PUBLIC HEARING
JULY 12, 1994

This being a scheduled Public Hearing the following items were presented
to the Board of County Commissioners:
The Board convened as the Local Liquor Licensing Authority.
Linda IS Kitchen
Earlene Roach, County Liquor Inspector, presented the new a~plication
for Linda M. Little, Linda's Kitchen. She informed the Board thlS matter has
been tabled from two previous meetings. Ms. Roach stated she had informed
Ms. Little to be present at this hearing, be prepared to take care of her
property taxes and submit certified checks for payment.
It was noted for the record Ms. Little was not present at this time.
Commissioner Johnson moved to deny the a~plication for Hotel and
Restaurant License for Linda M. Little, dba/Llnda's Kitchen.
Commissioner Gates seconded the motion.
At this time Ms. Little ap~eared for the hearin$.
In discussion, Chairman Phlllips informed Ms. Llttle there was a motion
on the floor for denial of her license application.
Ms. Roach stated Environmental Health and she have visited the site on
three separate occasions and found the following:
01) rodents were gaining entry into the establishment through the
back door, which has now been fixed.
02) there were open containers of food, which have been taken care
of.
03) there was built up grease and food around the equipment in the
kitchen, which has not been taken care of.
04) certified checks are to be submitted to pay for the licensing
fees.
05) the applicant is to be prepared to take care of back property
taxes.
Ms. Little informed the Board the back door has been fixed and she has
certified checks for the licensing fees. She stated she is prepared to make
a payment on her back taxes but cannot pay the entire amount today.
Commissioner Johnson asked if there was a previous payment schedule for
tax payments.
Ms. Little stated yes, but she believed all taxes were paid,
unfortunately they were not. She informed the Board the last three months
she has almost been in bankruptcy with her establishment.
Commissioner Johnson asked why Ms. Little was not at yesterday's
hearing.
Ms. Little responded she was tryin$ to get funds for the licensing fees.
Chairman Philli~s stated this appllcation for new liquor license has
taken a different tW1St than other license applications in the past. She
related she believes if Ms. Little is denied her license the County will most
likely not be able to collect the back taxes.
Commissioner Gates stated this is a difficult decision to make with a
history of the inability to make payments.

Commissioner Jormson asked if Ms. Little intends to get help with her
business and suggested that she obtain help with the business end of her
restaurant.
Commissioner Johnson withdrew his motion for denial.
Commissioner Gates withdrew his second.
Discussion followed on conditions for approval, back taxes, obtaining
help with the cleaning.
Sherry Brandon, Eagle County Treasurer, stated she does not have a
problem with a payment schedule for back taxes, but wants to assure Ms.
Little knows interest continues to accrue until the balance is paid in full.
commissioner Jormson moved to approve with the condition a report be
submitted by the Liguor Enforcement Officer in six months as to how the
establishment is belng maintained. Payments shall be made for back taxes by
certified funds.
commissioner Gates seconded the motion. The vote was declared
unanimous.
Beano's Cabin
Earlene Roach presented a modification of premises for Beaver Creek Food
Services, Inc., dbalBeano' s Cabin. She requested this matter be tabled to
July 26, 1994 at 11:45 a.m. to further investigate the lease and boundaries
of the proposed premises.
Commissioner Gates moved to table the modification of premises for
Beaver Creek Food Services, Inc., dba/Beano'S Cabin.
Commissioner Johnson seconded the motion. The vote was declared
unanimous.
There being no further business to be brought before the Board the
meeting was adjourned until July 21, 1994.
