'The morning being spent paying bills, the following items were presented
to the Board of County Commissioners in the afternoon for their
consideration:
Consent Calendar
Chairman Johnson stated the first item on the agenda was the consent
calendar as follows:
01) Bill paying, December 4, 1995
02) Payroll for December 7, 1995
03) Resolution 95-139, setting the holidays and meeting dates for
1996 Board of County commissioner meetings
. 04) Public notice regarding Brett Ranch Subdivision.
Commissioner Phillips moved to approve the consent calendar being items
1 -4 as I?resented.
Chalrman Johnson seconded the motion. Of the two voting corrmissioners,
the vote was declared unanimous.
Paul Gregg, Buildings and Grounds presented item number 05 on the
consent calendar, indicating they went to bid for this project. One bidder
was very high and the second doesn't carry workman's comp.
commissioner Phillips moved to reject the bids.
Chairman Johnson seconded the motion. Of the two voting Commissioners
the vote was declared unanimous.
Resolution 95-140, Arrowhead at Vail, Phase I, Filing 16
John Althoff, Engineering Technician, presented Resolution 95-140,
termination of the warranty period for Arrowhead at Vail, Phase I of Filing
16. He explained the termlnation to the Board.
commissioner Phillips moved to approve Resolution 95-140, termination of

Chairman Johnson seconded the motion. Of the two voting corrmissioners,
the vote was declared unanimous.
Chairman Johnson noted that Commissioner Gates was not present as he was
at a water meeting.
Resolution Conferring Power of Attorney
Jim Fritze, County Attorney, presented Resolution 95-141, conferring
power of attorney to draw on Letter of Credit for Basalt Trade Associates.

Resolution Conferring Power of Atto:z:ney
Jim Fritze presented Resolution 95-142, conferring power of attorney to
draw on Letter of Credit for Eagle II Developers. Mr. Fritze asked the ltem

Agreement, E-911 Telephone Service
Jim Fritze, County Attorney, presented an Intergovernmental Agreement
concerning the implementation, operation and maintenance of the E-911
telephone service. 'The agreement has been signed by the State Patrol and 'The
Town of Vail.
Commissioner Phillips moved to aI?prove the Intergovernmental Agreement
concerning the implementation, operatlon and maintenance of the E-911
telephone service.
Chairman Johnson seconded the motion. Of the two voting commissioners,
the vote was declared unanimous.
Grant Awards, Sheriff's Office
Jim Fritze presented a Statement of Grant Awards for three grants for
the Eagle County Sheriff's Office. He explained there are three awards for
different grants. 'The first is for the Policing Grant. 'The second is for
the Cops Fast Grant. 'The third is for the Juvenile Jail.
Commissioner Phillips moved to approve and sign the Policing Grant.
Chairman Johnson seconded the motion. Of the two voting Commissioners
the vote was declared unanimous.
Commissioner Phillips moved to approve and sign the Cops Fast Grant for
$75,000 for a three year period.
Chairman Johnson seconded the motion. Of the two voting commissioners
the vote was declared unanimous.
Commissioner Phillips moved to approve and sign the Juvenile Jail
Removal ~roject for $5,400.00.
Chalrman Johnson seconded the motion. Of the two voting commissioners
the vote was declared unanimous.
Building Extension, Eagle County Airport
Jim Fritze ~resented a request for additional building extension at the
Eagle County Reglonal Airport. He reminded the Board of the extension
approved in September for the baggage area. 'The construction started and the
blueprints were sent to Mr. Fritze's office. UJ?on receipt it was noted there
was also a weight room and a number of offices lncluded. Mr. Loeffler
indicated the 100 foot extension that was approved was for the ba9gage area.
The drawings submitted to the building department showed in additlon to the
baggage area, office area and weight room. 'The steel was being placed and
there was no building I?ermit issued for steel. 'The building was red tagged.
At that point the appllcation was reviewed and it was noted the permit
exceeded the building approved.
Mr. Fritze stated Mr. Colby has indicated they would like to seek
approval of a 100 foot building. A clarification is needed for the lease
documents as well. Mr. Fritze has brought the applicable copies.
Chairman Johnson questioned the approved application in September and
the other improvements which were to be made. He asked if those approvals
were taking place. 'The holding area was the only area which was not approved
at that time because of the sewage needs. Mr. Fritze responded Chairman
Johnson was correct and they did approve the walkway. 'The board did deny the
holding area until the waste water and sewage area were approved.
Chairman Johnson asked if the weight room and offices were considered by
the Board.

