BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 2015 -
A RESOLUTION ACCEPTING OWNERSHIP OF CERTAIN PARCELS OF LAND
FROM THE COLORADO DEPARTMENT OF TRANSPORTATION FOR SOCIAL,
ENVIRONMENTAL AND NONPROPRIETARY GOVERNMENTAL PURPOSES
WHEREAS, the Board of County Commissioners acting on behalf of Eagle County,
Colorado, desires to obtain title to certain parcels of land presently owned by the Colorado
Department of Transportation; and
WHEREAS, the parcels of land which are the subject of this Resolution are more
particularly described by Exhibit"A"; and
WHEREAS, it is the intention of the Board of County Commissioners to utilize the
subject parcels solely for social, environmental and nonproprietary governmental purposes
pursuant to CFR 710.403 (d) (1).
NOW, THEREFORE, be it resolved by the Board of County Commissioners of the
County of Eagle, State of Colorado:
THAT, Eagle County is hereby authorized to accept, by Quitclaim Deed, ownership of
and full maintenance responsibilities for the parcels of land described by Exhibit "A"; and
THAT, Eagle County's use of said parcels of land on a permanent basis shall be solely
for social, environmental and nonproprietary governmental purposes pursuant to CFR 710.403
(d) (1); and
THAT, Eagle County shall be solely and perpetually responsible for all future
improvement, maintenance and repair of said parcels of land; and
THAT, in the event Eagle County shall fail to use the subject parcels of land for social,
environmental and nonproprietary governmental purposes pursuant to CFR 710.403 (d) (1), or in
the event the placement of outdoor advertising signs on or near the subject parcels land violates
the Federal-Aid Highway Act of 1958 and/or the Federal Highway Beautification Act of 1965,
the subject parcels shall revert to the Colorado Department of Transportation, after notice and a
reasonable opportunity to cure.

County of Eagle, State of Colorado, at its regular meeting held the day of
2015.

PARCEL No. 37 REV. 3:
A tract or parcel of land No. 37 Rev. 3 of the State Department of Highways, Division of
Highways, State of Colorado (now known as the Department of Transportation, State of
Colorado), Project No. I 70-2(10) Unit 1, containing 0.818 acres, more or less, in Tract 45 of
Section 32, Township 4 South, Range 84 West, of the Sixth Principal Meridian, in Eagle County,
Colorado, said tract or parcel being more particularly described as follows:
Beginning at a point on the east line of the property, from which point Corner No. 4 of
Tract 67 bears S. 10° 12' W., a distance of 999.6 feet;
1. Thence S. 47° 57' W. a distance of 203.3 feet to the west line of Tract 45;
2. Thence S. 1° 45' 30"W., along the west line of Tract 45, a distance of 277.5 feet;
3. Thence S. 88° 14' 30" E. a distance of 73.1 feet to the east line of the property;
4. Thence N. 11° 44' 15" E., along the east line of the property, a distance of 424.7 feet,
more or less, to the point of beginning.
The above described parcel contains 0.818 acres, more or less.

Highways, State of Colorado (now known as the Department of Transportation, State of
Colorado), Project No. I 70-2(10) Unit 1, containing 1.074 acres, more or less, in Tract 45 of
Section 32, Township 4 South, Range 84 West, of the Sixth Principal Meridian, in Eagle County,
Colorado, said tract or parcel being more particularly described as follows:
Beginning at a point on the.west property line, from which point Corner No. 4, Tract 67
bears S. 10° 12' W., a distance of 999.6 feet;
1. Thence S. 11°44' 15" W., along the west property line, a distance of 424.7 feet;
2. Thence S. 88° 14'30" E. a distance of 66.9 feet;
3. Thence N. 2° 27' 30" E. a distance of 170.0 feet;
4. Thence N. 49° 11' E. a distance of 148.9 feet to the east property line;
5. Thence N. 11° 44' 15" E., along the east property line, a distance of 303.3 feet;
6. Thence S. 47° 57' W. a distance of 218.4 feet, more or less, to the point of beginning.
The above described parcel contains 1.074 acres, more or less.

Section 32, Township 4 South, Range 84 West, of the Sixth Principal Meridian, in Eagle County,
Colorado, said tract or parcel being more particularly described as follows:
Beginning at a point on the north line of Tract 45 from which point corner No. 4, Tract 68
bears N. 33° 04' 30" W., a distance of 1,464.9 feet;
1. Thence S. 88° 55' 30" W., along the north line of Tract 45, a distance of 304.7 feet;
2. Thence S. 8° 16' W. a distance of 7.4 feet;
3. Thence S. 47° 57' W. a distance of 259.7 feet to the west line of the property;
4. Thence S. 11°44' 15" W., along the west line of the property, a distance of 303.3
feet;
5. Thence N. 49° 11' E. a distance of 740.3 feet, more or less, to the point of beginning.
The above described parcel contains 2.174 acres, more or less.

Eagle County, Colorado, said tract or parcel being more particularly described as follows:
Beginning at a point in Tract 45, T. 4 S., R. 84 W., 6th P.M., from which corner No. 4 of
Tract 67, T. 4 S., R. 84 W., 6th P.M., bears S. 19° 52' 30" W., a distance of 917.3 feet;
1. Thence N. 77°49' 30" E., a distance of 244.3 feet;
2. Thence N. 49° 11' E., a distance of 60.0 feet;
3. Thence N. 18° 26' E., a distance of 229.0 feet;
4. Thence S. 49° 11' W., a distance of 471.2 feet, more or less, to the point of beginning.
The above described parcel contains 0.714 acres, more or less,
for the purposes of channel change.
