HomeMy WebLinkAboutR13-089 Approving District Attorney to Sit on Disposition of Forfeited Property Committee Commissioner moved adoption of the following Reso ution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 13 - RESOLUTION APPROVING THE DISTRICT ATTORNEY FOR THE FIFTH JUDICIAL DISTRICT OR HIS DESIGNEE TO SIT AS A MEMBER OF THE SUMMIT COUNTY'S COMMITTEE ON DISPOSITION OF FORFEITED PROPERTY WHEREAS, various law enforcement agencies may, from time to time, obtain seized and forfeited funds through arrests and prosecutions; and WHEREAS, Section 16-13-702(1), C.R.S.,provides that no forfeited property shall be used nor shall any forfeited proceeds be expended by a seizing agency unless such use or expenditure has been approved by a committee on the disposition of forfeited property; and WHEREAS, Section 16-13-702(3)through(6), C.R.S., further specifies the composition of various committees on disposition of forfeited property depending on the nature and identity of the seizing agency and other interested parties; and WHEREAS, the law enforcement agencies of Summit County wish to form the "Summit County's Committee on Disposition of Forfeited Property"(hereinafter"Committee")pursuant to Section 16-13-702(6)whose membership shall be comprised of the chief law enforcement officers of: (i) the Summit County Sheriff's office, (ii) the Town of Breckenridge, (iii)the Town of Dillon, (iv)the Town of Frisco, (v)the Town of Silverthorne, and(vi)the District Attorney for the Fifth Judicial District. The Committee's purpose will be the approval of the use of forfeited property or the expenditure of forfeited proceeds by a seizing law enforcement agency within Summit County by any agency who is a Committee member; and WHEREAS, Section 16-13-702(6)requires that the membership of said Committee be approved by all governing bodies which have budget authority over each member; and WHEREAS,the budget for the District Attorney's Office for the Fifth Judicial District is approved by Summit County, Eagle County, Lake County, and Clear Creek County. Although Eagle County, Lake County and Clear Creek County will not be members of this Committee nor eligible to access the seized property of the same,their approval of the District Attorney sitting on said Committee is necessary by the mandates of Section 16-13-702(6) C.R.S. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, Eagle County does hereby approve the formation of the Summit County's Committee on Disposition of Forfeited Property and authorizes the District Attorney for the Fifth Judicial District, or his designee,to participate and sit as a member of the same. THAT, the Board hereby finds, determines and declares that this Resolution is necessary for the public health, safety and welfare of the residents of the County of Eagle, State of Colorado.
