Home My WebLink AboutR11-029 Minturn Cemetery District Term Corrections Commissioner moved adoption of the follo ng Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 2011 CONCERNING TERM CORRECTIONS TO THE MINTURN CEMETERY DISTRICT BOARD OF DIRECTORS WHEREAS, the Board of County Commissioners of the County of Eagle, State of Colorado (hereinafter "Board ") is authorized by Section 30 -20 -803, C.R.S. to make appointments to the Board of Directors for cemetery districts; and WHEREAS, pursuant to C.R.S. Section 30 -20 -803 the initial cemetery district board shall consist of three individuals to be appointed for one two -year term, one four - year term and one -six year term and thereafter for terms of six years; and WHEREAS, the staggering of terms for the Minturn Cemetery District has become inconsistent with the state statutes and the Board desires to clarify the term for each Minturn Cemetery District Board member so such terms are consistent with state statute; and WHEREAS, Ernest Chavez, was appointed to the Minturn Cemetery District Board of Directors for a term expiring on July 28, 2015, which term shall be corrected to expire on July 28, 2013, to maintain the staggered terms required by the Colorado Revised Statutes; and WHEREAS, John Sheehan, was appointed to the Minturn Cemetery District Board of Directors for a term expiring on August 28, 2012, which term shall be corrected to expire on July 28, 2015, to maintain the staggered terms required by the Colorado Revised Statutes; and. WHEREAS, Mildred "Jay" Raiola was appointed to the Minturn Cemetery District Board of Directors for a term expiring on July 15, 2016 which term shall be corrected to expire on July 28, 2017, to maintain the staggered terms required by the Colorado Revised Statutes; and WHEREAS, the appointments set forth herein do not constitute a contractual obligation of the County of Eagle or Board of County Commissioners; and the County of Eagle and the Board of County Commissioners are not legally bound for the respective terms of appointment as specified herein. The Board of County Commissioners has the authority in its sole discretion to change, add or abolish such appointments and to fill vacancies as it sees fit. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, Ernest Chavez, be and is hereby appointed to the Minturn Cemetery District Board for a term to expire on July 28, 2013 or until such time as he is reappointed or his successor has been appointed. THAT, John Sheehan, be and is hereby appointed to the Minturn Cemetery District Board for a term to expire on July 28, 2015 or until such time as he is reappointed or his successor has been appointed. THAT, Mildred "Jay" Raiola, be and is hereby appointed to the Minturn Cemetery District Board for a term to expire on July 28, 2017 or until such time as she is reappointed or her successor has been appointed. THAT, the board finds, determines and declares that this Resolution is necessary for the public health, safety and welfare of the citizens of the County of Eagle, State of Colorado.
