Johnson again questioned the $9,400.00 fee. Bill Andree stated they do a real fertilization to mitigate and improve wildlife habitat. Working with Vail Associates, they use the consumer price index which showed an increase to $61.79 per acre multiplied by 32.01 acres. Open space is not added in. The total of $1977.00 is the fee for every three years of mitigation. Discussion continued on mitigation of developable land. The costs are then concrete. Chairman Gates questioned the option of paying the fee or doing a mitigation plan. Mr. Knight responded this is a requirement Mr. Jouflas should have to meet and they think no. They do not agree with the wildlife sanction. They question if it is the right thing to do. Commissioner Johnson reminded at sketch plan the County required a mitigation plan. Ms. Eastley stated at the time they agreed. If there is some dispute about habitat, somethin;J has to be done. Corrmissioner Philllps asked what happens to the money? Mr. Andree responded they do a Memorandum Of Understanding each time they do this. Each one states where the money can be used. In each case, they have specified the monies cannot come out of Eagle County and preferably it will be used on the site specific. They specify where they want the money to be used. They place the money in a trust fund who holds the money and it is held by the MOU. Commissioner Phillips asked if this plan is in use in other counties. Mr. Andree res~onded Mesa is using the same figure in their planning but by using brush feedlng. They did the same here with the landfill. The DOW has spent great time and takes exception to Terrill's statement it is broad based. Mr. Andree stated the DOW followed the guidelines set out by the County. They have not had the chance to corrment on the mitigation plan. Chairman Gates stated some of the irrpacts are voluntary. He questioned what is voluntary and what isn't. Mr. Andree stated they do not touch the principal. That is why the money goes into trust so the work can be done every year. Mr. Knight responded a great deal of this property is irrigated pasture land and they asked Thompson to look at it. He handed out co~ies of Mr. Thompson's report. This involves the entire 72 acres. The dlfference in the numbers is irrigated hay land. Mr. Andree stated they have addressed some of the concerns Mr. Thompson mentioned in his letter. The definition they use is an active hay field. They have tried to eliminate mapping active hay fields. Mr. Knight stated they don't feel any amount should be required. The mitigation on site is probably impractical. If they are required to do something, it will be with the DOW and use the amount in Mr. Thompsons letter. Mr. Andree stated these mitigation plans are becoming more and more widespread in an effort to offset the impacts. Instead of spending money to have independent people do this it makes sense for the DOW to take the lead. Mr. Jouflas can require in the MOU all improvements be made on his land. Mr. Knight referred to the letter and the fact the difference would be greater because his figures do include the whole 72 acres. Commissioner Phillips stated the County doesn't have any regulations to support this. The MOU can work, but it becomes arguable. She asked if Mr. Andree has the intention of doing so. Finding someone to take the responsibility for the money management is an issue. Corrmissioner Johnson stated he doesn't agree with seeing this in regulations. The County has tried to allow for flexibility by the landowner. That type of flexibility is needed to better improve habitat on their own lands. Corrmissioner Johnson stated he still has a concern with how the figure came about. The fees must be reasonable for the land owner and protect the wildlife. Mr. Andree stated the $9,400 in one year is enough money to generate the monies needed to maintain the property forever. It would be much more to pay the dollar amount by the year. Chairman Gates questloned why the DOW cannot treat the land owner fairly. Commissioner Phillips sU;Jgested this be tabled. Mr. Andree stated they wlll accept Mr. Thompson's amount and they will go to final plat. Mr. Jouflas stated he doesn't see that this is solvable. He will accept the offer. Commissioner Johnson stated he would like to see this tabled, even though the numbers from Thompson are there they do not reflect the right amount because the entire 72 acres are being considered. The undisturbed open space areas are not to be included. He asked if they are looking at the $7,806.14 for the whole 72 acres and if the letter is the wildlife mitigation plan they intend on submitting? Mr. Jouflas asked what will happen when and if he plans on doin;J more. Mr. Andree suggested if they are going to implement the mitigatlon plan he would like a MOU to be in place as well. Commissioner Phillips moved to continue file number PD-314-95-F, Ute Creek POD, until 1:30 p.m. Corrmissioner Johnson seconded the motion. The vote was declared unanimous. BOARD OF COUNTY COMMISSIONERS EAGLE, COLORADO RECORD OF PROCEEDINGS FORM 50 HOECKEL'S 387869 ZC-270-95,Jeanette Nottingham PD-345-95-S/P, Nottingham Cottages Kathy Eastley presented file numbers ZC-270-95, Jeannette Nottingham and PD-345-95-S/P, Nottingham Cottages. She stated this was a request to consider a zone change on a 2.85 acre parcel from Resource to PUD, and a request for a Minor PUD to allow for five short-term rental cottages, a sin;Jle family dwelling with a caretaker unit and conversion of a single famlly home lnto an antique/craft store. She explained the requests to the Board. Ms. Eastley read Staff findings. The Planning Corrmission recorrmended approval with the same conditions as Staff. Staff recommended approval of the zone change and approval of the Minor PUD with the following conditions: 1) Hook up to public water and sanitation facilities must occur for all units within this PUD except for the existing single family structure. Upon application for conversion of this structure to an Antique/Craft Store, the well and septic system must be abandoned and hook up to public facilities must occur. 