HomeMy WebLinkAboutR12-116 Nottingham/Red Dirt Creek Authorization of Preservation Commissioner 5Jttt moved adoption of the following resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 2012- ( I RESOLUTION AUTHORIZING ANY OF THE EAGLE COUNTY COMMISSIONERS TO EXECUTE ALL DOCUMENTS NECESSARY FOR THE PRESERVATION OF THE NOTTINGHAM/RED DIRT CREEK PROPERTY WHEREAS, on July 17, 2012 the Board of County Commissioners of Eagle County, Colorado ( "Board ") approved the purchase of the Nottingham/Red Dirt Creek Property, representing 228 acres of land along the Colorado River Road (hereinafter the "Property" or the "Nottingham/Red Dirt Creek Parcel ") which is owned by Nottingham Investment Co., LLLP, a Colorado limited liability limited partnership; and WHEREAS, in anticipation of closing of the Property, the Board desires to grant any of the commissioners the authority to execute all documents associated with or necessary for the preservation of the Property and grant requirements all as determined in Eagle County's sole discretion. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board authorizes any Commissioner to execute on its behalf any and all necessary documents, instruments, papers or other forms necessary to permanently preserve and conserve the Property contemplated herein at such time as all closing issues and grant requirements are satisfied as determined by Eagle County, Colorado in its sole discretion. THAT, the Board of County Commissioners finds, determines and declares that this Resolution is necessary for the public health, safety and welfare of the citizens of the County of Eagle, State of Colorado.
