RESOLUTION NO. 2 0 0 0 -_�
FINAL RELEASE OF COLLATERAL
AND
TERMINATION OF THE WARRANTY PERIOD
FOR
HOMESTEAD FILING NO. 2
WHEREAS, on April, 29, 1996, Warner Developments, Inc.
( "Subdivider ") and the Board of County Commissioners of Eagle
County, Colorado (hereinafter "Board ") entered into a
Subdivisions Improvements Agreement (hereinafter "Agreement ")
concerning the development of Homestead Filing No. 2;
WHEREAS, by Eagle County Consent No. 99 -23, the County
commenced the warranty period for Homestead Filing No. 2 said
warranty period to expire November 3, 2001; and
WHEREAS, both the Subdivider and Engineering Department
state that the work required under the Agreement is complete and
acceptable and the Engineering Department recommends full release
of the collateral and the termination of the Subdivision
Improvements Agreement, see Exhibit "A ", attached hereto and
incorporated herein by this reference. Based upon the oral and
written recommendations of the County staff, THE BOARD FINDS that
the Subdivider's obligations under the Agreement have been
satisfied.
WHEREAS, the warranty period required by the Subdivision
Improvements Agreement has ended.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the County accepts the roads listed in Exhibit A for
maintenance.
THAT, the Board hereby authorizes the full and final release
of collateral and the termination of the Subdivision Improvements
Agreement for Homestead Filing No. 2.

THAT, this document shall be recorded in the Records of the
Eagle County Clerk and Recorder, which shall be evidence that the
warranty period for Homestead Filing No. 2 has been successfully
completed and that the Subdivider's obligations under the
Agreement are complete.
THAT, the Letter of Credit No. 9561471 issued by First Bank
be returned.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County of Eagle, Stat of Colorado, at its regular meeting
held the C'Ve day o 2000.

RE: Homestead, Filing 2 Collateral Release
I have inspected the public improvements in Homestead, Filing 2 for which we have retained
$52,000 collateral. The improvements have successfully completed the warranty period and I
recommend that the $52,000 be released and the Subdivision Improvements Agreement be
terminated.
The following roads will be accepted for maintenance:
Lindsay Trail from the intersection of Gold Dust Drive to the cul -de -sac 0.12 miles
Remington Trail from the intersection of Gold Dust Drive to the cul -de -sac 0.24 miles
Russell Trail from the intersection of Gold Dust Drive to the cul -de -sac 0.21 miles
Hummingbird Trail from the intersection of Gold Dust Drive to the cul -de -sac 0.18 miles
Andover Trail from the intersection of Gold Dust Drive to the cul -de -sac 0.05 miles
Gold Dust Drive from South Forty Subdivision to the cul -de -sac 0.84 miles