2) A public access soft footpath must be constructed parallel to the high water mark of the Eagle River. The path cannot extend to the river and construction plan and collateral must be approved by the Eagle County Engineering Department at Final Plat. 3) Fees for Cash in-lieu of School Land Dedication fees be paid prior to Final Plat approval. 4) Fees for off-site road improvements be paid prior to Final Plat approval. The applicant shall reach an agreement with the County Engineering Department prior to final plat. 5) Drainage, erosion control and floodplain/setback information be approved by the Engineering Department at Final Plat. 6) Inclusion into the Eagle-Vail Metropolitan District must occur prior to Final Plat approval. 7) A final plat is required prior to issuance of any permit on this site. Tom Boni, Knight Planning, made a brief presentation to the Board. He addressed a concern with the off-site road improvements fee suggested. He stated the ap~licant believes this fee is the same as a full subdivision and this applicatlon is for individuals who will be staying at the motel but not paying into the County road system funds. He spoke to a bike path through the property. He stated the first phase is for the garage and the secondary unit above the garage. The second phase is the conversion of the existing dwelling into an antique store. Commissioner Phillips questioned improvements to the bridge. Kathy Eastley stated the fees for the off-site road improvements are based on $1,000.00 per dwelling unit. Mr. Boni stated a $2,000.00 fee sounds reasonable. He stated the bridge was upgraded when McGrady Acres was approved. He stated the Town of Avon does support this proposal. Mary Jo Berenato, Deputy County Attorney, stated there is no expense to the applicant concerning preparation of the Subdivision Improvements Agreement as those documents are prepared by the Attorney's Office. Commissioner Johnson stated he believes the foot path should be tied to the entire PUD rather than the cottages. Discussion continued on the fees and off-site road improvements agreement. Ms. Berenato sug;Jested the applicant meet with the Engineering Department prior to flnal plat to reach an agreement. Commissioner Johnson asked about satisfying the employee housing requirement. Ms. Eastley stated the caretaker unit is restricted for rental to an Eagle County worker. She stated the applicant will be generating a total of four employee housing units. Commissioner Phillips moved to approve file number ZC-270-95, Jeannette Nottingham, changing the zoning from Resource to PUD, incorporating staff findings. Corrmissioner Johnson seconded the motion. The vote was declared unanimous. Commissioner Johnson moved to approve PD-345-95-S/P, Nottingham Cottages, incorporating Staff findings and conditions, with the change noted above. Corrmissioner Phillips seconded the motion. The vote was declared unanimous. Knudson Ranch, 1041 Pennit Ray Merry, Environmental Health Officer, presented the 1041 Permit application for Knudson Ranch. He stated in order to begin the process the Board must determine the application to be complete. Mr. Merry stated Staff has determined the a~plication is complete and estimated the fees at $980.00. Commissioner Phlllips moved to approve the 1041 Permit application for Knudson Ranch and set the estimated fees at $980.00. Corrmissioner Johnson seconded the motion. The vote was declared unanimous. PD-314-95-F, Ute Creek PUD The Board returned to this item. Chris Jouflas asked if the Board would requlre them to either pay the mitigation fee or file a mitigation plan. Corrmissioner Johnson stated he does not believe Mr. Jouflas has to agree to this mitigation plan but he does need to have one in place before final plat. Chairman Gates stated the DOW stated they would accept the mitigation plan presented by the applicant. Corrmissioner Johnson reminded Mr. Jouflas he does not need to accept this plan but he does need to have a mitigation plan by the final plat. It is not a question of whether the Board is requiring payment of $7,800.00. The Board is requiring a mitigation plan. Corrmissioner Phillips questioned whether the landowner can provide the services of the mitigation. Ms. Eastley responded there is a re~ort that outlines the mitigation process and would be acceptable to them If the applicant wants to follow the plan. Mr. Jouflas again asked the Board if the mitigation of his other 2000 acres is substantial. Ms. Eastley reminded Mr. Jouflas an MOU must be drafted and he can direct the DOW as to where to spend these monies. Corrmissioner Phillips believes this to be a suggested amount and not a regulated fee. Ms. Eastley responded if they don't pay the fee they are responsible for mitigation measures. Commissioner Phillips stated they don't have recommendations and she has a problem with people having to make this payment. Ms. Eastley reminded the Board the necessity for payment came about because the information was not provided at prellminary ~lan. This agreement between the DOW and the applicant was in place before thls. They, staff, assumed the mitigation plan was in place and suggested the submittal information be brought forth. Chairman Gates questioned the timing for Mr. Jouflas to collect the required data. Ms. Eastley referred to the location in the plan that states the issues to be identified. Mr. Kni$ht stated they believe they have fulfilled the requirement. Commissloner Johnson stated the request is either to provide a mitigation plan or pay the fee. Ms. Eastley reminded the Board the submittal of a plan does not mean a fee will not be charged. Commissioner Johnson moved to approve PD-314-95-F, Ute Creek PUD with the submission of a mitigation plan as presented to the Board today. Commissioner Phillips seconded the motion. Discussion followed on the motion. Chairman Gates called for the question on the motion. Corrmissioner Johnson voting yes and Corrmissioner Gates and Phillips voting no. commissioner Phillips moved to approve PD-314-95-F, Ute Creek PUD and the applicant must provide a mitigation plan before final plat.
