ACKNOWLEDGING A FINDING OF NO SIGNIFICANT IMPACT (FONSI) FOR THE
ADDITION OF ONE WATER WELL AND ASSOCIATED WATER PIPELINE TO THE

' WHEREAS, the Upper Eagle Regional Water Authority (UERWA) municipal
water supply system includes a small well field, known as the Berry Creek Wells, located
adjacent to the Colorado Mountain College(CMC) in Edwards; and
WHEREAS, in February 2004, the redevelopment and replacement of BC - I and
BC-2 in the Bt,-rry Creek well field was approved by Fagle County under a PONS' (resolution
No, 2004-039, File Number 1041-)00); and
WHEREAS, this new pioject proposes to add one additional water well and
associated water pipeline to the existing Berry Creek well field. The planned well, designated
Berry Creek #3. (13C-3), will be located just west of CMC, The pipeline component of the project
is located within an existing utility and transportation corridor which includes water and sewer
pipelines, electrical utilities, and the Denver Rio Grande Western railroad;
SEE EXHIBIT "A", Location Map, ATTACHED; and
WHEREAS, the proposed project. will allow the UERWA to expand the
combined capacity of the Berry Creek Well Field from 800 gpm to 1,350 gpm, which is the
maximum legally available diversion rate based upon the water rights for the wells decreed in
Case Nos, W-3999 and 84CW0233; and
WHEREAS, in accordance with Section 6.03.01 of the Eagle County Land Use
Regulations, an Applicant is required to obtain a Finding of No Significant Impact (FONSI) or a
Permit prior to engaging in development in an area or an activity that has been determined to be
of State interest; and
WHEREAS. in accordance with Sections 6 03.01(1) and 6.04 of the Eagle
County Land Use Regulations. the Director of Community Development (hereinafter
"Director"), has reviewed the Applicant's proposal, and all relevant support materials, and,
having considered applicable Permit Application Approval Criteria, has determined that the

Regulations, an Applicant is required to obtain a Finding of No Significant Impact (FONSI) or a
Permit prior to engaging in development in an area or an activity that has been determined to be
of State interest; and
WHEREAS, in accordance with Sections 6.03.03(1) and 6.04 of the Eagle
County Land Use Regulations, the Director of Community Development (hereinafter
"Director "), has reviewed the Applicant's proposal, and all relevant support materials, and,
having considered applicable Permit Application Approval Criteria, has determined that the
construction of the proposed project, without mitigation, is unlikely to have any significant
adverse impact to the County (see Determination of a Finding of No Significant Impact,
ATTACHED AS EXHIBIT "B "); and
WHEREAS, notice of the Director's Detenmination of a Finding of No
Significant Impact (FONSI) was given to all proper agencies, departments and the County's legal
newspaper as required by Section 6.03.03(3) of Eagle County's Land Use Regulations; and
WHEREAS, in accordance with Section 6.03.03(4)(a) of Eagle County's Land
Use Regulations, the 14 day period during which a Request for Reconsideration of the Director's
Determination of a Finding of No Significant Impact (FONSI), by the Board of County
Commissioners or any affected party, elapsed on September 8, 2011; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, a Finding of No Significant Impact (FONSI) for Berry Creek Well #3 has
been granted by the Director of Community Development.
THAT, the Board of County Commissioners hereby directs the Department of
Y p
Community Development to provide a copy of this Resolution to the Applicant.
THEREFORE, the Board of County Commissioners finds, detennines and
declares that this Resolution is necessary for the public health, safety and welfare of the citizens
of the County of Eagle, State of Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners of
the County of Eagle, State of Colorado, at its regular meeting held the i- 01 µ day of

BOARD NOTICE OF DETERMINATION
NOTICE IS HEREBY GIVEN that the Community Development Director for the County of
Eagle, State of Colorado has determined that a Finding of No Significant Impact (FONSI) IS
APPROPRIATE pursuant to Section 6.03.03.(1), Chapter VI of the Eagle County Land Use
Regulations, Guidelines and Regulations for Areas and Activities of State Interest of the County
of Eagle, State of Colorado, 2003, as amended, for the below referenced application.
FILE NO. / NAME: FONSI File No FNZ -3445 / Berry Creek Well. Addition of one water
well and associated water pipeline to the existing Berry Creek well field.

