RESOLUTION
of the
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 2013 -
APPROVAL
OF THE SPECIAL USE PERMIT
FOR THE BRAND RESIDENCE.ACCESSORY DWELLING UNIT.
FILE NO. ZS-4162
WHEREAS, on or about February 21, 2012, the County of Eagle, State of Colorado,
accepted for filing an application for a special use permit submitted by Keith and Carrie Brand
(hereinafter"Applicant") for the purpose of creating one(1) 850 square foot Accessory Dwelling
Unit (the "ADU")to be located within an existing single-family structure in the Rural Residential
("RR") Zone District; and
WHEREAS, the ADU is to be located within the lower level of a single-family structure
located at 135 Fawn Drive, on Lot 8, Filing No 2, Red Table Acres Subdivision(the"subject
property"), according to a Site Plan and Floor Plan made part of the application(attached hereto
as Exhibit"A"and incorporated herein), and;
WHEREAS,the subject property is non-conforming to the size requirements of the RR
Zone District, necessitating a Special Use Permit for the proposed ADU, and;
WHEREAS, access for the ADU is to be provided via a private thirty(30') foot "ROW
Easement" across and over portions of Lots 5 and 8, Red Table Acres Subdivision,Filing No. 2
(as depicted on a Final Plat recorded at Book No. 240, Page 556, and subsequently; on a
Correction Plat recorded at Book 261; Page 467), and;
WHEREAS,the Red Table Acres Home Owners' Association(the"HOA"), acting as
