NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
Section 1. The Board hereby determines that all of the jurisdictional and other
requirements of Sections 32 -1 -207, C.R.S., have been fulfilled, including those relating to the
filing and form of the Service Plan Amendment, the form and publication of the public notice
of the hearing on the Service Plan Amendment and the type of public hearing held herein.
Section 2. Based upon the information contained within the Service Plan
Amendment and evidence presented to the Board of County Commissioners at the hearing,
the Board of County Commissioners hereby finds and determines as follows:
A. The District has submitted to the Board of County Commissioners evidence of
a pending application for a license or certificate of compliance to be issued by the Colorado
Department of Public Health and Environment for the District to operate as a health service
district.
B. That such evidence, by law and pursuant to Section 32 -1- 204(5), C.R.S.,
constitutes compliance with the requirement that satisfactory evidence be presented to the
Board of each of the following:
(i) There is sufficient existing and projected need for organized
services of the nature proposed in the Service Plan Amendment in the area serviced by the
District;
(ii) The existing services in the area to be served by the District are
inadequate for present and projected needs;
(iii) The District is capable of providing economical and sufficient
services to the area within its boundaries;
(iv) The area within the District has the financial ability to discharge
the proposed indebtedness on a reasonable basis;
(v) Adequate services are not and will not be available to the area
through Eagle County, or other governmental organization, including special districts, within
a reasonable time and on a comparable basis;
(vi) The facilities and service standards of the District are or will be
compatible with the facilities and service standards of Eagle County;
(vii) The Service Plan Amendment is in substantial compliance with
the Eagle County Master Plan;
(viii) The proposal is in compliance with the long -range water quality
management plan for the area; and
(ix) The Service Plan Amendment will be in the best interest of the
area served.
Section 3. The Service Plan Amendment of the District shall be and is hereby
approved without conditions.
Section 4. The Clerk to the Board is hereby directed to advise the District in
writing of this action and to attach a certified copy of this Resolution for the purpose of filing
the same with the District Court of Eagle County.
Section 5. All Resolutions, or parts thereof, in conflict with the provisions hereof,
are hereby repealed to the extent of such conflict only.
Section 6. This Resolution, immediately upon its passage, shall be authenticated
by the signatures of the Board of County Commissioners and the County Clerk and Recorder
and sealed with the corporate seal of the County.
Section 7. This Resolution is necessary for the public health, safety and welfare of
the citizenry County Eagle, the Count of Ea le, State of Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners of the
County of Eagle, State of Colorado, at its regular meeting held the 15th day of March, 2011.
