BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 97 - L
RESOLUTION AUTHORIZING THE TRANSFER OF BUDGETED
AND
APPROPRIATED MONEYS BETWEEN VARIOUS SPENDING AGENCIES
WHEREAS, on April 14, 1997, the Eagle County Board of County
Commissioners (hereinafter "Board ") held a hearing to consider the
adoption of a supplemental budget; and
WHEREAS, the Board approved the supplement budget except for
a certain line item, which would have provided for a transfer of
funds from the Capital Improvement Funds to Buildings and Grounds
for unanticipated expenses associated with the courthouse remodel
(hereinafter referred to as "Line Item "); and
WHEREAS, the Board also approved tabling of the Line Item to
April 22, 1997, at which time the Board will consider its approval;
and
WHEREAS, the Board here desires to approve the Line Item as
part of the supplement budget in view of the needs of the Building
and Grounds Department; and
WHEREAS, the Board has the authority to expend such unantici-
pated or unassured revenues by enacting a supplementary budget and
appropriation, and to transfer budgeted and appropriated revenues
from one county fund to another county fund, pursuant to C.R.S.
29 -1 -109; and
WHEREAS, Eagle County's Finance Director has determined that
such budget appropriation is in compliance with the provisions of
the Colorado Constitution, Article X, Section 20, also know as
"Amendment One: The Taxpayer's Bill of Rights "; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board hereby authorize transfers between spending
agencies as set forth in Exhibit B attached hereto and incorporated
herein by this reference.
THAT, the Treasurer of the County of Eagle is hereby requested
and directed to take all action necessary to effectuate the intent
of this Resolution.
THAT, the Eagle County Budget Officer is hereby requested and
directed to immediately transmit an original or certified copy of
this Resolution to the affected spending agencies and the officer
or employee of the County of Eagle whose duty it is to draw
warrants or orders for the payment of money.
THAT, the Eagle County Budget Officer is hereby further
requested and directed to file an original or certified copy of
this Resolution with the Division of Local Governments in the
Department of Local Affairs.
THAT, this resolution is necessary for the public health,
safety and welfare of the citizens of Eagle County, Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County of Eagle, State of Colorado, at its regular meeting
