The morning being spent paying bills, the following items were presented
to the Board of COlmty Corrmissioners for their consideration in the
afternoon:
Appeal, Building Pennit 6761
Sid Fox, Plarming Manager, presented the first item on the agenda was an
appeal of Building Permit #6761, Rocky Monntain Concrete Pumping. He stated
the site is currently vacant and is zoned resource.
Kevin Lindahl, Attorney representing the applicant, appeared and
introduced Bill Purdie, Construction Manager, and Steve Whitehead, Rocky
Monntain Concrete Pumping. He stated the aPI?licant disagrees with Staff
denial. Mr. Lindahl stated the application 1S for a 5,000 square foot metal
building and informed the Board no equipment would be stored on site other
than the trucks used for cement. He related the trucks would be stored
inside the building for maintenance. He stated the building would have a
collection system where the water would be recycled and the oil is burned
within the building hearing system.
Corrmissioner Gates asked if the applicant believed a Special Use Permit
is unnecessary.
Mr. Lindahl stated the applicant believes he is within his use by right
for this property.
Comrrdssioner Gates stated the photographs presented appear to show this
as a good business but the problem lies with the definition of County
Regulations.
Comrrdssioner Johnson ask what would fit nnder the definition of a
contractors storage yard.
Mr. Lindahl answered dump trucks, backhoe's, equipment not licensed to
be used on the highways.
Steve Whitehead, applicant, stated he believes that sales is the only
item not included in the definition of Connty Regulations.
The Board asked for clarification of Connty Regulations.
Jim Fritze, Connty Attorney, reviewed sect10n 1.06 (3), 2.05.26 and
2.06.10 of the Ea$le Connty Land Use Regulations. He reminded the Board they
have twenty days 1n which to render a decision.
Sid Fox stated it is fairly common for Staff to analyze a building
permit application. He stated Staff uses the Purpose Statement for
determination. Mr. Fox stated this is a key I?arcel in terms of the future of
Dotsero. He stated the Block Plant and the M1ne are to the East and timber
sites are to the South. He reiterated the long term picture must be looked
at.
Corrmissioner Gates stated the Regulations still leave a great deal to be
interpreted. He suggested the Board take this matter under advisement.
Kevin Lindahl stated he believes that sales, repair or service of the
vehicles is a use by right.
Comrrdssioner Johnson stated he interprets it to be quite clear and
believes this application falls nnder a contractors stora$e yard. He
suggested the applicant come back with a special use perm1t.
Chairman Phillips asked Mr. Fox for the definition of a contractors
storage yard.
Mr. Fox read the definition of a contractors storage yard.
Discussion continued on the appeal of building permit.
Corrmissioner Gates moved to take this matter nnder advisement and
respond within twenty days.
Chairman Phillips seconded the motion. corrmissioners Gates and Phillips
voting yes, Corrmissioner Johnson voting no.
Corrmissioner Johnson stated he believes the application should be denied
and the applicant return with a special use permit.
Corrmissioner Gates stated he has questions with the interpretations of
the Regulations.
Philip Purdee, Construction Manager, reminded the Board this is a
maintenance facility not a storage facility. He stated he believes the
improvements made to the property will enhance the area.

ZS-360-94, Arnold Residence
Patti Haefeli, Planning Technician, presented file number ZS-360-94,
Arnold Residence. She stated this as a request for a s~ecial use permit to
build an art studio above the applicants garage which wlll include a
bathroom. Staff recorrmended approval with the following conditions:
01) This special use permit is for an art studio only. This art
studio will be used primarily for storage of art supplies and the occasional
use for painting of furniture.
02) There shall be no retail services offered at this site.
03) There shall be no cliental visits to the site.
04) This art studio shall not be used as a dwelling lll1it.
Ms. Haefeli stated letters were sent to adjacent property owners and no
responses have been received. She informed the Board COlll1ty Regulations do
not allow for habitable space in a garage but it is feasible through a
Special Use Permit.
Susan Arnold, applicant, stated she has talked with all her neighbors
and they have no negative concerns.
commissioner Johnson asked if the special use permit should be based on
an art studio or a home occupation.
Discussion continued on the application.
commissioner Johnson moved to approve file number ZS-360-94, Arnold
Residence, incorporating Staff findings and recorrmendations.
Commissioner Gates seconded the motion. The vote was declared

Resolution 95-01
John Althoff, Engineering Technician, presented Resolution 95-01,
substitution of collateral and first partial release, Cordillera Subdivision,
Filing 11. He stated an on-site inspection was made and everything was in
order.
Commissioner Gates moved to approve Resolution 95-01, substitution of

Chairman Phillips seconded the motion. Of the two voting Cormussioners
the vote was declared lll1animous. Corrmissioner Johnson was out of the room at

