COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 2012- d v G
APPROVAL OF THE USE OF OPEN SPACE FUNDS FOR THE PRESERVATION OF THE
COLORADO RIVER RANCH PROPERTY LOCATED IN EAGLE COUNTY, COLORADO
WHEREAS, the Eagle County Open Space Fund was created to acquire and protect outstanding natural
lands, wildlife habitat, historic ranches and scenic areas; and
WHEREAS, Eagle County is interested in permanent preservation of the Colorado River Ranch Property
( "Property ") to protect its conservation values and provide public recreation benefits; and
WHEREAS, The Conservation Fund has entered into a purchase contract dated March 17, 2012 to
acquire a conservation easement on the Property from the landowner for $5,500,000; and
WHEREAS, the conservation easement will be held by Colorado Open Lands; and
WHEREAS, as part of the transaction Eagle County is to receive three separate easements to
accommodate public access to the Colorado River, Colorado River Ranch school site and Bull Gulch
Wilderness Study Area; and
WHEREAS, Eagle County applied for and Great Outdoors Colorado has agreed to grant $2,791,700
towards the purchase of the conservation easement; and
WHEREAS, it is currently unclear when the Great Outdoors Colorado grant funds will be available to
Eagle County; and
WHEREAS, Eagle County's Open Space Advisory Committee considered the acquisition of the
conservation easement at its meeting on July 9, 2012 and has recommended the expenditure of up to
$5,850,000 from the Open Space Fund recognizing that reimbursement from Great Outdoors Colorado
will occur at some point in the future; and
WHEREAS, the Eagle County Board of County Commissioners has heard the recommendation from the
Open Space Advisory Committee and desires to use Open Space Funds for the preservation of the
Property.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of
Eagle, State of Colorado:
THAT, subject to satisfaction of grant requirements and final approval of the same from Great Outdoor
Colorado, Open Space Funds in an amount up to $5,850,000 shall be used to fund the costs of
preservation and conservation of the Property which costs shall include, but not be limited to, transaction
fees to The Conservation Fund, costs of conservation easement conveyance and management needs.
THAT, the Board of County Commissioners finds, determines and declares that this Resolution is
necessary for the public health, safety and welfare of the citizens of Eagle County, State of Colorado.
MOVED AND ADOPTED by the Board of County Commissioners of the County of Eagle, State of
Colorado, at its regular meeting held the 11 day of j UL' , 2012.
