HomeMy WebLinkAboutR97-071 BLM Land Transfer for LandfillCommissioner LlL� moved adoption of the following esolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 97 --Y�_ RESOLUTION REGARDING BUREAU OF LAND MANAGEMENT LAND TRANSFER APPLICATION FOR THE EAGLE COUNTY LANDFILL WHEREAS, § 30 -20 -101 et seq., C.R.S., and specifically §30- 20- 108(2), C.R.S. regarding solid waste disposal sites and facilities, and § 30- 11- 101(1)(b), C.R.S. authorize Eagle County to acquire and hold land for the purpose of operation of a landfill; and WHEREAS, the Board of County Commissioners of Eagle County, Colorado, desire to apply to the Bureau of Land Management for transfer of land for the Eagle County Landfill; and WHEREAS, the Board of County Commissioners of Eagle County, Colorado, has approved funding for such transfer including approving appropriations for land acquisition and conducting site investigations required by applicable law or as may be required by the Bureau of Land Management. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board of County Commissioners of Eagle County shall apply to the Bureau of Land Management for a transfer of land for the Eagle County Landfill identified in Exhibit A hereto; the Board and its staff shall execute all appropriate documents including, but not limited to a land transfer application, that are necessary to accomplish such transfer of land. -a THAT, the Chairman of the Board of County Commissioners of Eagle County is authorized to execute the land transfer application. PAPERWORK REDUCTION ACT STATEMENT The Paperwork Reduction Act of 1980 (44 U.S.C. 3501, et seq.) requires us to inform you that: Information is being collected to process your request for Federal lands under the provisions of June 14, 1926 (43 U.S.C. 869 as amended), Recreation and Public Purposes Act. Information will be used to illustrate whether the applicant meets requirements of regulations found in 43 CFR Subpart 2740. Response to this request is mandatory, see regulations found in 43 CFR Subpart 2741.4 EXHIBIT A LEGAL DESCRIPTION OF LANDS APPLIED FOR The public lands that Eagle County is applying for ownership of include land presently leased from the BLM (lease serial numbers C -36803 [active landfill site], C -248 [closed landfill site], C -40277 [right -of -way], and C -40272 [Eagle River Water & Sanitation District compost facility]). Eagle County is also applying for ownership of additional lands to be used for future disposal area development, soil borrow area development, placement of soil stockpiles, run -on and run -off drainage controls, and site access. The total land proposed for transference is described as follows: Sections 2,3, 10 & 11 Township 4 South, Range 83 West of the 6th Principle Meridian County of Eagle State of Colorado Section 2 G.L.O Lot 12, G.L.O. Lot 13, the NE 1/4 of the SW 1/4, the S % of the S %2. Section 3 G.L.O. Lots 9 & 10. Section 10 G.L.O. Lot 1, all of G.L.O. Lot 2 East of State Highway 131 right -of -way, G.L.O. Lots 5 and 6, the E' /2 of the NE 1/4, the SW 1/4 of the NE 1/4, the SE 1/4 of the SW 1/4, and the SE 1/4. Section 11 The W ' /2, the W '/2 of the SE 1/4, the SE 1/4 of the SE 1/4, G.L.O.
