This being a scheduled Public Hearing the following items were presented
to the Board of County Conmissioners for their consideration:
Inpact Assistance Grant
Jack Lewis, County Manager, presented two Grant Applications, one for
The Town of Avon and the second being from the Colorado Mountain College.
Corrmissioner Johnson discussed how the Impact Assistance Program related
to mining efforts in the County. He stated he felt Colorado Mountain College
had a greater connection and should receive top priority in the grant
applications.
Conmissioner Phillips stated she agreed Colorado Mountain College should
receive top priority.
Wester.n Eagle County Metropolitan Recreation District
Keith Montag, Commmity Development Director, introduced a request from
the Western Ea~le County Metropolitan Recreation District to place signs
around the perlmeter fence of the new ball fields located at the Eagle County
Fairgrounds. He stated according to the County sign code, section 2.11.07,
reads signs are prohibited in all zone districts. Mr. Montag stated Staff
denied the request and related the District was present today to appeal the
decision before the Board of County conmissioners.
Bill Heicher, Western Eagle County Metropolitan Recreational District,
stated the lease between the County and the District states the County must
approve any request for signage. He related the District is aware the signs
they are requesting are in violation of the County's sign code, but believe
these signs are needed.
Conmissioner Johnson expressed his opinion to the restrictions of signs
supporting alcohol and tobacco.
Bill Heicher responded many of the team sponsors are in fact alcohol
related and could withdraw their support due to the lack of advertisement.
Mary Jo Berenato, Deputy County Attorney, questioned if the process for
a variance had been started.
Jack Lewis stated a similar situation arose in the El Jebel area last
year and that request was denied.
Keith Montag responded there is a difference of opinion on the meanin$
of the County sign code. He stated any time there is a difference of opinlon
it must be appealed to the Conmissioners.
Ma~ Jo Berenato advised the Board they could make a decision today or
the appllcant could follow the course for variance procedures.
Conmissioner Phillips moved the Board of County Conmissioners approve
the application for appeal from Western Eagle County Metropolitan District to
place signage alon~ the fence at the ball fields, with the condition signs
shall face the inslde of the ball fields and comply with the terms of the
lease.
conmissioner Johnson suggested the issue be taken under advisement for
further discussion on the restriction of alcohol and tobacco.
Chairman Gates seconded the motion. Conmissioners Phillips and Gates
voting yes and Conmissioner Johnson voting no.
Jack Lewis stated the next item for discussion was design and

construction of the restroom facilities and concession stand. He stated
under the terms of the lease the designs must be approved by the Board of
County Conmissioners.
Bill Heicher explained the layout of these facilities.
Conmissioner Johnson discussed the current configuration of the mens
room and suggested there be only one urinal and two regular toilets.
Chairman Gates asked if there were any objections to block style
configuration of all the facilities.
Bill Heicher responded the buildings will be sturdy but will also be
appealing to look at.
Discussion continued on the proposed facilities at the ball fields.
The Board concurred the District will come back with construction plans
indicating the design of the building and materials to be used.
Mary Jo Berenato, Deputy County Attorney, stated the District has
requested the Board waive the permit fees on all proposed signs. She stated
the fees total $52.00 per sign.
Jack Lewis corrmented sign fees have not been waived in the past.
conmissioner Johnson reflected on the fees in relation to the signs
rotating from year to year.
sid Fox, Planner Manager, corrmented the sign code is not specific. He
felt the code would allow for options.
Mary Jo Berenato informed the Board the fees would be a one time fee
only and is charged for the space and not the sign in that space. ...
conmissioner Johnson suggested setting a one time fee for the entire
site for the duration of the lease.
Jack Lewis reconmended the fee be determined by Staff. He stated the
Recreation District can negotiate this fee at a later date.
Bill Heicher requested the Board waive the permit fee for construction
concession stand.
Chairman Gates conmented the Board must not set a precedent by waiving
these type fees for the District.
The Board concurred to discuss this issue at a later date.
Bill Heicher stated the District may be able to hook onto a private
water line near the fields. He stated the other option is to run lines from
the new barn at the fairgrounds.
Willy Powell, Eagle Town Manager, conmented on the private water line
system. He stated the water line services a private users association of
which the County is a part, along with five lots in the Chambers PUD. He
informed the Board the agreement does not allow for expansion. Mr. Powell
stated it is the Town of Eagle'S reconmendation some of the current users of
the water lines be eliminated before the District is allowed to utilize the
water lines. He indicated the other option would be for a new agreement .to
be drafted with all involved parties approving the expansion. He conmented
the District has been asked to make improvements to the water line to insure
the pressure flow will not be affected by this addition.
Chairman Gates stated he felt the current line was being fully utilized
and there was no possibility of elimination.
Discussion followed on the current flow for families at the end of the
water line.
Mike Bradley, Buildin~s and Grounds Director, updated the Board on the
current use of the water llne.
Conmissioner Johnson asked how much water the District will need from
this water supply.
Commissioner Phillips asked about a sprinkler system.
Jack Lewis responded the County is providing water for the sprinkler
system by using the ditch water.
Bill Heicher suggested a larger system be installed for future growth.
Jack Lewis quoted from the lease, section 7, "lessee shall be
responsible for obtaining water for purposes other than irrigation."
conmissioner Johnson reiterated long term solutions should be looked at
for future water uses in relation to the existing line.
Bill Heicher mentioned a line has already been installed from the
Chambers trailer to the ball fields. He expressed much concern with the
confusion around this issue and who was responsible for it being resolved.
Conmissioner Gates suggested all users of the water line be involved in
the decision of expansion and use of the current water line.
Bill Reicher stated an answer is required by February as the fields are

scheduled to open in ~ril.
Mary Jo Berenato lnformed the Board she requires a motion in order to
prepare a formal Resolution in regards to the decisions made today.
conmissioner Gates stated he felt a meeting should be set with existing
water users before moving forward.
The Board concurred and directed Staff and Western Eagle County
Metropolitan District to set a date for a meeting with all water users on the
current water line at the Eagle County Fairgrounds.
There being no further business to be brought before the Board the
meeting was adjourned.