Mr. Fritze responded no.
Craig Colby, vail Beaver Creek Jet Center, stated the drawing submitted
to the Board was indeed correct. He stated however, at that time they were
talkin9 about a conceptual plan. He understands the scale to 100 feet of
somethlng he was not aware. Mr. Colby stated the issue of the extra 50 feet
does refer to the offices and weight room. He indicated those are named as
such just because they have been called that previously. 'The weight room has
been used as storage as were the rooms marked offices. Mr. Colby stated they
are storing equipment for the airlines. Mr. Colby further explained when
they tore down the one end of the building, they moved the stored goods to a
different area.
Mike Wheelersburg, Building Inspector, stated they were 9iven an
application and they sent a copy to the attorneys. At that tlme, Patti
contacted the attorney's office and found out it had been ap~roved by the
Board. It was not until after they had begun they realized lt was a larger
facility.
Chairman Johnson asked where they are now.
Mike responded they have erected the steel.
Jim Fritze stated the reason this is of any real issue is because the
frontage area is valuable and that 50 feet of development for storage pushes
any other development further down.
commissioner Phillips asked for a visual of fifty feet.
Chairman Johnson asked if the lease will allow the 150 feet.
Mr. Fritze responded they have no lease at all for this right now.
Mr. Colby stated when they met they were trying to meet the December
deadline. He is willing to admit the communicatlons may have broken down but
the ultimate goal was the same. In order to do that, they had to move some
storage and he admitted they did not discuss that at the time.
Commissioner Phillips asked if the plan submitted was related as to what
had been submitted.
Mr. Wheelersburg stated they asked if approval had been given and the
answer was yes. 'The attorney's office at that point had not seen the plans
submitted.
Mr. Colby explained the plan approved was done for conceptual purposes
only. 'They did this when they talked about all the illJ'rovements to be made.
Commissioner Phillips stated she remembered the dlscussion.
Mr. Colby explained the walls they had to tear down made for the
difference as they needed the storage.
Commissioner Phillips asked if they had always planned on the additional
area.
Mr. Colby responded their plans always included the area.
Chairman Johnson stated his concerns are with the labeling of the areas
where some are clearly labeled storage and some labeled office. Mr. Johnson
stated the plans show the offices.
Ted Vaughn, architect for the applicant, stated the office space should
have been designated as storage for the airlines. Occasionally they will put
a desk in there, but it is really for airline storage. 'The discrepancy is on
the part of the prints.
Chairman Johnson asked why they were labeled as such.
Mr. Vaughn stated his daughter-in-law, who is a new architect,
misrepresented it. It was done in error.
Chairman Johnson questioned how she got part of the labeling right.
Mr. Vaughn responded in trying to meet the deadline, they ended up with
some incorrect labeling, but thlS was not intentional on their part.
Commissioner Phillips reflected on the intention for today which is to
get approval for the 150 feet of space.
Mr. Colby concurred.
Chairman Johnson asked if this storage area needs to be greater than the
other area removed.
Mr. Colby responded it is about the same size.
Chairman Johnson, while looking at the blueprint, stated it is not only
wider but longer.
Mr. Colby indicated they may be larger because the need is there for the
roadables.
commissioner Phillips asked Mike Wheelersburg how much steel is up.
Mr. Wheelersburg stated it is for the 150 feet. 'There has been no
inspection. A permit for the cement was not issued but a verbal given. An

inspection was made on the footing and foundation.
Discussion continued on the application.
Jerry 'Thomas, General Manager for American Airlines at the Eagle
Airport, explained the rotating belt as it exists now. Because the facility
is so small, they are stacking passenger bags on top of each other. 'Their
concern is customer service observation and they are trying hard to convince
the passengers the airJ?ort can handle the numbers. He hopes this customer
service issue will be lncluded in the Board's decision.
Arm Waller, with Airport Shuttle, stated that coming up, they have
increased numbers of flights. She asks they give positive consideration as
they have bookings to exceed the facilities.
Mr. Fritze clarified the issues of construction without a building
permit and construction of a facility greater than what was approved. Mr.
Fritze stated the request is for an additional 50 feet.
Commissioner Phillips moved to allow the applicant to move forward as
quickly as possible to allow visitors to have a quality experience upon
arrival or departure. 'This approval is for the fifty feet.
Chairman Johnson seconded the motion.
In discussion, Chairman Johnson stated he would like to see the
applicant build as to what was approved originally. He is concerned with the
building of a facility that did not receive approval.
Commissioner Phillips stated she is concerned with the building as them
having "gotten away" with the increased space, but she doesn't feel the
uncompleted area should be left as raw.
Chairman Johnson called for the question on the motion. Commissioner
Phillips voting yes, Chairman Johnson voting no.
Mr. Colby asked for clarification and asked if they could build the 100
feet approved.
Chairman Johnson responded yes.
Mr. Colby asked if they should reapply for the additional 50 feet.
Chairman Johnson stated it is up to the applicant.
Mr. Fritze clarified they have a PUD approval for 100 feet. It is up to
the building official to approve the plan and give a building permit
accordingly.
Mr. 'Thomas questioned the process now and the redrawing of the diagrams,
moving the steel and the concrete. He questions the delay of the process.
Mr. Thomas stated they will be satisfied with the 100 feet but the additional
storage would be great for part storage for repairs. This will delay the
process and the benefit of weighing it will be felt by the passengers who
will be the ones who will learn the lesson. He asked if there is any
alternative that will speed this up and stated they would appreciate all that
could be done.
Chairman Johnson moved the Board reconsider the previous motion.
commissioner Phillips seconded the motion. Of the two voting
commissioners the vote was declared unanimous.
'There being no further business to come before the Board, they adjourned
until the December 5, 1995.
