RESOLUTION
OF THE BOARD OF COUNTY COMMISSIONERS
OF THE COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 2012 - q2

Variance from Improvement Standards
WHEREAS, Mr. Julian Nihill (the "Applicant ") is the owner of a five acre parcel of land (the
"Property") located at 7623 Kings Lake Road, with an Eagle County parcel identification number of 2469 -071-
00 -002; and
WHEREAS, The Applicant desires to construct a single family residence on the Property; and
WHEREAS, The Applicant seeks approval by the Board ofCounty Commissioners for variances from
existing County Regulation improvement standards relating to the safety of roads, as detailed in its application
(the "Application ") dated March 29, 2012 and the Staff Report submitted to the Board; and
WHEREAS, at a public hearing on the Application before the Eagle County Board of County
Commissioners on August 7, 2012, the Board heard the presentations of Eagle County Engineer Greg
Schroeder, the Applicant, and the .Applicant's representatives; examined the Engineering Staff Reports;
viewed the Power Point presentation of maps and views; received written comments of the public and referrals;
and qucricd staff, the Applicant and its representative concerning the Application; and
WHEREAS, at the conclusion of the hearing on August 7, 2012, it was moved, seconded and
unanimously voted that the Board grant each of the variances, concluding, after hearing and seeing the
evidence presented in these proceedings concerning variances from those.standards, that the hardship to the
Applicant from denial of the variances outweighs the potential impacts of the variances on public safety; and
instructing the County Attorney to prepare a Resolution formally approving the Application, including the
findings of the Board based on the above- described record evidence concerning hardship to.the Applicant and
the safety of the public; for consideration at a.mecting of the Board.
NOW, THEREFORE, THE BOARD OF COUNTY COMN USSIONERS FINDS, based on the
above- described record evidence and applying the criteria for evaluating- requests for variances from
improvement standards set out in applicable County Regulations, that the hardship to the Applicant from
denying the variances outweighs the impact of granting the variances on public safety.
NOW, THEREFORE, BE IT RESOLVED by theBoard of County Commissioners ofthe Countyof
Eagle, State of Colorado:

THAT the above - described application for variances be and hereby is approved as to each and every
variance therein requested, with the following conditions:
1. Except as otherwise modified by these conditions, all material representations of the
Applicant in this application and all public meetings shall be adhered to and considered
conditions of approval.
2. A grading permit will need to be issued to authorize the proposed work as shown in the
Applicant's Proposed Improvements. The grading permit will need to be designed by a
professional engineer.
3. The turn radius widening, as mentioned in the Applicant's Proposed Improvements, shall
have a turning analysis performed demonstrating that a fire engine can appropriately navigate
the turn. The extent of the widening shall be to not compromise the native bedrock and cause
the slope to have to be retained by mechanical means.
4. A detail shall be included on the grading permit plan that shows a typical road cross section to
be constructed and the amount of roadbase and base course to be added to the area to the west
of the bridge.
5. At the completion of the grading permit, the applicant's engineer of record shall submit a
signed and sealed letter certifying that the improvements have been constructed per the plans
and specifications in the grading permit.
THAT, the Board hereby finds, determines and declares that this Resolution is necessary for the
health, safety and welfare of the citizens of Eagle County.
THAT, the performance of the above conditions are necessary for the issuance for a building permit
and certificate of occupancy.

Eagle, State of Colorado, at its regular meeting held the 28 day of August, 2012.

A. CUT INTO BANK IN THIS AREA IN ORDER TO ADD MORE RADIUS
TO THIS CORNER THEREBY ALLOWING FOR A SMOOTHER TRANSI-
TION ONTO AND OFF OF THE BRIDGE.
B. REGRADE THIS AREA, TRADING OFF SOME OF THE UPPER FLAT IN
ORDER TO LESSEN GRADE. ALSO ADD TOPPING OF ROADBASE AS
NEEDED.
