HomeMy WebLinkAboutR00-125 zone district amendment Willits Family HomesteadCommissioner moved adoption of the fol owing Resolution: u.� RESOLUTION s o OF THE U_ U b� M W IM BOARD OF COUNTY COMMISSIONERS ,= COUNTY OF EAGLE, STATE OF COLORADO a M m �■ In a RESOLUTION NO: - JQD � a* z M f o am m APPROVAL OF ZONE DISTRICT AMENDMENT — o �N m m Willits Family Homestead �m M FILE NO: ZC -00034 M r r+ WHEREAS, Lloyd and Jenna Willits did file an application with the Eagle County Department of Community Development on or about February 17 th 2000 to rezone the herein described property in Eagle County from Resource (R) to Residential Suburban Low Density (RSL) and WHEREAS, at its public hearing /hearings held July 6 2000 the Roaring Fork Valley Regional Planning Commission, based on its findings, recommended approval of the proposed Willits Family Homestead Zone District Amendment, with certain conditions; and WHEREAS, a public hearing was held by the Board of County Commissioners of the County of Eagle, State of Colorado, on July 31s 2000 and WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies, the recommendation of the Planning Commission, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows: 1. That proper publication and public notice was provided as required by law for the hearing before the Regional Planning Commission and the Board of County Commissioners. I 011 f 2. That the Board reviewed the application pursuant to Eagle County Land Use Regulation Section 5 -230. 3. That the proposed zoning is consistent with the purposes, goals and policies of the Future Land Use Map ( "FLUM "), the Eagle County Master Plan and the Mid - Valley Community Master Plan. 4. That the amendment is compatible with existing and proposed uses surrounding the subject land, and is the appropriate zone district for the land. 5. That conditions in the area have changed such that an amendment to modify density is appropriate. G. That the effect on the natural environment would not cause significantly adverse impacts on the natural environment. 7. That the proposed amendment addresses a demonstrated community need; 8. That the proposed amendment would result in a logical and orderly development pattern and not constitute spot zoning. 9. That the amendment will be provided with necessary public facilities and services. 10. That the extent to which the area to which the proposed amendment would apply has changed to such a degree that it is in the public interest to encourage a new density in the area. 11. That for the above stated reasons, the proposed zoning is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Eagle County, Colorado. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Eagle, State of Colorado: THAT the petition of The Willits Family Homestead File Number ZC- 00034, for a Zoning Amendment to change from the Resource Zone District to the Residential Suburban Low Density (RSL) Zone District be and is hereby approved for the following described property located in the unincorporated area of Eagle County: SEE ATTACHED EXHIBIT "A" - or - INSERT LEGAL HERE oil e 6p , l THAT the Board of County Commissioners directs the Director of the Department of Community Development to enter this amendment on the appropriate page of the Official District Map and to provide a copy of this Resolution to the applicant.
