Marks Commissioner) Also present:,A..F..,,(A1) Orlosky Commissioner elect. Minutes of the last regular and special meetings were read and approved as read. This being the second Tuesday of January when new office holders take office, and It appearing that Commissioners Koprinikar and Orlosky were both sworn in as Cormnissioners for the new term in the District Court Chambers in Eagle County by District Judge Charles R. Casey on January 9, 1973, the day previous to this meeting; and it appearing to be desirable in the paying of bills that Commissioner elect Orlosky take office at this time, but that the vouchers for payment of bills, being December, 1972 pur- chases, be signed by 6ut'going"Chairman Gerard after which the new Chairman,Koprinikar, will take over for new business coming before the Board. Steinberg, MD Hugh Warder Dan M. Handy Associates, CP.A. Maxwell R. Barz ,Eagle Valley Enterprise First Bank of Eagle County The Bank of Vail Eagle Valley Batik Upon the resigning of Vincent Eichler as a member to the Eagle County Planning Commission, Don Price an alternate member, was appointed to fill the vacancy. Mr. Michael S. Blair, of McMinnville, Oregon, having previously been hired as Eagle County Planner, for work. There being no further business to come before the Board, it was moved, seconded and passed to adjourn until the next regular meeting unless sooner called by the Chairman. In the matter of fuel bids, it was determined that the County Clerk and County Attorney prepare and publish a notice for bids in the Eagle Valley Enterprise. The matter of opening up the road to the Bellyache Ridge Subdivision was discussed and tabled until a later date. Erik Edeen, County Sanitarian, appeared and made his monthly report. Whereupon, Commissioner Gerard moved for the adoption of said resolution, which was seconded by Commissioner Orlosky and declabed unanimous by Chairman Koprinikar. A copy of the Resolution follows these minutes. Mr. Tingsley then discussed the improvement and extension of the Eagle County Airport with the Commissioners. The Commissioners purchased a new Cat #12 Series F, Motor Grader from McCoy Company. A letter was received from the Colorado Land Use Commission advising that (as of January 23, 1973) the Eagle County Subdivision Regulations were declared to be in compliance with C.R.S. 106-2-34 (1963)(1972 Session Laws) or S. B. 35. A notice for bids of fuel and gasoline was ordered prepared for publishing in the Eagle Valley Enterprose. There being no further business to come before the Board at this time it was moved and seconded to adjourn until the next regular meeting, unless sooner called by the Chairman. In said matter, Robert 'Wham, Attorney for Rocky Mountain Airways, Williams, Attorney for -0/ V � Mountain Flying Service, Jack Elmore, Manager for Rocky Mountain Airways and John Oleson, President of Mountain Flying Service, all appeared in their capacities as represented above. Thereupon the Chairman asked the County Attorney to proceed. Mr. Warder then stated the subject as being a Base Operator Concession Agreement to be considered. The Chairman then called on Mr. Wham, who gave his opinion of the practibility of improvements in services as the need for added service increases. He stated that there was not enough business at the Eagle County Airport to merit two fixed base operators at this time, and feels the present proposal, if enacted, changes the contract between Eagle County and Rocky Mountain Airways and also mentioned certain interference and harassment by John Olsen, snow removal by Rocky Mountain alone, Airport Authority acting contra—wise to contract with R.M.A. and that a second base operator would create an untenable position for R.M.A. along with the economics of business divided. The Chairman then called on Mr. Williams, who questioned the economic motivation of R.M.A. and the elaborate default proceedures of the contract. Mr. Wham stated that R.M.A. has lost a lot of money on the operation and that Mr. Keller, Atty. acting for Eagle County, drew up the framework of the contract including the default proceedures. Mr. Williams asked why R.M.A. wants to stay on as F. B. 0., and stated his doubt that R.M.A. has ij any large amount of money invested in F. B. 0. services. Mr. Wham stated that R.M.A. believed in the future growth of the business, and that more services will be added as demanded. ' �i Commissioner Orlosky then questioned the need for two fixed base operators and requested reports from both Rocky Mountain Airways and Mountain Flying Service of their respective amounts of business over a thirty day period. Chairman Koprinikar inquired whether Commissioner Orlosky would so move, Whereupon, Commissioner Orlosky moved to have the Airport Authority take a deeper look into the situation of economic business for fixed base operators and that reports be forthcoming on business as per his request.
