BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO 2012- O 1
RESOLUTION CONCERNING THE ASSIGNMENT RIDER AGREEMENT BETWEEN
EAGLE COUNTY, COLORADO AND UNION PACIFIC RAILROAD COMPANY
WHEREAS, the Open Space Advisory Committee voted to support funding and
successful completion of the "Colorado River Conservation and Recreation Project "; and
WHEREAS, the current owner of the Colorado River Ranch, River Ranch, LLC, entered
into an agreement for the construction, maintenance and use of a new access road beneath an
existing railroad bridge dated the 18 day of October, 2011 ( "Agreement "); and
WHEREAS, the parties now desire to assign that Agreement from River Ranch, LLC to
Eagle County, Colorado; and
WHEREAS, Eagle County desires to assume the Agreement to facilitate permanent
public access to the proposed boat launch area upon resolution of any outstanding closing issues
or grant requirements as determined by Eagle County in its sole discretion.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Board of County
Commissioners of Eagle County, Colorado:
THAT, upon resolution of any outstanding closing issues or grant requirements as
determined by Eagle County in its sole discretion, the Eagle County Board of County
Commissioners hereby authorizes any Eagle County Commissioner to execute the Assignment
Rider Agreement in a form approved by the Eagle County Attorney's Office.
THAT, the Eagle County Board of County Commissioners finds, determines and declares
that this Resolution is necessary for the public health, safety and welfare of the residents of the
County of Eagle, State of Colorado.
MOVED AND ADOPTED by the Board of County Commissioners of the County of
Eagle, State of Colorado, at its regular meeting held the i U day of `Dip . , 2012.
