Gloria Deschamp, applicant, was present for the hearing. Ms. Knight stated everything is in order and all fees have been paid. She asked Ms. Deschamp is the construction of Highway 82 will have an adverse effect on her business. Ms. Deschamp answered yes there will be a major effect on her business during construction and after the road is complete with the designs of the intersections. She stated she believes there will be severe traffic congestion. Chairman Gates asked if there were any reports from the Eagle County Sheriff's Office. Commissioner Johnson questioned why the applicant had two different licenses, one for 3.2% Beer and one for liquor. He stated the age law changed for 3.2% Beer. Cordillera Metropolitan District Squaw Creek Metropolitan District Chairman Gates stated the next item on the agenda was consideration of service plans for the proposed Cordillera Special District and the Squaw Creek Special District. Keith Montag, Director Community Development, presented file numbers SD- 001-93 and SD-002-93. He stated the applicants are Kensington Partners and Stage Gulch Partners. Both proposed districts are located in the Squaw Creek area to serve the Cordillera development. He stated the Cordillera District will be formed to assist in the funding, integration and co-ordination of the district services and facilities. The Squaw Creek District will construct, own and operate the public services and facilities in Cordillera. He informed the Board the mill levy being proposed is 37 1/2 mills projected over a twenty-five year time period. He stated the approximate capital costs are $14,660,000.00. Mr. Montag stated the proposed services would be a water system, roads, fire protection, mosquito control and a limited transportation system. He stated the cable television portion has been removed from the proposal. Gerry Engle, Cordillera Attorney, appeared and related there were several individuals present to speak at this hearing and answer any questions the Board may have. Matt Dalton, representing the applicant, stated he was present to provide the statutory requirements for the proposed service plans. He pointed out on a map the location of the west parcel and the remainder boundaries of the Cordillera District. He stated the powers to be provided by each district is identical. He stated the District will be overlaying existing road, plowing and maintaining those roads, fire protection will be provided through a contract with the Avon Fire Protection District, misquito control will be a maintenance issue and transportation will also be a maintenance issue. Mr. Dalton stated homeowners are currently paying someone for all these issues. He stated the proponents have minimized the duplication of services in these districts. The environment for special districts today is such that the financial capabilities is driven by the Statutes. No Special District in the State of Colorado may issue bonds in excess of an aggregate amount of $2,000,000.00 or 50% of the assessed valuation. Mr. Dalton continued to discuss services to be provided. He discussed financial feasibility and discussed the following: a) There is sufficient existing and projected need for organized service in the area to be serviced by the proposed special district. b) The existing service in the area to be served by the proposed special district is inadequate for present and projected needs c) The proposed special district is capable of providing economical and sufficient service to the area within its proposed boundaries. d) The area to be included in the proposed special district has, or will have, the financial ability to discharge the proposed indebtedness on a reasonable basis. e) Adequate service is not or will not be available to the area through the County, other existing municipal or quasi-municipal corporations, including existing special districts within a reasonable time and on a comparable basis. f) The facility and service standards of the proposed special district are compatible with the facility and service standards of Eagle County within which the proposed special district is to be located and each municipality which is an interested party under Section 31-1-204 (1). g) The proposal is in substantial compliance with any master plan adopted pursuant to Section 30-28-106, C.R.S. h} The proposal is in compliance with any duly adopted city, county, regional, or state long-range water quality management plan for the area. i} The organization of the proposed special district will be in the best interests of the area proposed to be served. Commissioner Johnson questioned the special districts as associated with Amendment One. Mr. Dalton stated he is suggesting the payments will be characterized as revenues received in the provision of services. Commissioner Johnson questioned two separate districts as