BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 00 - Z!�1 2._
A RESOLUTION OPPOSING THE ADOPTION
OF "AMENDMENT 24" IN THE YEAR 2000 GENERAL ELECTION
WHEREAS, the voters of Colorado will be asked to adopt an amendment to the
Colorado Constitution in the November, 2000, general election reducing certain taxes, identified
as "Amendment 24 "providing for the "citizen management of growth "; and
WHEREAS, Amendment 24 prohibits local governments from approving new
developments except in already developed and developing areas during a period of time while the
local governments conduct studies to identify potential "Growth Areas" for new development
and then submit them to the voters for approval; and
WHEREAS, Amendment 24 prohibits local governments from approving new
developments thereafter, except by submitting new Growth Areas for voter approval; and
WHEREAS, representative government is the bedrock concept of American-style
government, and Amendment 24 has the effect of eliminating representative government with
respect to land planning; and
WHEREAS, smart growth management is a vital concern to Eagle County and Colorado
as a whole to maintain the quality of life that attracted and holds its citizens and visitors; and
WHEREAS, the adoption of Amendment 24 as constitutional amendments will require
statewide voter approval to amend its provisions to adjust to changes in the economic and social
climate in Eagle County, or in any one of its municipalities, alone, impairing Eagle County's
ability to grow "smartly" and also transferring control over local land planning issues to the Front
Range and other persons not living in Eagle County; and
WHEREAS, Amendment 24 is estimated to significantly negatively impact rural areas
such as Eagle County, decreasing the future value of ranch lands; and

WHEREAS, it is expected that there will be substantial expense imposed on local
governments to comply with the procedures required by Amendment 24; and
WHEREAS, it is expected that the meaning and application of the provisions of
Amendment 24 will be the subject of much litigation, further delaying development and further
burdening local government budgets; and
WHEREAS, it is both the obligation and the desire of the Board of County
Commissioners to communicate its strong opposition to Amendment 24 to the public;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board of County Commissioners expresses its strong opposition to
Amendment 24; and
THAT, the Board of County Commissioners urges the adoption by the state legislature of
reasonable standards for development which are sufficiently flexible to accommodate the
different needs of Colorado's varied communities and changing conditions that come with time.
