BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 2011- 6
A RESOLUTION APPROPRIATING $27,549 TO PARTIALLY FUND EAGLE VALLEY
LAND TRUST ADMINISTRATION OF A CONSERVATION EASEMENT ON
MILLER RANCH PUD, TRACT J
WHEREAS, the Miller Ranch PUD, approved by the Board of County Commissioners
on February 5, 2002, designates Tract J, an area of approximately 30.55 acres with
approximately 5000 square feet of Eagle River frontage, as Open Space; and
WHEREAS, over the years Tract J has become popular as a hiking and fishing site for
residents of and visitors to Eagle County; and
WHEREAS, the citizens of Eagle County have expressed support for permanently
preserving Tract J as open space; and
WHEREAS, the Eagle County Open Space Fund exists to acquire, maintain and preserve
open space in Eagle County; and
WHEREAS, the Eagle Valley Land Trust has indicated its willingness to accept a Deed
of Conservation Easement on Tract J to effectuate permanent preservation of Tract J as open
space; and
WHEREAS, acceptance of a deed of conservation on Tract J will cause the Eagle Valley
Land Trust to sustain initial and recurring costs associated with preparation and enforcement of a
conservation easement; and
WHEREAS, the Eagle Valley Land Trust has arranged for the Edwards Community
Authority, on behalf of the Edwards, Arrowhead and Berry Creek Metropolitan Districts, to
absorb a portion of such costs in the amount of $14, 475 and to contribute an additional $1,500
annually for maintenance needs on Tract J; and
WHEREAS, the Eagle County Citizens Open Space Advisory Committee met on
February 14, 2011, and, acting in accordance with Board of County Commissioners Resolution
2003 -97, as amended, considered the open space qualities of Tract J, and unanimously
recommended funding the conservation easement as provided herein in the amount of $27,549;
and
WHEREAS, the Board of County Commissioners, based on the provisions of the Miller
Ranch PUD, the open space merits of Tract J, the importance of permanently preserving Tract J
as open space, and the recommendation of the Citizens Open Space Advisory Committee,
supports granting a conservation easement to the Eagle Valley Land Trust on Miller Ranch PUD
Tract J.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board directs County Staff to work with the Eagle Valley Land Trust to
determine the appropriate terms of a conservation easement on Tract J and upon the agreement
of the staff and the Land Trust, in due course to present such conservation easement to the Board
for review, approval and execution; and
THAT, the Board hereby resolves to contribute $27,549 from the Eagle County Open
Space Fund toward the initial costs of the Eagle Valley Land Trust in accepting and enforcing a
Deed of Conservation Easement on Tract J, such amount to be paid to Eagle Valley Land Trust
promptly upon execution by the County and the Land Trust of a mutually agreed Deed of
Conservation Easement; and
THAT the Board of County Commissioners finds, determines and declares that this
Resolution is necessary for the public health, safety and welfare of the citizens of the County of
Eagle, State of Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners of the
County of Eagle, State of Colorado, at its regular meeting held the 8th day of March, 2011.