opposed to one single district. Mr. Dalton stated Squaw Creek Metropolitan District will be the managing district and Cordillera Metropolitan District will have little to do. Commissioner Johnson stated the mill levy being proposed is the highest Metropolitan District mill levy in Eagle County. Gerry Engle stated the bonds are only sold based on their current valuations. Jim Fritze asked who would be the voters in the Squaw Creek Metropolitan District. Mr. Dalton stated the Squaw Creek District is a small district and the voters will be five people who have been transferred property by Kensington Partners and will then serve on the Board. Mr. Fritze asked if there would be a mill levy for the Squaw Creek District. Mr. Dalton answered no. Jim Fritze questioned how salaries would be set for employees of the Squaw Creek Metropolitan District. Mr. Dalton stated he does not anticipate having any employees. BOARD OF COUNTY COMMISSIONERS EAGLE, COLORADO RECORD OF PROCEEDINGS FORM 50 HOECKEL:S 387869 Mr. Fritze questioned the type facilities would be constructed. Mr. Dalton answered those items are discussed in the Service Plan and will be discussed by Gerry Engle. He read a proposed resolution into the record. Mr. Fritze asked why the water rights were being leased to the Districts rather than being sold to the Districts. Mr. Dalton stated under the contract the Districts will be required to give water rights to the Edwards Metropolitan District sufficient to allow them to provide the bulk of the water service for the entire development. Mr. Fritze asked what improvements are contemplated in which the developer would be paid by the District. Mr. Dalton stated there currently is a water line being constructed and various road improvements. Discussion continued with Mr. Fritze asking questions of Mr. Dalton concerning two districts being proposed. Gerry Engle stated Cordillera was approved as a stand alone water system and that is where the P.U.D. left off. He informed the Board Cordillera has joined forces with the Upper Eagle Water Authority. He explained how the two special districts came about. Stan Bernstein, financial planner for Cordillera and Squaw Creek Metropolitan Districts, spoke to the financial feasibility of these districts. Commissioner Phillips asked about the five homeowners and payment of the debt. Mr. Bernstein stated Cordillera Metropolitan District is the one responsible for paying off the debt. Commissioner Phillips asked how many homeowners would be included in the assessment of mill levy. Mr. Engle stated there are two districts. One of those includes all the homeowners in Cordillera. He stated there are currently sixty-two homeowners and eighty-seven properties under contract. Mr. Fritze asked if the Cordillera properties will be in the two proposed districts not in either Eagle County Ambulance District or the Eagle County Emergency Services Hospital District. Mr. Engle stated he believes the properties will be included in those districts and also in the Western Eagle County Metropolitan Recreation District. Mr. Fritze questioned if the properties are in the Ambulance District what is the need for additional ambulance services. Mr. Dalton stated there would be no additional ambulance services. Andy Cain, underwriter for the bonds for the district, stated the bond market was alive but not well. He stated there are two ways to finance the bonds, borrowing and building up the infrastructure or go back after the developer has put the money into the development and go back and take some of the capital costs back out. Dave Edwards, resident of Fort Collins, informed the Board in their review of the service plan, the applicants have been forthright and open to all the property owners about the whys and wherefores of this concept, compromises and Kensington needing to remain in control. He stated he looked forward to helping other property owners to understand the concept of the two districts. Jim Ware, Attorney for the Homeowners Association, pointed out one of the goals of the homeowners association is to assure the district will be better off six months from now then they have been in the past. He stated the Homeowners Association is in favor of the proposal. Further discussion followed on the two districts proposed. Keith Montag read Staff's concerns and issues as follows: 01) Justification for the creation of two districts 02) District proliferation 03) Financial report justification: a) There appears to be too little taxable value within the district b} The revenue is heavily dependent on "contract" with Cordillera District which may cause "premium" on debt c) Who are the owners in the District d) Explain the debt issuance limit e) Is sale/construction of 25 homes per year for 16 years realistic 04) Based on Amendment #1, is it possible that a double election process