HomeMy WebLinkAboutR12-029 Fulford Road Engineering Requirements H _ moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 2012 - A RESOLUTION EXCLUDING PRIVATE, SEASONAL RECREATIONAL RESIDENCES IN THE FULFORD HISTORICAL DISTRICT FROM CERTAIN COUNTY ROAD ENGINEERING REQUIREMENTS WHEREAS, Eagle County has engineering and dual access standards for roads providing access to residences in unincorporated Eagle County; and WHEREAS, such engineering and duality standards are intended to assure that new development in unincorporated Eagle County provide, to the extent possible, safe year round access and residences appropriate for year round residence; and WHEREAS, the Fulford Historical District has long been recognized in the County Land Use Regulations as a separate and unique zone district in unincorporated Eagle County, reflecting its long- standing historical development as a seasonal recreation residential area; and WHEREAS, usage of residences in the Fulford Historical District historically and currently is essentially seasonal and largely in the summer; and WHEREAS, residents of Fulford knowingly have chosen a remote, rustic location with risk of unavailability of emergency and other services inherent in the distance of Fulford from such services and the seasonal nature of access to Fulford; and WHEREAS, the County Planning Department and Engineering Department have determined that the certain access road engineering and duality requirements are not necessary or appropriate for private, seasonal use residences in the Fulford Historical District and should not be applied to such residences in the Fulford Historical District. NOW, THEREFORE, BE IT RESOLVED: THAT based on the judgment and recommendation of the County Planning Department and Engineering Department, the Board of County Commissioners authorizes and directs that County access road engineering standards and dual access requirements not be applied to non- commercial, seasonal cabins and other forms of residence in the Fulford Historical District. THAT the Board hereby finds, determines and declares that this Resolution is necessary for the public health, safety and welfare of the citizens of the County of Eagle, State of Colorado. MOVED, READ AND ADOPTED by the Board of County Commissioners of the County of Eagle, State of Colorado, at its regular meeting held the day of 2012.
