County Attorney Deputy Clerk to the Board Chairman Absent: James Johnson, Jr. This being a scheduled Public Hearing the following items were presented to the Board of County Commissioners for their consideration: Emergency Medical Report Paul Ramsay, Emer$ency Medical Services representative, presented the Emergency Medical Servlces Report and Plan. He stated this application is the yearly application. COrnmlssioner Phillips asked about the cornmunication system and vacation of the Colorado State Patrol Mr. Ramsay stated Sheriff Johnson is currently heading the communication committee. He discussed the possibilities for a new system. Commissioner Phillips stated all available funds will go to the . communication system if the de-Brucing question passes on the November ballot. Bob Loeffler, Ass't. County Attorney, stated in terms of transportation, the EMS Organization shall carry approved equipment. Mr. Ramsay stated the appropriate equipment is currently being carried in all vehicles. Commissioner Phillips moved to approve the Emergency Medical Services Report and Plan. The Chairman shall be authorized to sign said ~lan. Chairman Pro-tem Gates seconded the motion. Of the two votlng Commissioners the vote was declared unanimous. Chairman Johnson was not present at this meeting. Cooley Mesa Leasing Site Plan Dan Reynolds, Airport Manager, presented the Cooley Mesa Leasing Site Plan. He stated Cooley Mesa Leasing requested they be allowed to expand their current business to the West. Brad Ghent, Cooley Mesa Leasing, presented the original plans from the car wash showing all the parcels in question. He stated the gravel parking lot will be extended to lots 11 and 12, additional car rental storage gara$es will be added to parcels 11 and 12, summer and fall of 1996, an addition wlll be added to the current building and parcels 11 and 8 will be paved. He stated the Vail Beaver Creek Jet Center has agreed to put a cut into the curb by the baggage area to allow the cars immediate exit from that area. Todd Gardner, Cooley Mesa Leasing, discussed past events with traffic and decisions made by the Jet Center. Mr. Ghent stated in 1996 a check in canopy will be installed. He stated currently the pick up is from the Baggage Claim area. Bob Loeffler noted the difference between right of first refusal and ownership of parcels 11 and 12. He related the County has not received any offers to lease those parcels. Discussion followed on the proposal. Commissioner Phillips asked if a temporary lease would be satisfactory to the applicant. Dan Reynolds stated the Board can either approve the proposal, Mr. Ghent can start over, or what would work for the applicant for short term leases. He stated anything long term will not work at this time. Mr. Ghent stated the ideas for parcels 7 and 8 will work well at this 1 time. He stated if the lease is to only be short term, it does not make sense to invest alot of time and money lnto the project. Mr. Loeffler stated if the Board were prepared to accept short term a~plications on parcels 7 & 8, which would not affect Mr. Ghent's right of flrst refusal. If the Board is considering a long term arrangement, an agreement needs to be drafted deleting Mr. Ghent's right of first refusal on parcels 11 and 12. Jim Fritze, County Attorney, suggested acce~ting short term applications on parcels 7 & 8 or a long term agreement declarlng where the rights of first refusal are and on which lots, deleting those rights on parcels 11 and 12. Discussion continued on the proposal. Commissioner Phillips moved to approve and a plan for parcels 7 & 8, Cooley Mesa Leasing, be allowed long term rental on parcels 7 & 8, rights of first refusal on lots 11 & 12. Staff shall be instructed to prepare a document for long term leases on lots 7 & 8, rights of first refusal on lots 11 & 12, and the applicant giving up his rights to lots 13 & 14. Chairman Pro-tem Gates seconded the motion. Of the two voting commissioners the vote was declared unanimous. Chairman Johnson returned and assumed Chairmanship of the meeting. Consent Calendar Chairman Johnson stated the next item on the agenda was the consent calendar as follows: 01) Bill paying 02) Payroll for September 28, 1995 03) County Veterans Service Officers Monthly Report 8-95 04) Contract between Eagle County and the Colorado Department of Public Health and Environment to provide child health services. Commissioner Phillips moved to approve the consent calendar as presented. commissioner Gates seconded the motion. The vote was declared unanimous. Resolution 95-121 Jim Fritze, County Attorney, ~resented Resolution 95-121, authorizing the Chairman or his designee, to Slgn the Airport Improvements proj ect Grant for ramp construction upon Attorney review and approval. Commissioner Gates moved to approve Resolution 95-121, Airport Improvements Project Grant. Commissioner Phillips seconded the motion. The vote was declared unanimous. Bob Loeffler stated the Resolution reflects anticipation of the grant being received before April 30, 1996, the end of the fiscal year. Appeal, Robert Mayne Keith Montag, Director of Community Development, presented an appeal from Robert V. MaYne stating over the past two to three months Western Petroleum has been talking with Ellie Caryl, Planning Technician, to determine if a propane facility could be located on Mr. MaYne's property in Dotsero. It has been found it is possible. Today's hearing is regarding Western Petroleum's desire to lease the property ln Dotsero. The findings of Staff is that a long term lease will in turn be cause for a rezoning of the property in question. Mr. Montag went on to explain Western Petroleum desire is to distribute their products from a site on a concrete pad, which provides access to the tank. Mike Vatter, owner of Western Petroleum, agreed with Mr. Montag, stating they intend to use the facility as a distribution point. Terry Quinn, representing Robert MaYne, stated their reason for appeal is to determine if a legal issue arises out of the use of the location. The site, he explained is in Dotsero on the north side of I-70. It is the site of the MaYne Block plant. This proposal would be located in the northeast corner of that site. He stated they believe the lease should not be 2 BOARD OF COUNTY COMMISSIONERS EAGLE, COLORADO RECORD OF PROCEEDINGS FORM 50 HOECKEL'S 387869 considered a subdivision and question whether subdivision proceedings will be considered for the rental properties in the future or in the ~ast. He listed numerous different rental leases now in effect as well as agrlcultural leases. Mr. MaYne's desire is to take a vacant piece of ground and allow Mr. Vatter to put a tank on it. Chairman Johnson stated the difference between the leases Mr. Quinn mentioned and others, is they have gone throu$h the PUD process. Mr. Quinn asked about a self storage facllity. Chairman Johnson responded when the use is determined, the subdivision is created. Mr. Quinn questioned why a plat would not then be created. He spoke to the Edwards Medical center, Rive rwalk, etc. and asked if those had to go through the subdivision process. Mary Jo Berenato, Deputy County Attorney, explained the difference between the apartment and the storage use, is that the lessee has no ownership of the property. Mr. MaYne is leasing the land not the air space. In this instance, Mr. Vatter is making the investment to the land without Mr. MaYne constructing the building. Mr. Quinn questioned the leasing of agricultural land. Ms. Berenato stated until 1984, there was a provision which has been removed. Commissioner Gates returned to the question of agricultural property. Mr. Quinn responded if you are allocating a certain part of property under 35 acres, would the individual have to go through the subdivision process. Ms. Berenato asked the Board to respond only to this file. commissioner Phillips asked if the area has been marked. Mr. MaYne referred to the fact two years ago he constructed a storage facility and has been renting places there to store equipment. Mr. Quinn questioned then if Mr. MaYne builds the pad and leases it to Mr. Vatter, the problem would be over. Commissioner Gates moved to deny the appeal by Robert MaYne. Commissioner Phillips seconded the motion. The vote was declared unanimous. There being no further business to be brought before the Board the meeting was adjourned until September 26, 1995. ~ 3
