• BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 2012- O'.Q 0
RESOLUTION APPROVING CONSERVATION AND TRAIL EASEMENTS, BASE
LINE REPORTS, TRAIL MAINTENANCE AGREEMENTS AND MANAGEMENT
PLANS ASSOCIATED WITH THE "HOMESTEAD L" PURCHASE AND
AUTHORIZING ANY OF THE EAGLE COUNTY COMMISSIONERS TO EXECUTE
ALL DOCUMENTS NECESSARY FOR THE PRESERVATION OF THE PROPERTY
WHEREAS, on September 1, 2011 the Board of County Commissioners of Eagle
County, Colorado ( "Board ") purchased approximately 160 acres of land adjacent to the
Homestead Subdivision in Eagle County, Colorado owned by East Lake Creek Ranch, LLP
(hereinafter the "Property" or the "Homestead L "); and
WHEREAS, the Board desires to enter into a conservation easement with Eagle Valley
Land Trust to permanently preserve the majority of the Property; and
• WHEREAS, as part of the conservation of the Property, the Board and Eagle Valley
Land Trust will approve a baseline report and enter into a management plan for operation and
management of the Property; and
WHEREAS, as part of the acquisition of the Property, certain adjacent property owners
have also agreed to permanently conserve certain lands as open space and to grant certain trail
easements for passive recreation to the County for the benefit of the public; and
WHEREAS, the Homestead Owners Association, Inc. has agreed to permanently
preserve approximately 138 acres as open space; and has agreed to grant a trail easement to
Eagle County across approximately 18 acres of land between Highway 6 and the Property and a
trail from the Homestead water tank to nearby US Forest Service land; and
WHEREAS, Creamery Ranch Homeowners Association, Inc. has contributed funds to
Eagle Valley Land Trust and has agreed to permanently preserve approximately 24 acres as open
space; and has agreed to grant a trail easement to Eagle County across that open space; and
WHEREAS, Edwards Metropolitan District has agreed to provide a public trail easement
across its property near the Homestead water tank; and
WHEREAS, the Board wishes to ensure that any of the County Commissioners has the
authority to execute all documents associated with the preservation of the Property including all
• trail easements and other related documents.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF

COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF
COLO DO:
T HAT, the Board authorizes any Commissioner to execute on its behalf any and all
necessary documents, instruments, papers or other forms necessary to conserve the Property
and to Obtain the various trail easements and maintenance agreements contemplated herein.
Such documents may include, but shall not be limited to,
a. Conservation Easement for the Property attached hereto as Exhibit A;
b. Management Plan for the Property attached hereto as Exhibit B;
c. Base Line Agreement for the Property attached hereto as Exhibit C;
d. Trail Easement with Homestead Owners Association, Inc. for the "18" Trail
attached hereto as Exhibit D;
e. Trail Easement with Homestead Owners Association, Inc. for the Water
Tank Trail attached hereto as Exhibit E;
f. Trail Easement with Edwards Metropolitan District for the Water Tank Trail
attached hereto as Exhibit F;
g. Trail Easement with Creamery Ranch Homeowners Association, Inc. III
attached hereto as Exhibit G;
h. Agreement with Creamery Ranch Homeowners Association, Inc. and
Edwards Metropolitan District regarding maintenance of trails and trail
easement area attached hereto as Exhibit H;
i. Agreement with Homestead Owners Association, Inc. and Edwards
Metropolitan District regarding maintenance of the Property and related
trails attached hereto as Exhibit I; and
j. any other necessary documents which in the opinion of staff are required or
desirable.
AT, the Board of County Commissioners finds, determines and declares that this
Resoluticn is necessary for the public health, safety and welfare of the citizens of the County of
Eagle, State of Colorado.
