RESOLUTION NO. 2011- 1
FOR
RELEASE OF ASSIGNMENT OF CERTIFICATE OF DEPOSIT
NO. 41785
FOR ROAD CUT PERMIT NO. 3713
FOR
LAKE CREEK METROPOLITAN DISTRICT
WHEREAS, the Board of County Commissioners of the County of Eagle, State of
Colorado ( "Board ") granted Road Cut Permit No. 3713 to Lake Creek Metropolitan District for
work performed on Brook Place and Eagle Crest Drive, Lake Creek Meadows Subdivision
(Subdivider); and
WHEREAS, the Subdivider provided collateral in the form of Assignment of Certificate
of Deposit No. 41785 issued by Alpine Bank in the amount of $6,000.00 to guarantee the faithful
completion of the construction project; and
WHEREAS, both the Subdivider and the Engineering Department state that the work
required under the Road Cut Permit is satisfactory and the Engineering Department recommends
full release of the collateral (Exhibit "A "); and
WHEREAS, the release of the Assignment of Certificate of Deposit requires termination
of the Assignment by written Resolution of the Board of County Commissioners.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board hereby authorizes the full and final release of the collateral and the
Assignment of Certificate of Deposit No. 41785 be terminated and that the same be returned to
the Subdivider.
THAT, this document shall be recorded in the Records of the Eagle County Clerk
and Recorder, which shall be evidence that the warranty period for Lake Creek Metropolitan
District has been successfully completed and that the Subdivider's obligations under the
. Agreement are complete.
MOVED, READ AND ADOPTED by the Board of County Commissioners of the
County of Eagle, State of Colorado, at its regular meeting held the I (p day of August, 2011.

Lake Creek Metropolitan District — Assignment of Alpine Bank Certificate of Deposit
Inspection was made August 9, 2011, of the work performed under Construction in the Public
Way Permit #3713, for work performed on Brook Place and Eagle Crest Drive, Lake Creek
Meadows subdivision.
The work is satisfactory under the requirements of the permit and has successfully survived a
two year warranty period. Release of the Certificate of Deposit as collateral is recommended.
