This being a scheduled Public Hearing the following items were presented
to the Board of County Commissioners for their consideration:
BE-52-93, Beaver Creek
Keith Montag, Community Development Director, presented file number BE-
52-93, Lot 11, Block 2, Tract H, Beaver Creek, Filing 5. He stated the
applicant has requested this matter be tabled to October 12, 1993 at 9:30
a.m. He stated Staff only received the mylar yesterday and has not had time
to properly review it.
Commissioner Johnson moved to table file number BE-52-93 to October 12,
1993 at 9:30 a.m., at the applicants request.
Commissioner Phillips seconded the motion. The vote was declared
unanimous.
SM-858-93, pinewoods
Mary Jo Berenato, Deputy County Attorney, presented file number SM-858-
93, Pinewoods. She stated the pinewoods Homeowners Association and Council
have requested this matter be tabled for sixty (60) days to allow time to
complete agreements with adjacent property owners. She recommended the Board
table this matter to November 23, 1993. . .
Commissioner Phillips moved to table SM-858-93, Pinewoods, to November
23, 1993, at the applicants request.
conmissioner Johnson seconded the motion. The vote was declared
unanimous.
Plat & Resolution Signing
Sid Fox, Planning Manager, stated the next item on the agenda was plat
and resolution signing. He presented file number SM-859-93-A, Arrowhead at
Vail, Phase I, Filing #22. He stated this was a technical correction and
recommended the Chairman sign the plat.
conmissioner Phillips moved to approve and authorize the Chairman to
sign the final plat, file number SM-859-93-A, Arrowhead at Vail, Lot 23,
Filing 22, Phase I.
Commissioner Johnson seconded the motion. The vote was declared
unan1mous.
Sid Fox presented final plat BE-54-93, Lot 15, Block 4, Tract H, Beaver
Creek POD. He stated this request amends the building envelope. He
recommended the Board approve and sign the plat.
commissioner Johnson moved to approve the final plat, file number BE-54-
93, Lot 15, Block 4, Tract H, Beaver Creek POD. The Chairman shall be
authorized to sign the ~lat.
Commissioner Phill1ps seconded the motion. The vote was declared
unanimous.
Sid Fox presented SM-868-93, Lot 41, Block 1, Filing 2, Eagle-Vail. He
stated this application was a duplex split and informed the Board this plat
does include the duplex split caveat. He recommended the Board approve the
plat.

Commissioner Phillips moved to approve final plat file number SM-868-93,
Lot 41, Block 1, Filing 2, Eagle-Vail, a duplex split including the duplex
split caveat.
Commissioner Johnson seconded the motion. The vote was declared
unanimous.
Sid Fox presented Resolution 93-111, a Special Use Permit for the Public
Service Company, connecting the gas lines between Minturn and Vail. He
requested the Board approve the Resolution.
Commissioner Johnson moved to a~prove Resolution 93-111, a Special Use
Permit for Public Service Company, f1le number ZS-335-93.
Conmissioner Phillips seconded the motion. The vote was declared
unanimous.
SE-292-93 & SE-293-93, Wolters & Ellard Exemption
Sid Fox ~resented file numbers SE-292-93 and SE-293-93, Wolters and
Ellard Exempt1on. He stated the site is located approximately eight miles
from Dotsero along the Colorado River. Mr. Fox stated the application is to
legalize two fifteen acre parcels. He informed the Board the zoning on the
property is Resource, there is legal water supply, access and adequate sewage
disposal. Staff recommended approval.
Commissioner Phillips moved to approve file number SE-292-93, Wolters
and Ellard Exemption Plat and adopt Staff findings.

unanimous.

Commissioner Phillips seconded the motion. The vote was declared
unanimous.
SM-867-93, Sopris View Apartments
sid Fox presented final plat file number SM-867-93, Sopris View
Apartments, located off Highway 82. He stated the plat subdivides the second
apartment building away from the first building.
Commissioner Phillips asked if the apartments have been completed.
Mr. Fox stated sixteen (16) have been completed out of the total of
sixty-two (62) previously approved.
Mary Jo Berenato stated Staff has requested the applicant place two plat
notes on the plat, one to state secondary lot lines are being created and
each building does not by itself comply with County zonin;J and two,
restrictions from selling any parcels as part of the prel1minary plan. She
informed the Board Meldor Company illegally signed the property over to
Basalt Trade Associates and is now refusing to sign the consent to
assignment, but Basalt Trade Associates has taken all liability.
Jim Fritze, County Attorney, stated the property was conveyed in
violation of the ori~inal agreement.
commissioner Ph1llips moved to a~prove the plat file number SM-867-93,
Sopris View Apartments, with restrict10n number seven. The Board shall also
approve the Subdivision Improvements Agreement and Addendum.
conmissioner Johnson seconded the motion. The vote was declared
unanimous.
There being no further business to be brought before the Board the
meeting was adjourned until October 4, 1993.
