RESOLUTION NO 2013- I v I
A RESOLUTION ESTABLISHING THE FEE FOR PROCESSING
SPECIAL DISTRICT SERVICE PLANS
WHEREAS, Eagle County (the "County") is authorized pursuant to C.R.S. §
32-1-202(3) to impose a processing fee, not to exceed five hundred dollars ($500.00), to be
utilized to reimburse the County for reasonable direct costs related to processing special
district service plans and the hearing prescribed by C.R.S. § 32-1-204, including the costs of
notice, publication and recording of testimony; and
WHEREAS, if the Eagle County Board of County Commissioners (the "Board")
determines that special review of a service plan is required, the County is authorized pursuant
to C.R.S. § 32-1-202(3) to impose an additional fee to reimburse the County for reasonable
direct costs related to such special review. If the Board imposes such additional fee, it shall
not be less than five hundred dollars ($500.00), and it shall not exceed one one-hundredth of
one percent of the total amount of the debt to be issued by the special district as indicated in
the service plan or the amended service plan or ten thousand dollars ($10,000.00),whichever
is less; and
NOW THEREFORE BE IT RESOLVED by the Board of County Commissioners of
Eagle County, Colorado,
THAT, the Board hereby establishes a processing fee of five hundred dollars ($500.00) to
be utilized to reimburse the County for reasonable direct costs relating to processing special
district service plans and the hearing prescribed by C.R.S. § 32-1-204, including the costs of
notice, publication and recording of testimony; and
THAT, if the Board determines that special review of a service plan is required, the
County may impose an additional fee to reimburse the County for reasonable direct costs related to
such special review. If the Board imposes such additional fee, it shall not be less than five
hundred dollars ($500.00), and it shall not exceed one one-hundredth of one percent of the total
amount of the debt to be issued by the special district as indicated in the service plan or the
amended service plan or ten thousand dollars ($10,000.00), whichever is less; and
THAT, the Board of County Commissioners finds determines and declares that this
Resolution is necessary for the public health safety and welfare of the citizens of the County of
Eagle, State of Colorado.
