COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 2013- 09 1
APPROVAL OF A ZONE DISTRICT AMENDMENT FOR THE DIEMOZ RIVER
RANCH PUD (A.K.A. THE "CARRICARTE PROPERTY") FROM
PLANNED UNIT DEVELOPMENT (PUD) TO RESOURCE (R) ZONING
FILE NO. ZC-4096
WHEREAS, on November 26, 2012, Michael and Natalie Carricarte (the "Applicants")
submitted a request to the Board of County Commissioners(hereinafter the"Board")to amend the
Official Zone District Map for Eagle County, Colorado, and;
WHEREAS, the Applicants specifically requested to rezone the Diemoz River Ranch
Planned Unit Development,a 46.7 acre parcel(the"Property")located adjacent to Hooks Spur Road
Right-of-Way,and due West of the Hooks Spur Road Bridge; SE %of Section 3;NW'/Section 11,
and;NE ' Section 10;Township 8 South,Ranch 87 West of the 6th Principle Meridian,in El Jebel,
Colorado, from the Planned Unit Development (PUD) Zone District to the Resource (R) Zone
District, and;
WHEREAS, the Property has been zoned PUD since April 27, 1998 (Eagle County
Resolution No. 98-65;Eagle County File No.ZC-00022),in association with the approved Diemoz
River Ranch Preliminary Plan for PUD (Eagle County File No. PDP-00007), and;
WHEREAS,the Diemoz River Ranch PUD Guide was amended and replaced in its entirety
(Eagle County File No. PDA-00030),for the purpose of changing the legal description and acreage
of the PUD, as approved by the Board on November 20, 2000 (Resolution No. 2000-176) and
subsequently recorded at Reception Number 746272 on December 14, 2000, and;
WHEREAS, a Final Plat for PUD was approved on April 24, 2001, and subsequently
recorded on May 10, 2001, at Reception Number 756794, in accordance with the Diemoz River
Ranch Preliminary Plan for PUD,creating four(4)lots and associated building envelopes,associated
easements and rights-of-way, and a common open space area(Eagle County File No. PDF-00049),
and;

WHEREAS,a Subdivision and Off-Site Improvements Agreement for Diemoz River Ranch
PUD was executed by and between the developer and Eagle County on April 24, 2001, and
subsequently recorded on April 30, 2001, at Reception Number 755728, and;
WHEREAS, no development permits for the Property have been issued since the time of
Final Plat approval and no construction activities have commenced on the Property pursuant to the
PUD Preliminary Plan, Final Plat and associated Subdivision Improvements Agreement, and;
WHEREAS,the Applicants desire to down-zone the Property and, concurrently,to vacate
the Final Plat for the Diemoz River Ranch PUD,and pursuant to companion File G-4097,to vacate a
public fishing easement on the Property, and;
WHEREAS, at a public hearing held on May 2, 2013, the Roaring Fork Valley Regional
Planning Commission unanimously voted to recommend approval of Eagle County File No. ZC-
4096, with conditions, and;
WHEREAS, at a public hearing held on May 28, 2013,the Board approved Eagle County
File No. ZC-4096, with conditions; and concurrently approved, pursuant to Resolution No.
3-oq(, , the Applicants' re uest for vacation of a public fishing easement(File No. G-4097);
and pursuant to Resolution No. 0- ,the Applicants' request for vacation of the Final Plat.
NOW THEREFORE, based on the evidence, testimony, exhibits, and study of the
Comprehensive Plan for the unincorporated areas of Eagle County, comments of the Eagle County
Department of Community Development, comments of public officials and agencies,the Planning
Commission deliberations, and comments from all interested parties, the Board finds as follows:
THAT,proper publication and public notice were provided as required by law for hearings
before the Planning Commission and the Board, and;
Pursuant to Eagle County Land Use Regulations, Section 5-230.D. Standards for a Zone
Change:
STANDARD: Consistency with the Comprehensive Plan. [Section 5-230.D.1] The
proposed amendment DOES consider the purposes and intents of the Comprehensive
Plan, all ancillary County adopted Specialty and Community Plan documents, and IS
consistent with all relevant goals, policies, implementation strategies and Future Land
Use Map designation.
STANDARD: Compatible with Surrounding Uses. [Section 5-230.D.2] The proposal
DOES provide compatibility with the type, intensity, character and scale of existing and
permissible land uses surrounding the subject property; dimensional limitations of the

proposed zone district, when applied, should result in development that will be
harmonious with the physical character of existing neighborhood(s) surrounding the
subject property.
STANDARD:Public Benefit. [Section 5-230.D.3] The proposal DOES address a
demonstrated community need or otherwise results in one or more particular public
benefits that offset the impacts of the proposed uses requested, including but not limited
to: Affordable local resident housing; childcare facilities; multi-modal transportation,
public recreational opportunities; infrastructure improvements; preservation of
agriculture/sensitive lands.
STANDARD: Change of Circumstances. [Section 5-230.D.4] The proposal DOES
address or respond to a beneficial material change that has occurred to the immediate
neighborhood or to the greater Eagle County community.
STANDARD:Adequate Infrastructure. [Section 5-230.D.5] The property subject to the
proposal IS served by adequate roads, water, sewer and other public use facilities.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of the
County of Eagle, State of Colorado,that the Zone District Amendment(Eagle County File No.ZC-
4096) for the Diemoz River Ranch Planned Unit Development Property, located in El Jebel,
Colorado, as described under Exhibit "A" attached hereto, from the Planned Unit Development
(PUD) Zone District to the Resource (R) Zone District, is hereby APPROVED subject to
compliance with the following condition:
1. Except otherwise modified by this development permit, all material representations
made by the Applicant in this application and in public meeting shall be adhered to
and considered conditions of approval.
2. That the Applicant shall complete all necessary documents to evidence the public
right-of-way dedication and the fishing easement vacation and easement grant per
companion File No. G-4097, as directed by County staff or the Eagle County Board of
County Commissioners prior to completion of the resolutions to approve the zone
change and the Final Plat vacation.
THAT the Board of County Commissioners directs the Director of Community
Development to enter this amendment on the appropriate page of the Official Zone District Map
and to provide a copy of this Resolution to the applicant.

THAT the Board hereby finds, determines and declares that this Resolution is necessary
for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado.