would be necessary with two districts 05) Explanation of the boundary discrepancy between the two districts 06) Inclusion of "drainage maintenance" in the service plan. Mr. Montag read Staff findings for the Board. He stated Staff recommended approval of the proposed service plans, if the applicant adequately addresses the issues identified. The Planning Commission recommended approval with concerns being addressed. Allen Sartin, Finance Director, stated he reviewed the financial packets, suggested changes and he was satisfied with the proforma's in general. He stated there were no administrative costs separated out in the service plans, but they were included in the total figures. With respect to Amendment One, the bond issue side is good. Mr. Sartin stated there is no clear cut issue to compare one district to two districts in Amendment One. Suzanne Shepard, property owner, spoke to planning concerns and stated she still does not understand the two districts. She spoke in opposition to the proposal of two districts. Mike Leaderhouse, Co-Trustee for Ellis Beard Estate, asked if the Ellis property could be included in the two districts. Mr. Engle stated annexation depends on development and water rights. Commissioner Johnson asked about the special improvements agreement that Cordillera currently has with Eagle County. Mr. Engle stated the improvements required by the County will be completed. Commissioner Johnson moved to close public comment and take this matter under advisement for a period of twenty days, then notify the applicant in writing of the Board's decision. Commissioner Phillips seconded the motion. In discussion, Jim Fritze stated Amendment One does not impare the ability to pay voter approved bonds and local support is a matter for the Board to determine. He stated the reason for the two different district structure is to lock in control over the long term. Commissioner Johnson moved to withdraw his previous motion and enter a memorandum as submitted by Jim Fritze, County Attorney, into the record. Commissioner Phillips seconded the motion. The vote was declared unanimous. Jim Fritze suggested this matter be continued to July 26, 1993 to allow the Board time to consider this matter. Commissioner Johnson questioned if the Board were to close this hearing would the public be able to have input at the next hearing. Jim Fritze stated if the Board closes the hearing there would be no additional comments until stipulated by the Board. In discussion, Chairman Gates asked if the applicant could submit additional information within the twenty day deliberation period. Mr. Fritze stated that would depend if the Board was closing the hearing or just continuing the hearing for deliberation. Mr. Dalton stated he did not have any concerns with closing the hearing as long as the applicant was allowed to respond to the memorandum submitted by Jim Fritze. Commissioner Johnson moved to continue the hearing to July 26, 1993 at 11:00 a.m. Commissioner Phillips seconded the motion. The vote was declared unanimous. Town of Avon Chairman Gates stated the next item on the agenda was an agreement between Eagle County and Town of Avon, for a grant award in the amount of $21,000.00. Jack Lewis, County Manager, reminded the Board this matter had been tabled at the last hearing in order to obtain additional information about the use of the six buses that were being purchased. He stated it has been explained this purchase was not for use in Estes Park. Commissioner Phillips moved to approve the agreement between Eagle County and the Town of Avon for a grant award in the amount of $21,000.00. Commissioner Johnson seconded the motion. The vote was declared unanimous. Eby Creek Mesa Chairman Gates stated the next item on the agenda was the off-site improvements agreement for Eby Creek Mesa Subdivision. Jim Fritze stated this matter was discussed at the previous hearing and all issues have been resolved with the exception of access with regard to lot 220, which is currently not covered in the agreement. He called to the Board's attention the replacement of certain dates in the agreement. He stated the agreement, as drafted, required the developer to present evidence of signed BOARD OF COUNTY COMMISSIONERS EAGLE, COLORADO RECORD OF PROCEEDINGS FORM 50 HOECKEL'S 387869 contracts with regard to all utilities and proof of payment. He stated the applicant is working on acceptable bond form which will be submitted at a later date. Phil Scott, Senior Engineering Technician, stated with the reconstruction of Eby Creek Road, there is no access listed for lot 220. He stated there will be three or four feet of fill in this area, which will dramatically increase the grades for this lot's driveway. Mr. Scott stated normally the owner of the lot would have been contacted so he may indicate where he will install the