HomeMy WebLinkAboutR13-111 Execute All Documents Horn Ranch ')UL.42-- Commissioner ► moved adoption of the following resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 2013- I RESOLUTION AUTHORIZING ANY OF THE EAGLE COUNTY COMMISSIONERS TO EXECUTE ALL DOCUMENTS NECESSARY FOR THE PRESERVATION OF THE HORN RANCH PROPERTY WHEREAS, on October 1, 2013 the Board of County Commissioners of Eagle County, Colorado ("Board") approved an agreement to purchase a conservation easement on a portion of and fee-title ownership on another portion of the Horn Ranch,representing a total of approximately 402 acres of land along Interstate 70 and US Highway 6 (hereinafter the "Property"or the"Horn Ranch")which is owned by The Piney Valley Ranches Trust (hereinafter"PVRT"); and WHEREAS, the Board desires to use open space funds to protect the Horn Ranch, which includes a portion of the land to remain in private ownership under conservation easement ("Retained Parcel"), and a portion to be conveyed to Eagle County in fee ("Conveyance Parcel"). WHEREAS, the Board seeks to protect the "Retained Parcel" and"Conveyance Parcel" with conservation easements conveyed to the Eagle Valley Land Trust; and WHEREAS, Eagle County will acquire a recreational trail easement through the Retained Parcel through the Recreational Trail Easement Agreement Between The Piney Valley Ranches Trust and Eagle County, Colorado; and WHEREAS, Eagle County will acquire access to the stone quarry through the Stone Quarry Access Agreement Between The Piney Valley Ranches Trust and Eagle County, Colorado that permits periodic guided hikes to the historic rock quarry; and WHEREAS,trail easements, baseline reports, conservation easements, and closing documents will be executed to complete this transaction; and WHEREAS,the Board wishes to authorize any of the County Commissioners authority to execute all documents associated with the preservation and acquisition of the Property and other related documents.
