HomeMy WebLinkAboutR14-065 Emergency Service Provider Impact Fees Assessment Termination Commissioner CA-14.--e-AOLALA-="Si moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 2014 - UU6 RESOLUTION TERMINATING THE ASSESSMENT OF EMERGENCY SERVICE PROVIDER IMPACT FEES FOR THE EAGLE COUNTY HEALTH SERVICE DISTRICT D/B/A EAGLE COUNTY PARAMEDIC SERVICES WHEREAS, the Eagle County Health Service District, d/b/a Eagle County Paramedic Services(ECHSD)was consolidated with the Western Eagle County Ambulance District(WECAD) through inclusion and dissolution effective December 31, 2013; and WHEREAS,previous to the effective date of the consolidation,WECAD did request of,and had implemented by Eagle County an Emergency Service Provider Impact Fee on new development to offset the cost or impact of new development upon the capital facilities of the WECAD; and WHEREAS, per Colorado Revised Statutes, if the ECHSD is to assess impact fees, the District is obligated to assess Emergency Service Provider Impact Fees equally within all governmental jurisdictions that the District's boundary overlaps. To date, the Emergency Service Provider Impact Fees have been assessed within every governmental jurisdiction west of Wolcott, inclusive of unincorporated Eagle County,the Town of Eagle and the Town of Gypsum. The region west of Wolcott was within the boundary of the now dissolved WECAD; and WHEREAS, the consolidated ECHSD Board of Directors has determined that while certainly impacts on new development still exist and that it may be necessary to in the future to request re-implementation of the Emergency Service Provider Impact Fees,at this time other sources of revenue appear to be sufficient to accommodate new growth; and WHEREAS,based upon the above change of circumstances,the ECHSD Board of Directors has found that it is in the best interest of the District and its local government partners to terminate any further collection of the Emergency Service Provider Impact Fee as of January 1, 2014. The District is to reimburse all developers from whom any impact fees were collected since January 1, 2014. The ECHSD Board of Directors Resolution memorializing this decision is attached as Exhibit `A' of this Board of County Commissioner Resolution; and WHEREAS, the ECHSD Board of Directors requests that the Board of County Commissioners rescind the Emergency Service Provider Impact Fees for all unincorporated geographical areas located within the newly consolidated ECHSD boundary via this Board of County 1 RESOLUTION EAGLE COUNTY HEALTH SERVICE DISTRICT DB/A EAGLE COUNTY PARAMEDIC SERVICES TERMINATING THE ASSESSMENT OF IMPACT FEES WHEREAS, the Eagle County Health Service District, d/b/a Eagle County Paramedic Services ("ECIISD") recently consolidated with the Western Eagle County Ambulance District ("WECAD") through inclusion and dissolution; and WHEREAS, previous to the effective date of the consolidation, WECAD did request of, and had implemented by, Eagle County, the Town of Gypsum and the Town of Eagle an Impact Fee on new development to offset the cost or impact of new developments upon the capital facilities of the WECAD; and WHEREAS, the consolidated ECHSD has determined that while certainly impacts on new development still exist and that it may be necessary to in the future again ask for the re-implementation of Impact Fees, at this time other sources of revenue appear to be sufficient to accommodate new growth; and WHEREAS, based upon the above change of circumstances, the Board of Directors of the ECHSD finds that it is in the best interest of the District and its local government partners to terminate any further collection of the Fire Protection Impact Fee as of January 1, 2014; and that any fees collected following that date should be reimbursed to the applicable developer. NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Eagle County Health Service District, successor to Western Eagle County Ambulance District, that the County of Eagle, the Town of Eagle and the Town of Gypsum are all requested to terminate at the earliest convenience further collection of an Impact Fee for ambulance purposes; and to make such termination retroactive to January 1, 2014; and that any fees collected after that date be reimbursed.