driveway. He stated as of this date no response has been received from the owner of lot 220. Nancy Nichols, High Country Engineering, stated the driveway could be better or worse depending on where the owner intends to install his access. Phil Scott stated the access to that lot is a part of the impacts for Eby Creek Subdivision. He stated it will be the applicant's responsibility to assure there is adequate access to lot 220. Jim Fritze stated it is not the applicant's responsibility to provide perfect access to this lot. He informed the Board it is their responsibility to insure the access be no worse than it is today. Wendy Sacks, Eagle River Land Company, stated they will acknowledge and agree the access to lot 220 will be no worse than it is today. Commissioner Phillips moved to approve the Off-Site Improvements Agreement for Eby Creek Mesa Subdivision with the understanding access to lot 220 shall be no worse than it is today. Commissioner Johnson seconded the motion. Commissioners Phillips and Johnson voting yes and Chairman Gates abstaining. Cottonwood, Filing #1 Chairman Gates stated the next item on the agenda was final plat approval for Cottonwood, Filing #1, Lake Creek Apartments. Sid Fox, Planning Manager, stated this application was a final plat which was tabled from the hearing on June 28, 1993. He stated the intent of the final plat is to create two lots for multi-family development and associated open space. He stated the approved density of this lot is 270 units. The project will provide employee housing credits for Vail Associates, Arrowhead and Cordillera. He stated the credits available for Vail Associates will be 100, Arrowhead will be 34 and Cordillera will be 34. He stated these credits will be formally established by formal resolution at a later date. Mr. Fox stated the land area is 56 acres and informed the Board the Preliminary Plan for this site was approved January 1992. Mr. Fox stated the Planning Commission recommended approval by a vote of four (4) to one (1). He stated the Planning Commission did express some concern of the recreation amenities for the project. He stated at the last Board of County Commissioner hearing Staff identified several outstanding issues to be addressed before Staff could recommend signing of the plat. He informed the Board all those issues have been addressed to the satisfaction of Staff with one exception. He stated the final public improvement drawings are being reviewed by County Engineer. County Attorney and County Surveyor have reviewed the final plat. Staff recommended approval in accordance with Section 2.19.02 of the Eagle County Land Use Regulations. Jim Fritze stated there will be a plat note placed on the plat for which he has prepared a formal resolution. He suggested the Board also make a motion to approve the resolution. Commissioner Phillips moved to approve Resolution 93-73, Cottonwood Filing #1, final plat Lake Creek Affordable Housing, file number PD-296-93-F. Commissioner Johnson seconded the motion. The vote was declared unanimous. Commissioner Johnson moved to approve the final plat for PD-296-93-F, Cottonwood, Filing #1, Lake Creek Apartments. Commissioner Phillips seconded the motion. The vote was declared unanimous. Resolution 93-74 Commissioner Johnson stated the next item on the agenda was a proposed Resolution allowing the placement of 1/2 of 1% sales tax which would be dedicated to transportation, on the November ballot. He stated the reason for this question to be placed on the ballot is to allow for permenant funding source for mass transportation. Chairman Gates asked when mass transportation is spoke of if it includes bikes, equestrian, airports and bussing. Jim Fritze stated the sales tax has a ten year sunset, running from January 1, 1994 through December 31, 2004. He stated if the sales tax were to continue beyond the year 2004 it would require voter approval. Mr. Fritze stated this would be the first ballot question after the Bruce Amendment, making it longer in wordage. He stated the Resolution provides for a portion of the monies to be allocated for public transportation in the Basalt and El Jebel area. He stated the same items will be taxed and the same items will be exempt as those under the current County sales tax. Commissioner Phillips stated by approving this resolution it will give the Board an option of placing this question on the November ballot. She stated this question can be withdrawn at a later date if so desired. Commissioner Phillips moved to approve Resolution 93-74, providing for the submission to qualified electors of Eagle County, authorizing the levy of a County Sales Tax of 1/2 of 1% for a mass transportation system. The question will be submitted at the election to be held November 2, 1993. Commissioner Johnson seconded the motion. The vote was declared unanimous.
