RESOLUTION NO. 2012- U V
APPROVAL OF THE USE OF OPEN SPACE FUNDS FOR THE ACQUISTION OF THE
NOTTINGHAM -RED DIRT PROPERTY LOCATED IN EAGLE COUNTY, COLORADO
WHEREAS, the Eagle County Open Space Fund was created to acquire and protect outstanding natural
lands, wildlife habitat, historic ranches and scenic areas; and
WHEREAS, Eagle County is interested in acquiring the Nottingham -Red Dirt Property ( "Property ") to
protect its conservation values and provide public recreation benefits; and
WHEREAS, Eagle County has entered into a purchase contract dated March 14, 2012 to acquire the
Property from the landowner for $2,350,000; and
WHEREAS, Eagle County applied for and Great Outdoors Colorado has agreed to grant $1,175,000
towards the purchase of the Property; and
WHEREAS, it is currently unclear when the Great Outdoors Colorado grant funds will be available to
Eagle County; and
WHEREAS, Eagle County's Open Space Advisory Committee considered the acquisition of the Property
at its meeting on July 9, 2012 and has recommended the expenditure of $2,430,000 from the Open Space
Fund recognizing that reimbursement from Great Outdoors Colorado will occur at some point in the
future; and
WHEREAS, the Eagle County Board of County Commissioners has heard the recommendation from the
Open Space Advisory Committee and desires to use Open Space Funds for the acquisition and
preservation of the Property.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of
Eagle, State of Colorado:
THAT, subject to satisfaction of grant requirements and final approval of the same from Great Outdoors
Colorado, Open Space Funds in an amount up to $2,430,000 shall be used to fund the costs of the
acquisition (which costs shall include, but not be limited to, surveys, appraisals, environmental testing,
closing costs, title insurance and the like) and costs related to preservation and conservation of the
Property (which costs shall include, but not be limited to, cost of conservation easement conveyance and
management needs).
THAT, the Board of County Commissioners finds, determines and declares that this Resolution is
necessary for the public health, safety and welfare of the citizens of Eagle County, State of Colorado.
