RESOLUTION NO.2015- U J
APPROVAL INCREASING THE AMOUNT OF OPEN SPACE FUNDS FOR THE PURCHASE
OF A CONSERVATION EASEMENT AND PUBLIC TRAIL EASEMENT ON A PORTION OF
THE EMMA FARM PROPERTY ON HOOKS LANE,EAGLE COUNTY AND PITKIN
COUNTY,COLORADO
WHEREAS, on or about March 2, 2015, Pitkin County entered into a contract that was ratified
by the Pitkin Board of County Commissioners on March 25, 2015, to purchase a conservation easement
on approximately 49 acres of land located on Hooks Lane known as Emma Farm (hereinafter the
"Property"); and
WHEREAS, a public trail easement across a portion of the Property is to be conveyed to and
managed by Pitkin County as part of the purchase; and
WHEREAS,the conservation easement is to be jointly held, administered and enforced by Pit kin
County and Aspen Valley Land Trust and will eliminate residential development and will severely restrict
other forms of development on three legally created lots in Eagle County and one lot in Pitkin County;
and
WHEREAS, by Resolution No. 2015-014 the Board of County Commissioners approved a
resolution to spend up to $1,477,500 from the Eagle County Open Space Fund for the purchase of a
conservation easement on a portion of the Property and related trail easement; and
WHEREAS, the Board of County Commissioners wishes to increase its monetary contribution
for the purchase of a conservation easement on the Property and related trail easement by an amount up to
$40,000 in lieu of contributing the same amount toward the purchase of the Carricarte property that is
being acquired by Pitkin County; and
WHEREAS, the Board of County Commissioners previously approved an expenditure of up to
$1,477,500 toward the purchase and it now desires to approve up to $1,517,500 towards the purchase of
the Emma Farms conservation easement and public trail easement.
NOW, THEREFORE BE IT RESOLVED by the Board of County Commissioners of the
County of Eagle, State of Colorado:
THAT, the Board of County Commissioners hereby specifically authorizes the expenditure of up
to one million five hundred seventeen thousand five hundred dollars ($1,517,500) from the Open Space
Fund to be used for the purchase of Emma Farms conservation easement and public trail easement; and
THAT, such expenditure of Open Space Funds shall be subject to satisfactory due diligence
review, approval of the form of conservation easement for the Property, and inclusion in a supplemental
budget to be separately considered by the Board of County Commissioners; and
THAT, the Board of County Commissioners finds, determines and declares that this Resolution
is necessary for the public health, safety and welfare of the citizens of Eagle County, State of Colorado.
