RESOLUTION NO. 9 / - 7�
RESOLUTION GRANTING A SPECIAL PERMIT FOR
TEMPORARY HOUSING FOR the Hunt family,
who reside at 5509 Upper Cattle Creek Road
FILE NO. TH -00002
WHEREAS, the Board of County Commissioners of the County of
Eagle, State of Colorado (hereinafter the "Board "), is authorized
to grant temporary housing permits, pursuant to Chapter II,
Section 2.07.09 of the Eagle County Land Use Regulations; and
WHEREAS, the Hunt family(hereinafter the "Applicant "),
applied to the Eagle County Department of Community Development
for a temporary housing permit on March 17, 1997, within the
Rural Resource Zone District; and
WHEREAS, based on the evidence, testimony, exhibits, study
of the Master Plan for the unincorporated areas of Eagle County,
comments of the Eagle County Department of Community Development,
comments of public officials and agencies, and comments from all
interested parties, the Board of County Commissioners of the
County of Eagle, State of Colorado ( "the Board "), finds as
follows:
1. That proper publication and public notice was provided
as required by law for the hearings before the Planning
Commission and the Board.
2. That the proposed use of the temporary housing permit
conforms to .the requirements of Section 2.07.09 of the
Eagle County Land Use Regulations.
3. That the proposed special use will be compatible with
existing uses in the area.
4. That for the above - stated and other reasons, the
proposed zoning is in the best interest of the health,
safety, morals, convenience, order, prosperity and
welfare of the citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board hereby approves a special permit for
temporary housing for the Spiegel family, provided the following
conditions are met:
1) The existing modular home must be removed from the prior to
any final inspections for the new reside--: ^e.

2) Not more than one temporary structure on site.
3) The Hunts may apply for an extension of the Temporary
Housing Permit if the construction of the new home has not
been completed within six months. The permit may be
extended for an additional six months upon approval form the
Department of Community Development.
THAT, should Applicant not comply with any or all of the
conditions, the temporary housing permit shall be revoked.
THAT, the Board of County Commissioners directs the
Department of Community Development to provide a copy of this
Resolution to the Applicant.
THAT, the Board hereby finds, determines and declares that
this Resolution is necessary for the health, safety and welfare
of the citizens of Eagle County.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County of Eagle, State of Colorado, at its regular meeting
held the 8th day of April, 1997, nunc pro tunc to the 1st day of
April, 1997.