PROJECT DESCRIPTION:
The Upper Eagle Regional Water Authority (UERWA) municipal water supply system includes a
small well field, known as the Berry Creek Wells, located adjacent to the Colorado Mountain
College(CMC) in Edwards.
In February 2004, the redevelopment and replacement of BC -1 and BC -2 in the Berry Creek well
field was approved by Eagle County under a FONSI (resolution No. 2004 -039, File Number
1041- 0050).
This new project proposes to add one additional water well and associated water pipeline to the
existing Berry Creek well field. The planned well, designated Berry Creek #3 (BC -3), will be
located just west of CMC. The pipeline component of the project is located within an existing
utility and transportation corridor which includes water and sewer pipelines, electrical utilities,
and the Denver Rio Grande Western railroad. More specifically, the pipeline is located in a
clearing/access area that is within CMC's current construction site and the new pipeline will be
installed just north of the railroad right -of -way in a dry pasture that historically was cultivated
and used for grazing and the well house is located to the south of the pond in Freedom Park.
Leonard Rice Engineers, Inc. and UERWA are coordinating with CMC on BC -3 pre - construction
considerations (access, easements, reseeding, etc.).
The proposed project will involve installation of the following facilities:
EXHIBIT
Well BC -3 with a 14 -inch casing to a depth of 208 -feet and a maximum rated capacity of
800 gallons per minute (gpm); expected production rate is 550 gpm.
n 1,145 -feet of 8 -inch pipeline, buried to a depth of 7 to 10 -feet, connecting the well to the
well house and the well house to water distribution system.
The proposed project, will allow the UERWA to expand the combined capacity of the Berry
Creek Well Field from 800 gpm to 1,350 gpm, which is the maximum legally available diversion
rate based upon the water rights for the wells decreed in Case Nos. W -3999 and 84CW0233.
After the well is completed, UERWA will perform site reclamation as necessary to restore
landscaping and vegetation in a manner that is compatible with the surrounding areas.
Improvements will be located within existing easements, and no disturbance of wetlands, riparian
areas or other environmentally sensitive areas requiring mitigation will result. The cost of the
project has already been funded by the UERWA.
STAFF RECOMMENDATION:
Based on a review of the pre - application submittals and the information obtained during the pre -
application process, Staff HAS found that the construction and /or operation of the proposed
project requires no mitigation, and in its proposed location is unlikely to have any significant
adverse impact to the County. Staff recommends that a Finding of No Significant Impact be
issued.
DETERMINATION BY THE DIRECTOR OF COMMUNITY DEVELOPMENT
Pursuant to Section 6.03.03(1), and based on the review of the application, relevant support
materials and the recommendation of Staff, I have determined a Finding of No Significant Impact
( FONSI) is appropriate for File FNZ -3445. Upon completion of the public notice process, and
once the 14 day reconsideration period has elapsed without receipt of a request for call -up, Staff
will proceed, at my direction, to draft a resolution for the Board's signature indicating the Finding
of No Significant Impact for drilling and operating Berry Creek Well #3 as proposed.

PUBLIC NOTICE IS FURTHER GIVEN, pursuant to Section 6.03.03.(4).(b), Chapter VI of the
Eagle County Land Use Regulations, Guidelines and Regulations for Areas and Activities of
State Interest of the County of Eagle, State of Colorado, 2003, as amended, that any affected
party seeking a reconsideration of the Director's Determination of a FONSI shall file a written
request with the Board of County Commissioners within fourteen (14) days of the date of this
publication. If a written request is received, then the Board shall reconsider the Director's
Determination of the FONSI at the regularly scheduled meeting for which proper notice can be
accomplished. The affected party may request a reasonable extension if necessary.