Resolution 95-02
Dan Reynolds, Airport Manager, presented Resolution 95-02, accepting the
1995 Colorado Discretionary Aviation Grant and naming Dan Reynolds as Project
Director.
Commissioner Gates moved to approve Resolution 95-02, accepting the 1995
Colorado Discretionary Aviation Grant and naming Dan Reynolds as Project
Director.
Chairman Phillips seconded the motion. Of the two voting Commissioners
the vote was declared lll1animous.
Contract, Department of Transportation
Dan Reynolds presented a contract between the State of Colorado for use
and benefit of the Department of Transportation, Aeronautical Board, but the
Division of Aeronautics and Eagle COlll1ty for the 1995 Colorado Discretionary
Aviation Grant.
Commissioner Gates moved to approve the contract between Eagle COlll1ty
and the State of Colorado, Department of Transportation, for the 1995
Colorado Discretionary Aviation Grant.
Chairman Phillips seconded the motion. Of the two voting Commissioners
the vote was declared lll1animous.
PD-318-94-F, Eagle Dakota POD SUbdivision
Paul Clarkson, Planner, presented file number PD-318-94-F, Eagle Dakota
PUD Subdivision. He stated this is a request to subdivide a nine dwelling

Mr. Clarkson stated the applicant has related same collateralization has
been done through Garfield County. Staff recommended a~proval but the plat
and subdivision improvements agreement not be signed untll an amount for
collateralization has been agreed upon by the applicant and the County.
Steve Isom, re~resenting the applicant, stated all the utilities come
from Blue Lake, Fillng 5 and are all collateralized through Garfield County.
commissioner Gates asked if something went wrong in Eagle County what
recourse would the County have.
Mr. Isom stated some of the improvements have been built and released by
Garfield County.
Commissioner Jormson asked if the County could sign an Intergovernmental
Agreement with Garfield County so Eagle County could draw on the collateral
if necessary.
Bob Loeffler, Ass't. County Attorney, stated he will speak to Garfield
County concerning the agreement.
Mr. Isom brought up a 1991 State Statute that requires a developers
certificate issued by the State of Colorado Realtors Board.
Mr. Loeffler stated he believes the plat carmot be returned to the
developer for a new signing.
commissioner Gates moved to approve file number PD-318-94-F, Eagle
Dakota Subdivision. A change shall be made on the plat to clarify the
certification. The plat shall be approved once an Intergovernmental
Agreement is reached with Garfield County to allow Eagle County to draw on
Garfield County's collateral.
Commissioner Jormson seconded the motion. The vote was declared
unanimous.
SM-820-92, Delia Subdivision
Paul Clarkson presented file number SM-820-92, Delia Subdivision. He
stated the applicant was instructed by the Board on December 20, 1994, to
return with covenants agreeable to the Division of wildlife. Mr. Clarkson
stated the covenants have been submitted and the Division of wildlife is in
agreement. Staff recommended approval.
Commissioner Gates questioned what the covenants cover.
Rich Delia, applicant, reviewed the covenants for the Board.
Chairman Phillips asked why the County is getting involved with these
covenants.
Mr. Clarkson stated the covenants are the only fom of control the
County has and is required by the Division of wildlife.
Commissioner Gates asked if Eagle County Animal Control had reviewed the
covenants.
Mr. Clarkson answered yes.
Mr. Delia stated the covenants carmot be rewritten without review by
Eagle County, but infomed the Board Eagle County will not be the enforcement
agency.
Discussion continued on the covenants for Delia Subdivision.
Commissioner Jormson noted some discrepancies in the covenants and
suggested this matter be tabled to a later date for the Board's review.
Commissioner Gates concurred.
Commissioner Jormson moved to table this matter to January 10, 1995 at
3:00 p.m.
Commissioner Gates seconded the motion. The vote was declared
unanimous.

Sid Fox ~resented file number PD-291-94-A, Riverwalk at Edwards. He
stated Staff 1.S recommending tabling but related he will explain the file to
the Board. He stated the applicant is making some progress in definin;J a
mechanism to insure employee housing. Mr. Fox discussed deed restrict1.ons
and price caps on saleable and rental nnits.
Mr. Loeffler stated he nnderstands the applicant is not interested in
deed restrictions.
Commissioner Gates stated the basic sketch plan was modified to increase
the commercial space.
Mara Kleinschmidt, Attorney representing the applicant, stated they have
not found the price caps to be an acceptable proJ?<?sal. She stated the
applicant assumed price caps were not being cons1.dered.
Chairman Phillips stated the Board needs to say yes or no to price caps.
Ms. Kleinschmidt stated if price caps are requ1.red, the applicant will
withdraw the application amendment and proceed accordingly.
Mr. Loeffler stated there will be a deed restriction regardless, but
determining what type or kind is still being discussed.
Ms. Kleinshcmidt stated deed restrictions are certainly acceptable,
however, price restrictions that have to do with saleability and appreciation
is not acceptable.
Bill Clinkenbeard, Edwards resident, stated it is difficult to develop a
property when there is no defined policy in Eagle Connty concerning price
caps and deed restrictions. He stated price caps are erroneous.
Bill Williams, applicant, stated he does not have to build a break even
apartment house but related this is a low income development and a price cap
as proposed will not be feasible.
Mr. Fox stated part of this application is for an additional 50,000
square foot income space which should help to justify the 4,000 to 6,000
square feet of employee housing.
Jack Lewis, County Manager, stated under the original ~roposal the
applicant intended to provide 150 employee units. He quest1.oned how the
